The agreement between the Government of the Republic of Belarus and the Cabinet of Ministers of Ukraine on the simplified procedure for journey of the section of the highway Slavutich - the Chernobyl NPP which passes on the territory of the Republic of Belarus, workers, vehicles and loads of the Chernobyl NPP and the companies which perform activities in exclusion zone, and also the foreign specialists involved to implementation of the international projects on closing of the Chernobyl NPP

The government of the Republic of Belarus and the Cabinet of Ministers of Ukraine (further - the Parties),

proceeding from need of providing the operational solution of the tasks connected with performance of works on closing of the Chernobyl NPP (further - the CNPP),

for the purpose of creation of the simplified procedure for journey of the section of Slavutich CNPP Highway which passes on the territory of the Republic of Belarus, workers, vehicles and loads of the CNPP and the companies which perform activities in exclusion zone, and also the foreign specialists involved to implementation of the international projects on closing of the CNPP (further - participants of transit),

considering that this section of the road passes on the territory of the Republic of Belarus,

agreed as follows:

Article 1

For the purpose of implementation of this agreement of the Party determine competent authorities.

Competent authorities of the Parties are:

from the Belarusian Side

1. State boundary committee,

2. State Customs Committee,

3. Ministry of Emergency Situations.

from the Ukrainian Side

1. Administration of the State Border Service,

2. State Customs Service,

3. The ministry of questions of emergency situations and for protection of the population against effects of the Chernobyl catastrophic crash.

Article 2

Participants of transit for crossing of the Belarusian-Ukrainian frontier for the purpose of the subsequent transit of the section of Slavutich CNPP Highway use for physical persons and vehicles the valid documents, for loads - internal documents of Ukraine, and also the omission of the established sample (further - the omission).

Conditions, procedure for issue and samples of omissions, the list of the companies of exclusion zone, and also quantity and type of vehicles which can perform transit in the simplified procedure are determined by competent authorities of Ukraine in coordination with competent authorities of the Republic of Belarus.

Article 3

Concerning the participants of transit crossing the Belarusian-Ukrainian frontier according to this agreement the simplified procedure for the omission is established, and also they are exempted from customs examination.

When crossing frontier at the road check point "Komarin (Republic of Belarus) - the Slavutich (Ukraine)" in the presence of the omission execution of any additional documents is not made.

The Belarusian Side reserves the right control of transit of persons, vehicles and cargo transfer according to the national legal system in the presence of good causes.

Article 4

Participants of transit cannot deviate route "Slavutich CNPP", take the load which is not specified in shipping documents, and also persons which do not have omissions.

In case of transportation of loads their sealing is in addition applied.

Responsibility for sealing of loads, safety of seals in the course of transit on the territory of the Republic of Belarus is assigned to the consignor. Samples of prints of seals are timely transferred by competent authorities of Ukraine to competent authority of the Republic of Belarus.

In case of identification of violations participants of transit bear responsibility according to the legislation of the Republic of Belarus.

Article 5

The Belarusian Side provides lanes at the road check point "Komarin (Republic of Belarus) - the Slavutich (Ukraine)" to participants of transit.

The Ukrainian Side takes part in arrangement and providing with technical means the Belarusian part of the check point "Komarin (Republic of Belarus) - the Slavutich (Ukraine)" in the amounts necessary for providing the simplified procedure for transit and approved by both Parties.

The parties create from representatives of the competent authorities specified in Article 1 of this agreement, joint working group which will determine amounts of works and hardware of the check point.

Agreed volumes of works and hardware of the check point, and also terms of their realization are determined by the separate Protocol which is integral part of this agreement.

Article 6

By mutual consent of the Parties changes and additions which are drawn up by separate protocols which are integral part of this agreement can be made to this agreement.

Article 7

All disagreements arising in case of implementation of this agreement will be solved the Parties by consultations and negotiations.

Article 8

Action of this agreement does not affect obligations of the Parties according to other international treaties signed by the Republic of Belarus and Ukraine.

Article 9

This agreement is signed for a period of five years and becomes effective from the date of receipt through diplomatic channels of the last written notice of accomplishment of the interstate procedures by the Parties necessary for its entry into force.

This agreement will be prolonged automatically for one year if any of the Parties does not declare intention to stop its action.

This agreement it can be terminated the either party by the direction of the written notice diplomatic channels to other Party. In this case the Agreement voids in 60 days from the date of receipt of the specified notification.

From the effective date this agreement the Agreement between the Cabinet of Ministers of the Republic of Belarus and the Government of Ukraine on the simplified procedure for crossing of frontier by employees of the companies, organizations and organizations of exclusion zone of the Chernobyl nuclear power plant signed in Minsk on December 16, 1994 voids.

It is made in Chernihiv on January 20, 2009 in duplicate, everyone in the Russian and Ukrainian languages, at the same time both texts are authentic.
