Concerning application of the Agreement between the Government of the Russian Federation and the Government of the Republic Georgia about the international automobile communication signed in Tbilisi on February 3, 1994 the agreement as follows is reached:
1. The term "carrier" means any physical person or legal entity allowed according to the domestic legislation of the country to implementation of international carriages.
The term "vehicle" means:
a) in transit freights - the cargo vehicle, the trailer hauling truck, the tractor truck or the tractor truck with semitrailer truck;
b) in transit passengers - the bus, that is the vehicle intended for transportation of passengers and having at least 8 places for sitting apart from the driver, and also trail car for luggage transport of passengers.
The term "regular transportations of passengers" means the transportations of passengers performed by vehicles of Contracting Parties on in advance approved route, the schedule and rate with indication of initial and final Items of movement and stopping points.
The term "irregular transportations" means all other transportations.
The term "transit transportations" means transportations of passengers and freights through the territory of one of Contracting Parties in case of which the points of departure and appointments are out of the territory of this Contracting Party.
The term "health control" means sanitary, veterinary, and also phytosanitary control.
The term "permission" means the document resolving entrance and departure of the vehicle of one Contracting Party from the territory of other Contracting Party or granting the right to journey transit through the territory of other Contracting Party.
2. In this agreement sense it is necessary to understand as competent authorities:
from the Russian Side - the Ministry of Transport of the Russian Federation;
from the Georgian Side - Department of road transport of the Republic Georgia.
3. The procedure provided in Article 5 of this agreement extends also to the irregular transportations performed by buses when the specified vehicles carry out shuttle transportations of passengers.
4. Contracting parties agreed to keep the operating procedure of international carriages established by earlier signed intergovernmental agreements of the USSR with other countries and also operation of conventions and other agreements in the field of road transport which participant was the USSR.
Provisions of the paragraph of 1 this Item do not extend to the agreements in the field of road transport signed by Contracting Parties with the third countries at the time of the signature of this agreement.
Each of Contracting Parties in case of the conclusion with the third countries of the agreements in the field of road transport changing the procedure established by the agreements specified in the paragraph of 1 this Item will inform on it other Contracting Party.
5. Contracting parties on the basis of reciprocity will coordinate work in the sphere:
scientific and technical policy on road transport;
project developments legislative and the bylaws, standards and regulations regulating work of road transport.
This Protocol is integral part of this agreement.
