The agreement between the Government of the Russian Federation and the Government of Turkmenistan on cooperation in development of fuel and energy complexes

of April 15, 1994

The government of the Russian Federation and the Government of Turkmenistan which further are referred to as with the Parties

being guided by the Agreement between the Government of the Russian Federation and the Government of Turkmenistan on free trade of November 11, 1992, the Ashgabat declaration on development of cooperation and enforcement of trust in the relations between the State Parties of the Commonwealth of Independent States of December 24, 1993, the Agreement on cooperation in the field of investing activities of gosudarstvuchastnik of the Commonwealth of Independent States of December 24, 1993,

recognizing importance of deepening of mutually beneficial long-term economic cooperation and interest of the Parties in effective use of source of raw materials,

considering need of creation of conditions for joint development and implementation of target programs and projects of cooperation for industries of fuel and energy complexes,

agreed as follows:

Article 1

The parties on the basis of mutual advantage, mutual assistance and mutual respect of economic interests of each other will develop in every possible way cooperation in industries of fuel and energy complexes.

Article 2

The parties will take measures to preserving and expansion of the developed industry and cross-industry bonds for supplies of equipment, materials, products and other products for fuel and energy complexes.

Article 3

The parties will promote development of long-term cooperation in search and prospecting drilling, development and arrangement of oil and gas fields, construction and operation oil, gazo-and oil pipelines, transit of oil and gas for export, constructions of power lines, reconstruction of objects of power on mutually advantageous conditions with attracting investors, including the third countries.

The parties agreed that the construction jointly of the constructed objects shall be performed on the basis of single regulating documents.

The parties will charge to the Ministry of Fuel and Energy of the Russian Federation and the Ministry of oil and gas of Turkmenistan to develop and approve the Program of cooperation between fuel and energy complexes of Russia and Turkmenistan till 2000.

Article 4

The parties cooperate in implementation of programs of investigation and development of mineral resources of bottom of the Caspian Sea which is object of joint use of the Caspian states.

Article 5

The parties will promote creation of joint businesses of different patterns of ownership between business entities of the states on joint-stock basis, including with participation of the third countries.

Article 6

The parties will promote development of cooperation in the field of oil refining and sale of oil products.

The parties will charge to the Ministry of Fuel and Energy of the Russian Federation and the Ministry of oil and gas of Turkmenistan to develop the approved program for loading of oil processing capacities of Turkmenistan taking into account interest of the Parties.

The questions connected with licensing, quoting of oil and oil products, customs and tax relations will be considered by forms of settlement of business entities according to legislations of the Parties.

Article 7

Mutual deliveries of fuel and energy resources and the most important types of products, and also transit of oil and gas for export will be determined by system of bulk distribution lines by annually free intergovernmental agreements.

Article 8

The parties will charge to the Ministry of Fuel and Energy of the Russian Federation and the Ministry of oil and gas of Turkmenistan to perform assistance and coordination in cooperation of business entities of fuel and energy complexes.

Article 9

The matters of argument arising in connection with interpretation and application of this agreement will be solved the Parties by negotiations and consultations.

Disputes between business entities of the Parties are considered according to provisions of the signed economic agreements (contracts).

Article 10

The parties will organize mutual submission of quarterly information on the course of accomplishment of this agreement.

Article 11

This agreement becomes effective from the date of signing and will remain in force before the expiration of six months from the date of when one of the Parties notifies in writing other Party on the intention to stop its action.

It is made in Moscow on April 15, 1994 in duplicate in the Russian and Turkmen languages, and both texts are equally authoritative.
