For the purpose of single classification of homogeneous goods, effective customs control of the goods crossing border of the Republic of Moldova, and their identification according to the Combined commodity nomenclature approved by the Law No. 172 of July 25 2014, and also based on Article 141/2 of the Customs code of the Republic of Moldova (No. 1149-XIV of 20:07. 2000, Official monitor of the Republic of Moldova, special release of 1:01. 2007) I ORDER:
1. Approve methodology of classification of the pneumatic rubber tires and tires recovered or which were in the use (according to appendix).
2. To assign execution of this order to chiefs of customs.
3. To impose control of execution of this order on head department of information flows and customs statistics.
4. This order becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

to the Order of Customs Service of RM No. 235-O of August 6, 2009
This methodology was developed based on the basic rules of interpretation of the commodity nomenclature of the Republic of Moldova with use of the Explanations to the Harmonized commodity description and coding system developed by World Customs Organization, one of the parties of which is the Republic of Moldova, and also studying of the international practice.
According to Explanations to the Harmonized commodity description and coding system, in subline items 4012.11, 4012.12, 4012.13 and 4012.19 the term "the recovered tires and tires" means tires and tires at which the worn-out protector is removed from framework and new protector is created by two methods: (i) the protector is formed from unrvulcanized rubber on tire framework or (ii) the vulcanized protector unites with framework by means of the vulcanized rubber tape. Such tires and tires can be carried to tires and tires at which only the protector is recovered, the protector and the upper parts of sidewalls is recovered or the protector and sidewalls is recovered (fully or partially).
The tires which were in the use and tires of subline item 4012.20 can be subjected to cutting or deepening of the drawing of protector thanks to what worn out (but seen) flutes of protector go deep cutting. Such recovery is usually made on the tires and tires used on heavy vehicles (for example, buses or motor vehicles for transportation of goods). The tires and tires subjected to cutting or deepening of the drawing of protector which were in the use do not belong to subline items 4012.11, 4012.12, 4012.13 and 4012.19.
Tires and tires of subline items 4012.11, 4012.12, 4012.13, 4012.19 and 4012.20 can be also subjected to additional cutting of protectors in case of which cross and diagonal flutes are added by cutting to the existing drawing of protector. Such additional cutting does not influence reference of the recovered tires and tires to subline items 4012.11, 4012.12, 4012.13, 4012.19 or the tires which were in the use and tires of subline item 4012.20.
