The agreement between the Government of the Republic of Belarus and the Government of the Russian Federation on cooperation in the field of use of atomic energy in the peace purposes

The government of the Republic of Belarus and the Government of the Russian Federation which are hereinafter referred to as with the Parties

in view of that both states are members of International Atomic Energy Agency (further - IAEA) and agreement parties about non-proliferation of nuclear weapon of July 1, 1968,

being guided by the principles provided in the Agreement on creation of the Union State of December 8, 1999 and in the Agreement on the basic principles of cooperation in the field of peaceful use of atomic energy of June 26, 1992

considering that the Republic of Belarus and the Russian Federation are participants of the Vienna convention on the civil responsibility for nuclear damage of May 21, 1963, Conventions on physical protection of nuclear material of October 26, 1979, Conventions on the operational notification on nuclear accident of September 26, 1986, the Integrated convention on safety of the treatment of the fulfilled fuel and on safety of the treatment of radioactive waste of September 5, 1997, the Convention on Nuclear Safety of June 17, 1994,

considering that use of atomic energy in the peace purposes is important factor of social and economic development of both states,

understanding responsibility to the people and the international community for ensuring reliable and safe operation of nuclear installations and safe use of nuclear materials,

aiming to support and develop the relations of friendship and mutual understanding between two states by further cooperation increase between them in the field of use of atomic energy in the peace purposes,

agreed as follows:

Article 1

The parties develop and strengthen cooperation in the field of use of atomic energy in the peace purposes according to the legislation of each of the states of the Parties, requirements and priorities of the national nuclear programs.

Article 2

For the purposes of this agreement the terms below have the following values:

"component" - component of the equipment or other subject designated thus with the consent of competent authorities of the Parties;

"equipment" - the equipment specified in the document of IAEA INFCIRC/254/Rev.8/Part 1 and subsequent changes which will be made to this document. Any such changes are valid within this agreement only if both Parties inform each other in writing through diplomatic channels that they accept such changes;

"material" - any of the non-nuclear materials specified in the document of IAEA INFCIRC/254/Rev.8/Part 1 and subsequent changes which will be made to this document. "information" - scientific, commercial either the specifications or other information in any form which are appropriately designated by agreement of competent authorities of the Parties for provision or exchange within this agreement;

"information of limited distribution" - information, access to which is limited by the Federal Laws of the Russian Federation;

"office information of limited distribution" - data which distribution according to the legislation of the Republic of Belarus the organizations consider undesirable for the benefit of ensuring the activities;

"intellectual property" matters, established in article 2 of the Convention establishing World Intellectual Property Organization, signed in Stockholm (Sweden) on July 14, 1967;

"nuclear material" - any "initial material" or "the special split material" according to the definitions given in the article XX of the Charter of IAEA. Any determination of Board of governors of IAEA within the article XX of the Charter of IAEA which changes the list of the materials falling under determination "initial material" or "the special split material" is valid within this agreement only if both Parties inform each other in writing through diplomatic channels that they accept such change;

"technology" matters, IAEA established in the document INFCIRC/254/Rev.8/Part 1 and subsequent changes which will be made to this document. Any such changes are valid within this agreement only if both Parties inform each other in writing through diplomatic channels that they accept such changes;

"authorized organization" - the legal entity of each of the states of the Parties, which authorized relevant Party or competent authority of the relevant Party on implementation of cooperation within this agreement.

Article 3

The parties perform cooperation in the following directions:

development, designing, construction, operation and conclusion from operation of nuclear power plants, research reactors and other nuclear installations;

supply of nuclear fuel for nuclear power plants, research reactors and other nuclear installations;

supply of equipment, materials and rendering services in the directions of cooperation provided by this Article;

the treatment of the irradiated nuclear fuel and radioactive waste;

implementation of joint industrial activity;

ensuring nuclear safety, radiation protection, and also assessment of radiative effects of atomic energy and fuel cycle on the environment;

implementation of basic and applied researches in the field of use of atomic energy in the peace purposes;

implementation of joint actions for prevention of nuclear accident and liquidation of its effects;

production of radioisotopes and their application in the industry, medicine and agricultural industry;

standardization of legislations of the states of the Parties in the field of use of atomic energy in the peace purposes;

training of specialists in the field of use of atomic energy in the peace purposes and personnel on operation of nuclear power plants;

regulation of nuclear and radiation safety;

other directions of cooperation offered by the Joint advisory commission formed according to Article 10 of this agreement which are drawn up by modification of this agreement as it stipulated in Article the 14th this agreement.

Article 4

The cooperation provided in Article 3 of this agreement is performed by means of:

developments of agreements between the Parties which include the plan of implementation of the expected project, methods of its financing, responsibility of each of the Parties, procedure for use and realization of results of joint activities and also determine the rights of the Parties to the order information and results received during the researches;

developments of the approved programs of carrying out joint surveys and developments;

the conclusions of separate contracts (contracts) between authorized organizations in which the amount of the approved cooperation, the rights and obligations of agreement parties (contracts), financial and other conditions of cooperation between authorized organizations, according to the legislation of each of the states of the Parties is determined;
