About approval of Fire safety regulations for cult constructions

1. Approve Fire safety regulations for cult constructions which are applied.

2. To heads of State department of fire safety, the head departments of the Ministry of Emergency Measures of Ukraine in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol, to rectors of higher educational institutions, the Vinnytsia highest professional school of civil protection of the Ministry of Emergency Situations to report and organize studying by staff of the divisions of requirements of Fire safety regulations subordinated to them for cult constructions.

3. This order becomes effective from the date of official publication.

4. To legal support division (Sukhomlin O. M.) and to the Ukrainian research institution of fire safety (YA.I. Hamster) submit this order on state registration to the Ministry of Justice of Ukraine in accordance with the established procedure.

5. To impose control over the implementation of this order on the deputy minister Tretyakov V. M.

Fire safety regulations for cult constructions

1. General provisions

1.1. Fire safety regulations for cult constructions (further - Rules) establish requirements of fire safety during construction, reconstruction, capital repairs, technical retrofitting and operation of such constructions.

1.2. These rules are developed according to the Law of Ukraine "About fire safety" and the resolution of the Cabinet of Ministers of Ukraine of 01.07.2002 N 870 "About approval of the Program of ensuring fire safety for the period till 2010" and are obligatory for accomplishment by legal entities and physical litsamipredpriyatiya irrespective of patterns of ownership and type of their activities.

1.3. When ensuring fire safety in cult constructions of Ukraine it is also necessary to be guided by the Fire safety regulations in Ukraine approved by the order of the Ministry of Emergency Situations of 19.10.2004 of N 126, registered in the Ministry of Justice of Ukraine 04.11.2004 for N 1410/10009 (further - Fire safety regulations in Ukraine).

1.4. In case of change of functional purpose of the existing houses and constructions under cult construction it is necessary to fulfill requirements of Item 1.3 of these rules.

1.5. During reconstruction, restoration and capital repairs of the cult constructions which are monuments of architecture, history and culture except provisions of these rules, it is necessary to carry out regulations of the current legislation of rather cultural heritage. Fire-proof actions for the cult constructions which are historical and cultural monuments shall be accepted individually for each house taking into account its features and be approved with central or territorial authorities of the state fire supervision.

1.6. If space-planning and engineering solutions, ways of evacuation and emergency exits on objects of immovable cultural heritage which are used as cult constructions it is impossible to bring into accord with requirements of the state construction regulations and these Rules, it is necessary to develop complex of the compensating fire-proof actions which do not reduce the value of such constructions and to approve them according to the legislation.

1.7. Ensuring fire safety in cult constructions is assigned to priors of these constructions and persons authorized by them.

During new construction or reconstruction of cult constructions ensuring fire safety is assigned to the customer or person authorized by it and the construction organization.

1.8. In cult constructions it is necessary to provide such requirements of fire safety:

preserving the bearing capability of designs during certain time;

restriction of spread of fire and smoke in construction, and also on the next constructions and the adjacent territories;

ensuring evacuation of people from construction or their rescue different way;

safety of rescue teams.

1.9. It is necessary to make reconstruction, technical retrofitting, restoration, capital repairs of cult constructions only in the presence of the corresponding project documentation which is approved in accordance with the established procedure.

1.10. In these rules the terms below are used in such value:

Cult construction - the building (construction) intended for holding church services and religious practices (Christian: cathedrals, churches, chapels, belltowers, houses of worship and so forth; Muslim mosques; Judaic synagogues and so forth).

The prayful hall - the room for believers and visitors in cult construction during church services and religious practices.

Altar - the most sacred part of the Christian temple located from its East side. In Orthodox churches the altar is separated by iconostasis.

Handicapped national groups - on DBN B.2.2-17-2006 "Availability of buildings and constructions to handicapped national groups".

Fire prevention regime - complex of the established standards of behavior of the people, rules of performance of works and exploitation of object aimed at providing its fire safety (on GSTU 2272:2006 "Fire safety. Terms and determinations of the basic concepts").

Devices using naked flame - means of cult appointment for lighting of rooms and attributes of religious practices in which use of naked flame is caused by specifics of rituals (icon lamps, candles, candlesticks, torches, incensories and so forth).

Evacuation lighting - the lighting intended for evacuation of people from rooms during emergency shutdown of working light.

Illumination of safety - lighting for further work during emergency shutdown of working light.
