1. Approve the enclosed Rules of marking of toys, the image of mark of conformity and technical requirements to it.

2. To provide to committee on technical regulation and metrology of the Ministry of the industry and trade of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its subsequent official publication in mass media.

3. To impose control of execution of this order on the vice-chairman of Committee on technical regulation and metrology of the Ministry of the industry and trade of the Republic of Kazakhstan Momyshev T. A.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of marking of toys, the image of mark of conformity and technical requirements to it

1. General provisions

1. Rules of marking of toys (further - Rules), the image of mark of conformity and technical requirements to it are developed according to the subitem 3) of Item 2 of article 5 of the Law of the Republic of Kazakhstan of July 21, 2007 "About safety of toys".

2. Rules, the image of mark of conformity and technical requirements to it extend in the territory of the Republic of Kazakhstan to accredited bodies on confirmation of conformity, and also the legal entities and physical persons implementing and extending toys.

3. In the territory of the Republic of Kazakhstan the toys which underwent confirmation of conformity, received the certificate of conformity and marked by mark of conformity are implemented and extend.

2. Procedure for marking of toys

4. Marking of toys mark of conformity is performed by the applicant (the manufacturer, the seller) of these products who underwent the procedure of confirmation of conformity.

5. In case of product labeling use the following processing methods:

branding of finished product, consumer packaging by mark of conformity by means of special brand;

drawing on products of the flat or relief image of mark of conformity during engineering procedure of production by means of the specialized industrial equipment;

application of packaging materials and forms of the accompanying documentation with drawing the image of mark of conformity on them;

attachment of specially manufactured carriers of mark of conformity (labels, labels, films).

6. The mark of conformity is applied on fixed part of each product of the certified products near marking by the trademark of the manufacturer (in case of its availability) or over designation of the regulating document on which compliance to requirements products are certified.

Drawing mark of conformity shall not worsen appearance of toy.

In case of impossibility of drawing mark of conformity directly on products (small products) it is applied on container or packaging.

Operational, technical and shipping documents shall be also marked by mark of conformity in that place where data on certification of products are provided (number and date of issue of the certificate of conformity, the name of the body which issued the certificate).

7. The image of mark of conformity is carried out by the technological method providing the accurate image, resistance to external impacts, durability during products expiration date.

8. Under the image of mark of conformity by the same technological method the code of the Republic of Kazakhstan and code of certification body with indication of area symbol in the location of body for confirmation of conformity according to appendix 4 to these rules is specified.

9. Marking on toys shall contain the following information in the state and Russian languages:

1) name of the manufacturer and (or) his trademark;

2) name of product;

3) main indicators of appointment and condition of application;

4) date of production;

5) country of goods' origin.

10. The example of product labeling by mark of conformity is given in appendix 5 to these rules.

3. Technical requirements to mark of conformity

11. The following types of the image of mark of conformity are established:

for the toys which underwent confirmation of conformity and conforming to the safety requirements established in technical regulations in form according to appendix 1 to these rules;

for the toys which underwent voluntary confirmation of conformity on the indicators determined by the applicant in form according to appendix 2 to these rules.

12. Graphical representation of mark of conformity should be accompanied with codes of the Republic of Kazakhstan and the body for confirmation of conformity which issued the certificate. The sizes for tracing of mark of conformity and codes correspond to the sizes specified in appendix 3 to these rules.

13. The size of mark of conformity is determined by the choice of the basic size R (appendix 3) from the following row - 2; 3; 5; 8; 12; 15; 20; 30; 50; 80; 125; 200 millimeters.

The code of the Republic of Kazakhstan and code of the body for confirmation of conformity which issued the certificate of conformity put at 0,7 R distance under graphical representation of mark of conformity, symmetrically rather vertical axis of mark of conformity font 0,5 R height;

code of the Republic of Kazakhstan - KZ.

The code of body for confirmation of conformity consists of the three-digit number of code of area and three-digit number assigned to body for confirmation of conformity.

14. The size of mark of conformity, method and the place of its drawing determine body for confirmation of conformity together with the applicant who acquired the product labeling right mark of conformity.

15. Execution of mark of conformity is carried out by one contrast color against the background of surface on which it is applied.
