About approval of regulations on order of registration of the vehicles used for transportation of dangerous goods, procedure for the admission of vehicles to transportation of dangerous goods, procedure for issue of the certificate on training of the driver of the motorized vehicle for accomplishment of transportation of dangerous goods

According to article 10 of the Law of the Republic of Belarus of January 5, 2008 "About traffic" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve enclosed:

Regulations on order of registration of the vehicles used for transportation of dangerous goods;

Regulations on procedure for the admission of vehicles to transportation of dangerous goods;

Regulations on procedure for issue of the certificate on training of the driver of the motorized vehicle for accomplishment of transportation of dangerous goods.

2. To republican state bodies to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

3. This resolution becomes effective since August 21, 2009.

Regulations on order of registration of the vehicles used for transportation of dangerous goods

1. This Provision developed according to the paragraph the eighth article 10 of the Law of the Republic of Belarus of January 5, 2008 "About traffic" (The national register of legal acts of the Republic of Belarus, 2008, No. 14, 2/1410; 2009, No. 119, 2/1569), is established order of registration, removals from accounting of the vehicles used for transportation of dangerous goods, and modification of the documents connected with their registration.

2. For the purposes of this provision the following terms and their determinations are used:

the vehicle owner, used for transportation of dangerous goods (further - the owner), - the legal entity, including the Ministry of Defence, the Ministry of Internal Affairs, Committee for State Security, the State boundary committee, other troops and military forming (further if other is not determined, - state bodies), and also the bodies, the organizations, divisions and military units which are under their supervision, or the individual entrepreneur performing operation of the vehicle belonging to them on the property right, the right of economic maintaining or operational management or on other bases, stipulated by the legislation or the agreement;

record card of the vehicle used for transportation of dangerous goods (further - record card), the document issued in the procedure established by this Provision to the owner and the certifying fact of registration of the vehicle used for transportation of dangerous goods;

the vehicles used for transportation of dangerous goods (further - vehicles), - the motorized vehicles and trail cars intended for movement in structure with motorized vehicles, which are carrying out transportation of dangerous goods.

3. Registration, removal from accounting of vehicles and modification of the documents connected with their registration and also issue of record cards in form according to appendix 1 is performed by Department on supervision of safe operation in the industry of the Ministry of Emergency Situations and its structural divisions (further - the Gospromnadzor), and concerning the vehicles belonging to state bodies (the bodies, the organizations, divisions and military units which are under their supervision) - the divisions determined by state bodies (further - the registering divisions). The record cards issued before entry into force of this provision are not subject to replacement in connection with entry into force of this provision.

4. The Gospromnadzor, the registering divisions register vehicles under condition:

state registration of the vehicle in the State automobile inspection of the Ministry of Internal Affairs or registration divisions of state bodies - for the vehicles belonging to state bodies (the bodies, the organizations, divisions and military units which are under their supervision);

passings in accordance with the established procedure the state technical inspection and obtaining in cases, stipulated by the legislation, permissions to the admission of the vehicle to participation in traffic;

availability at the owner of permission to the right of use of the specialized vehicle of foreign production in the Republic of Belarus - for stationary established tanks and cages.

5. For registration of vehicles the owner represents to the Gospromnadzor, the registering divisions the statement in form according to appendix 2, and also operational documents (the passport, the maintenance manual, the form or their duplicates).

In case of removal from accounting of vehicles and modification of the documents connected with their registration, the owner shall return record card on check-in location.

6. The decision on registration of vehicles or on refusal in their registration is accepted by the Gospromnadzor, the registering divisions within five working days after registration of the arrived statements.

Vehicles are registered in the magazine of registration, removal from accounting of the vehicles used for transportation of dangerous goods, and modification of the documents connected with their registration in form according to appendix 3 (daleezhurnat) on electronic and paper carriers then record cards are issued to owners.

Operational documents (the passport, the maintenance manual, the form or their duplicates) after registration (refusal) return to registration of vehicles to the owner.

The Gospromnadzor, the registering divisions refuse to the owner vehicle registration in case of failure to carry out of the conditions determined in item 4 of this provision, and (or) specifying in the statement of the data untrue.

In case of refusal in vehicle registration to its owner within five working days from the date of decision making it is reported in writing about cause of failure.

7. Modification of the documents connected with registration of vehicles is carried out within five working days from the date of registration of a statement in form according to appendix 2 to this Provision in case of change:

names of the legal entity or surname, name, middle name of the individual entrepreneur;
