The State Customs Committee of the Russian Federation and Customs committee of the Ministry of Finance of the Republic of Kazakhstan which further are referred to as with the Parties

based on the Agreement on the Customs union of January 20, 1995, the Agreement on uniform conditions of transit through the territories of the State Parties of the Customs union of January 22, 1998,

recognizing need of streamlining of movement through the Russian-Kazakhstan frontier of alcoholic and tobacco products and enhancement of carrying out customs control concerning these goods,

agreed about the following:

Article 1

For the purposes of the this Protocol "alcoholic and tobacco products" are understood as the goods specified in appendix to the this Protocol.

Article 2

Before completion of creation of single customs area of the Customs union movement of alcoholic and tobacco products through the Russian-Kazakhstan frontier is allowed in the following items of the omission:

Movement of alcoholic and tobacco products through the check points on the Russian-Kazakhstan frontier which are not specified in this Article is not allowed.

Article 3

The customs authorities of the Parties located on the railway check points specified in Article 2 this Protocols on the approved communication channels daily inform each other and law-enforcement bodies on transport of the states of the Parties on movement of alcoholic and tobacco products after completion of their customs clearance.

Customs in which region of activities there are specified railway check points will approve procedure for transfer of operational information and data on movement of alcoholic and tobacco products which are subject to transfer.

Article 4

The alcoholic and tobacco products moved through automobile check points, specified in Article 2 this Protocols after completion of their customs clearance by customs authorities of one party, are delivered to the adjacent check point of the state of other Party on condition of their customs escort, except as specified transportations of alcoholic and tobacco products by customs carriers of the states of the Parties according to the Protocol on customs carriers of the State Parties of the CIS of September 18, 1995 and other international agreements.

Customs in which region there are specified automobile check points will approve the procedure for customs escort of alcoholic and tobacco products between adjacent check points including procedure and form of transfer of the accompanied goods taking into account requirements of the national legal system of the states of the Parties, international agreements, and also local conditions.

The Russian and Kazakhstan customs in which region of activities there are specified automobile check points monthly inform Representative office of Customs Service of the Russian Federation under Customs Service of the Republic of Kazakhstan and the State Customs Committee of the Republic of Kazakhstan respectively on movement of alcoholic and tobacco products.

Article 5

The expenses which arose at carrier, the sender or the receiver of alcoholic and tobacco products in connection with application of customs escort in case of their movement by road transport between adjacent check points of the states of the Parties are not compensated by the customs parties.

Article 6

The parties will take measures for ensuring customs escort when moving alcoholic and tobacco products by road transport between adjacent check points of the states of the Parties, including providing the relevant customs necessary transport means and means of communication.

The parties will provide proper customs control at the check points determined by the this Protocol.

Article 7

According to the mutual written arrangement of the Parties in the this Protocol can it is brought changes and amendments.

Article 8

The this Protocol becomes effective in thirty days from the date of its signing and affects for five years with its automatic prolongation the subsequent five-year periods if any of the Parties does not notify in writing other Party on the intention to terminate the this Protocol not later than three months before the end of the next five-year period.

It is made in Moscow on July 6, 1998 in duplicate in Russian.
