The government of the Russian Federation and the Government of the Republic of Moldova which are hereinafter referred to as with the Parties in pursuance of article 11 of the Agreement on mutual recognition of the rights and regulation of the relations of property signed on October 9, 1992 (further imenuyetsyasoglasheniye) and according to the Protocol concerning property between the Russian Federation and the Republic of Moldova of February 9, 1993
agreed as follows:
Objects of property of the Russian Federation in the territory of the Republic of Moldova and objects of property of the Republic of Moldova are in the territory of the Russian Federation determined according to articles 2 and 4 of the Agreement.
Lists of objects which can be carried in accordance with the established procedure to property of the Russian Federation in the territory of the Republic of Moldova and to property of the Republic of Moldova in the territory of the Russian Federation are given in the appendices N 1 and 2 to this agreement and are its integral part. Lists can be added according to offers of the Parties.
Based on the objects determined in Article 1 of this agreement before their privatization joint businesses can be created according to the proposal of the owner according to the legislation of the state of the location of object. Conditions of creation of joint businesses are determined by concerned parties in their constituent documents.
The decision on incorporating and privatization of specific object is accepted by the owner who in 10-day time from the date of adoption of the relevant decision informs on it other Party.
For the solution of all questions on incorporating and privatization of specific object the owner creates commission of the representatives in he under which approval can involve representatives of other party, the necessary organizations and specialists.
The value assessment of the privatized property is made by the technique determined by the legislation of the state of the location of property at the time of creation of the commission on privatization of object.
In case of privatization of the objects relating to property of the Russian Federation and located in the territory of the Republic of Moldova, and the objects relating to property of the Republic of Moldova and located in the territory of the Russian Federation privileges according to the legislation of the state of the location of object are provided to members of labor collective of each of these objects and persons equated to them.
The size of the state share (block of shares) in property (authorized capital) of the privatized object which is taken out for realization at tender or auction, procedure and the place of their carrying out, and also instrument of payment are determined by the decision of the owner according to the current legislation of the Russian Federation and the Republic of Moldova.
Legal entities irrespective of the place of their registration, and also the physical persons irrespective of nationality recognized by buyers by the legislation of the state in the territory of which the auction or competition is held can be buyers of the privatized property.
The means received from privatization of the objects determined in Article 1 of this agreement are used according to the legislation of the state owner of these objects.
According to the mutual arrangement of the Party can make additions and changes which are drawn up by the relevant protocols to this agreement and are integral part of this agreement.
This agreement becomes effective from the date of its signing.
It is made in Moscow on April 12, 1996 in two authentic copies, everyone in the Russian and Moldavian languages, at the same time both texts are equally authoritative.
