For the purpose of execution of provisions of Item h) parts (1) articles 15 and 50 of the Law on service in customs authorities No. 1150-XIV of July 20, 2000. (The official monitor of the Republic of Moldova, 2000, Art. No. 106-108, 765), with subsequent changes and amendments, DECIDES: the Government

Approve the Code of ethics of the employee of customs authority it (is applied).

Code of ethics of the employee of customs authority

Chapter I. General provisions

1. The code of ethics of the employee of customs authority (further the Code) establishes obligatory regulations of professional ethics and pursues the aim of regulation of the basic principles of behavior for prevention of situations which can affect reputation of the employee of customs authority in particular and customs authorities in general.

2. The purpose of this Code is ensuring provision of high-quality services and informing the public on rules of conduct of the employee of customs authority which observance shall be guaranteed.

3. This Code stimulates the public actively to promote accomplishment of the main objective set for customs authorities.

Chapter II. Code purpose, principles and professional values of the employee of customs authority

4. This Code is intended for ensuring carrying out customs control at the highest professional level.

5. The fundamental principles of service in customs authorities is the following:

a) equality - impartiality, honesty and justice to all persons to whom the employee of customs authority in connection with execution of public function contacts;

b) service quality - carrying out best quality customs control and according to the highest standards so that to provide both realization of function of customs control, and free activities of the taxpayer during control;

c) confidentiality - nondisclosure by the employee of customs authority of data which has owing to the official position, without the permission of persons authorized on that, except as specified, provided by the law.

The employee of customs authority will be careful in use and storage of accumulated informations, and will not use information and documents which he studied, for the purpose of, contradicting the law.

The employee of customs authority shall observe confidentiality of the data received during the professional activity.

The employee of customs authority who received any data during the professional activity not use this information in own favor or for benefit of the third parties;

d) impartiality - obligation of the objective and neutral attitude of the employee of customs authority towards any private, economic, political, religious or other interest;

e) independence - execution of office tasks and obligations according to the competences established for the hierarchical level occupied in customs authorities without unreasonable intervention of other customs officers, citizens or structures of the power;

f) moral integrity - prohibition of the application, acceptance or transfer by the employee of customs authority, directly or indirectly, any benefit or profit in case of accomplishment of public function or any abuse of the position;

g) legality - observance by the employee of customs authority in case of execution of the obligations of the Constitution of the Republic of Moldova, the current legislation and international treaties which party the Republic of Moldova is;

h) loyalty - commitment to organization and values advanced by it, the conscientious attitude shown by the employee of customs authority on own initiative to tasks of organization, respect for hierarchy in organization, honesty in relations, observance of the truth and justice, conscientious attitude to execution of service duties, accomplishment of the undertaken obligations, ensuring confidentiality in case of execution of service;

i) professionalism - execution of the service duties is responsible, competent, effective, accurate and is fair.

6. Professional values of the employee of customs authority is the following:

a) experience and competence - the employee of customs authority in the activities is based on the sensible professional judgment provided with proper preparation and competence of staff of Customs Service;

b) command spirit - customs officers interact according to the general principles and interests of Customs Service;

c) the tradition - Customs Service, as the member of World Customs Organization, acquired constructive traditions which are applied by customs officers that society felt succession of values of customs authorities.

Chapter III. Professional ethics, obligations and prohibitions of the employee of customs authority

7. For execution of service duties the employee of customs authority shall:

a) observe provisions of the current legislation, internal regulations, and also the professional regulations specific to the performed activities;

b) observe and apply the fundamental principles of service in customs authorities;

c) be fair in case of accomplishment of service duties and show the civilized attitude towards persons to whom comes into contact in connection with execution of service duties;

d) be loyal to organization in which works;

e) fulfill service duties honesty and responsibly;

f) be in all circumstances objective and impartial;

g) not come under influence of private interests and political pressure on duty;

h) have always the behavior keeping and strengthening trust of the public in integrity, impartiality and efficiency of Customs Service, balanced and non-discriminatory, to have to all identical approach, observing their rights and advantage;

i) keep confidentiality of the carried-out transactions, materials and information with which gets acquainted in case of function execution;

j) support and perform activities for fight against offenses, corruption, illicit trafficking in goods and values and other illegal activities;

k) report to the higher chief about all cases of the offer to be effective contrary to regulations of ethics and discipline, and also about illegal actions which became known to it in case of function execution;

l) not come under in case of decision making influence from persons or structures both from the organization, and because of its limits, especially in situation when it can lead to creation of certain benefits for any face or group of people, and behavior, both public, and private, shall not do it vulnerable for undue influence from other person;
