The agreement between the Government of the Russian Federation and the Government of the Republic of Armenia on interstate military transportations for the benefit of the Russian military base

of January 26, 1996

The government of the Russian Federation and the Government of the Republic of Armenia which are referred to as further with the Parties

being guided by the Contract between the Russian Federation and the Republic of Armenia on legal status of the Armed Forces of the Russian Federation which are in the territory of the Republic of Armenia of August 21, 1992, the Contract between the Russian Federation and the Republic of Armenia on the Russian military base in the territory of the Republic of Armenia of March 16, 1995,

agreed as follows:

Article 1

1. For the purposes of this agreement the specified terms mean:

"military loads" - the loads belonging to the Armed Forces of the Russian Federation and intended for maintenance of combat readiness and ensuring activities of the Russian military base;

"interstate military transportations" - transportations of troops, military loads, persons which are part of the Russian military base in the territory of the Republic of Armenia and members of families of these persons on the territory of the Republic of Armenia for the benefit of the Russian military base;

"guard" - the armed division of the Armed Forces of the Russian Federation which is carrying out task on protection, defense and maintenance of military loads.

2. The determinations containing in article 1 of the Contract between the Russian Federation and the Republic of Armenia about the Russian military base in the territory of the Republic of Armenia of March 16, 1995 are applied to this agreement.

Article 2

1. Interstate military transportations are performed by railway, air and road transport.

2. The Armenian Side provides free and safe transportation on the territory of the Republic of Armenia of the military and special equipment, arms, ammunition and military and technical property at the expense of means of the Ministry of Defence of the Republic of Armenia.

3. The parties provide cooperation between relevant organs of management of the Parties concerning the organization and implementation of military transportations.

Article 3

The parties are guided by the agreements on transportation of dangerous goods signed within gosudarstvuchastnik of the Commonwealth of Independent States, and also keep the procedure for planning, accomplishment and safety of transportations of dangerous goods which was earlier operating in the territory of the former USSR if it does not contradict the procedure established by the regulating documents signed within the State Parties of the Commonwealth of Independent States.

Article 4

The parties are guided by the Temporary instruction for planning of interstate rail haulings and the Provisional regulations on the organization of military interstate rail haulings of the Commonwealth of Independent States approved by the decision of the Council of Ministers of Defense of the State Parties of the Commonwealth of Independent States on November 4, 1992.

Article 5

1. The organization of interstate military transportations by air transport is performed in coordination with the relevant competent authorities of the Parties which are responsible for work of air transport.

2. Aircrafts of the Armed Forces of the Russian Federation perform flights (flights) in airspace of the Republic of Armenia according to requests according to the procedure and along the routes determined in coordination with relevant organs of the Parties. The Armenian Side promotes free flights (flights) in airspace of the Republic of Armenia of aircrafts of the Armed Forces of the Russian Federation.

3. Use by aircrafts of the Armed Forces of the Russian Federation of airspace of the Republic of Armenia according to the approved plans of flights, and also take off and landing of aircrafts of the Armed Forces of the Russian Federation in military airfields of the Republic of Armenia are performed gratuitously. Maintenance and filling of aircrafts of the Armed Forces of the Russian Federation are made by aviation specialists of Armed Forces of the Republic of Armenia in the mutual arrangement of authorized bodies of the Parties and paid with the Russian Side for clearing settlement at the prices operating in the Republic of Armenia.

Actions of this Item temporarily extend to the civil airports of the Republic of Armenia in cases of impossibility to accept aircrafts of the Armed Forces of the Russian Federation in military airfields of the Republic of Armenia.

4. Management of flights of aircrafts of the Armed Forces of the Russian Federation in airspace of the Republic of Armenia, exchange of information and correspondence on the line of governing bodies of air traffic is performed in Russian.

Article 6

Interstate military transportations by road transport are performed both in single procedure, and as a part of columns according to traffic regulations of the Republic of Armenia.

Article 7

1. Military loads are subject to protection by guard on all transit from initial to terminal point.

2. Material and household providing guard is made by the Russian Side.

3. The Armenian Side takes the measures providing assistance to guard in accomplishment of the tasks set for them including provision by it in case of need means of communication and implementation of material and household providing, medical and other types of servicing, and also first-priority departure of guard and their arms to the places of permanent deployment.

4. Separate types of military loads can be transported if it is stipulated by the legislation the Russian Federation, without maintenance by guard.

Article 8

Border and customs control, and also execution of the omission of military loads through frontier of the Republic of Armenia are made at the established check points by boundary and customs authorities of the Parties based on the military omissions which are drawn up by the Ministry of Defence of the Russian Federation without collection of customs payments and application to military loads in the amounts determined by the Ministry of Defence of the Russian Federation, measures of economic policy, other import restrictions and export and also without submission of the cargo customs declaration.

Article 9

Persons which are part of the Russian military base members of families of these persons, and also staff of guard cross frontier of the Republic of Armenia on visa-free basis, under identity documents, and also according to the lists of the military personnel certified by relevant organs of the Ministry of Defence of the Russian Federation.
