About measures for development and expansion of family entrepreneurship without formation of legal entity and mechanical activities

In pursuance of the resolution of the Cabinet of Ministers of September 12, 2008 "About measures for implementation of the Convention on the minimum age for employment and the Convention on prohibition and immediate measures for eradication of the worst forms of child labor ratified by the Republic of Uzbekistan" and for the purpose of further development of family entrepreneurship and workmanship as one of the most effective remedies of increase in the income of household budgets, involvement of the unoccupied population in productive activity and preserving centuries-old traditions of national crafts the Cabinet of Ministers decides No. 207:

1. Agree with the offer of the Ministry of Labour and Social Protection of the population, the Ministry of Economics, State committee on demonopolization, support of the competition and entrepreneurship and Chamber of Commerce and Industry of the Republic of Uzbekistan on reference of mechanical activities of citizens to forms of home work.

2. Approve Regulations on procedure of family entrepreneurship without formation of legal entity and mechanical activities according to appendix.

3. To the ministry of employment and employment relationships of the Republic of Uzbekistan:

together with the Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent interested in the ministries and departments, Hunarmand Association to provide coordination and support of development of the Family entrepreneurship and mechanical activities on system basis;

together with the State committee according to the statistics to organize accounting of the citizens participating in family entrepreneurship, and also performing mechanical activities, including pupils of handicraftsmen as occupied with home work;

provide inclusion of parameters of development of family entrepreneurship and workmanship in forecast parameters of territorial programs of creation of new workplaces;

provide allocation for 2009 to 1 billion bags from funds of the State fund of assistance of employment for provision of soft credits for development of family entrepreneurship and workmanship, including their preparation according to the training program with the Usto-shogird method.

4. Recommend to the State fund of assistance of employment, Mikrocredit to bank and other commercial banks to expand allocation in accordance with the established procedure of preferential microdevelopment loans of family entrepreneurship and workmanship, the organization of home work.

5. To Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas, areas and cities, ministries and departments:

promote development of workmanship by provision in lease of rooms, branch and arrangement of special places, the organization of network of specialized shops and booths for trade in the products and goods made by handicraftsmen;

give practical help in ensuring subjects of workmanship with local raw materials, materials, tools and means of small-scale mechanization, holding exhibitions of products of workmanship, creation of necessary conditions for training of youth in skills of workmanship;

together with bodies for work to provide control of observance of procedure of family entrepreneurship and mechanical activities.

6. To the Ministry of Labour and Social Protection of the population of the Republic of Uzbekistan together with the interested ministries and departments to make in the Cabinet of Ministers offers on the changes and amendments in regulatory legal acts following from this resolution in a month.

7. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan Azimov R. S.

Regulations on procedure of family entrepreneurship without formation of legal entity and mechanical activities

I. General provisions

1. This Provision determines procedure of family entrepreneurship without formation of legal entity and mechanical activities in the Republic of Uzbekistan.

2. For the purpose of this provision the following basic concepts are used:

family entrepreneurship - the joint business activity of physical persons without formation of legal entity performed by spouses based on their common property belonging to them as common joint property, and based on personal labor of spouses and the family members helping them;

family members - the spouses, the spouse, parents or adoptive parents and children aged from 15 years including adopted and adopted;

mechanical activities (workmanship) - activities of physical persons without formation of legal entity on production of products or goods (works, services) of workmanship;

the handicraftsman (the master handicraftsman, lips) - physical person, independently or by means of pupils making products or goods (works, services) mechanical activities on the basis of the traditional technologies oriented to use of special skills, tools and means of small-scale mechanization meeting historically developed requirements to functional features of products and national esthetic regulations;

the handicraftsman's pupil - physical person aged from 15 years is also more senior, studying at the handicraftsman of activities for production of products or goods (works, services) of mechanical activities.

II. State registration, registration of subjects of family entrepreneurship and mechanical activities and execution of allowing documents

State registration, registration of subjects of family entrepreneurship and mechanical activities and execution of allowing documents are performed according to the procedure for state registration, registration of subjects of entrepreneurship and execution of allowing documents established by the legislation.

4. In case of state registration of subjects of family entrepreneurship the certificate on state registration of the individual entrepreneur of the established sample in which it is specified that individual activities are performed in the form of family entrepreneurship is granted, and also the family members performing joint business activity are specified.

5. In case of state registration, registration of subjects of family entrepreneurship and execution of allowing documents on behalf of the subject of family entrepreneurship one of spouses, from the notarized consent of other spouse acts.

6. In case of state registration of subjects of mechanical activities the certificate on state registration of the individual entrepreneur of the established sample, with indication of the directions of mechanical activities according to appendix No. 1 to the Presidential decree of the Republic of Uzbekistan of November 17, 2017 is granted No. UP-5242 "About Measures for Further Development of Workmanship and Full Support of Handicraftsmen".
