The agreement between the Russian Federation and the Republic of Abkhazia on common efforts in protection of frontier of the Republic of Abkhazia

The Russian Federation and the Republic of Abkhazia which are hereinafter referred to as with the Parties

being guided by intentions to develop among themselves friendship and mutually beneficial cooperation on the basis of the conventional principles and rules of international law,

for the purpose of realization of provisions of the Treaty of friendship, cooperation and mutual aid between the Russian Federation and the Republic of Abkhazia of September 17, 2008,

proceeding from mutual interest in safety and stability on frontier of the Republic of Abkhazia,

agreed as follows:

Article 1

The concepts used in this agreement mean the following:

"frontier" - frontier of the Republic of Abkhazia with Georgia, and also borders of sea spaces to which extend sovereignty, the sovereign rights and jurisdiction of the Republic of Abkhazia;

"Border management" - the division of authority of the Russian Side performing the activities in the territory of the Republic of Abkhazia based on this agreement;

"military personnel of Border management" - the military personnel of authority of the Russian Side passing military service in Border management and also the military personnel sent by authority of the Russian Side to official journey on the territory of the Republic of Abkhazia;

"civil personnel" - the citizens of the Russian Federation and citizens of the Republic of Abkhazia who voluntarily went based on the legislation of the Russian Federation to work in Border management and being in its state;

"members of families of the military personnel of Border management" - the spouse (spouse), children, and also the parents and other persons living together with the military personnel of Border management and being in their dependence;

"real estate of Border management" - the buildings and constructions occupied by Border management;

"personal estate of Border management" - the arms which are in use of Border management, ammunition, military equipment, including vehicles, and also other appliances which are property of the Russian Federation.

Article 2

The parties taking into account mutual interests, on the basis of the legislation of each of the Parties and international treaties existing in the relations between the Parties perform cooperation on boundary questions for the purpose of providing with common efforts:

protection of frontier;

fight against terrorism, arms trafficking, ammunition, explosive and toxic agents and radioactive materials, illicit movement through frontier of drugs, psychotropic substances and their precursors, and also suppression of other unlawful activity performed when crossing frontier;

material logistics of activities of authorities of the Parties;

training of specialists for authority of the Abkhazian Side.

Article 3

The Abkhazian Side before forming of bodies of boundary protection of the Republic of Abkhazia for the benefit of ensuring own safety and safety of the Russian Federation delegates to the Russian Side of power on protection of frontier. The powers on protection of frontier delegated to the Russian Side in full are applied to sea spaces to which extend sovereignty, the sovereign rights and jurisdiction of the Republic of Abkhazia. Border control at check points through frontier is exercised jointly in collateral order.

According to the statement of the Abkhazian Side the powers delegated the Russian Federation return. The procedure and terms of return of the specified powers are determined by the agreement of the Parties.

Article 4

The authorities of the Parties responsible for implementation of this agreement, are:

from the Russian Side - Federal Security Service of the Russian Federation;

from the Abkhazian Side - Service of state security of the Republic of Abkhazia.

The parties in writing through diplomatic channels inform each other on changes in names of the authorities.

Article 5

For protection of frontier for action of the powers specified in Article 3 of this agreement the Border management which in the activities is guided by the legislation of the Russian Federation and submits to the chief of Border management is created.

Places of dislocation of divisions and accommodation of the military personnel of Border management are determined by the chief of Border management in coordination with executive bodies of the Abkhazian Side.

Article 6

The Russian side finances maintenance costs of the military personnel and civil personnel of Border management, and also other maintenance costs and material logistics of Border management.

Bank accounts in the field organization of the Central bank of the Russian Federation located in the territory of the Republic of Abkhazia, based on the bank account agreements signed by authority of the Russian Side and the Central bank of the Russian Federation are opened for border management.

The field organization of the Central bank of the Russian Federation located in the territory of the Republic of Abkhazia performs bank servicing of Border management, his military personnel and civil personnel, and also provides cash disbursement of money.

Money on accounts of Border management are formed by transfer of the appropriate means allocated from the federal budget of the Russian Federation to authority of the Russian Federation and also at the expense of other sources.

Article 7

The Abkhazian Side for goal achievement of this agreement grants to Border management documentary drawn up right of free use by the parcels of land and real estate which are property of the Republic of Abkhazia.

The real estate which is property of the Republic of Abkhazia, her citizens or legal entities and used by Border management, in process of release returns to the owner.

The real estate acquired for a fee at legal entities or physical persons, and also the objects constructed in the territory of the Republic of Abkhazia at the expense of means of the Russian Federation are property of the Russian Side, in process of release can be transferred to the Abkhazian Side. The procedure for their transfer is determined by free standing agreements.

Article 8

The Abkhazian Side renders assistance in providing Border management with office premises and participates in improvement of social conditions of the military personnel of Border management and members of their families.

Article 9

Aircrafts of authority of the Russian Side in case of accomplishment of the flights for the purpose of provided by this agreement are exempted from payment for use of airspace of the Republic of Abkhazia, operation of the airports and airfields (airfields) irrespective of their forms of business and patterns of ownership, and also for receipt of the navigation, meteorological and other information used for ensuring these flights.
