1. Approve the enclosed Regulations on determination and approval of general admissible catch of water biological resources and its change.

2. Recognize to invalid:

the order of the Government of the Russian Federation of September 26, 2005 N 583 "About determination and approval of general admissible catch of water biological resources, and also about introduction of changes in them" (The Russian Federation Code, 2005, N 40, the Art. 4036);

Regulations on determination and approval of general admissible catch of water biological resources and its change

1. This Provision establishes procedure for determination and approval of general admissible catch of water biological resources of specific type in certain areas (further - general admissible catch).

2. General admissible catch is estimated in tons (including for seaweed - at the rate of the weight of crude weight) and pieces (for marine mammals).

3. General admissible catch is determined for types of water biological resources which list affirms the Ministry of Agriculture of the Russian Federation for each fishery basin, including:

a) general admissible catch around production (catch) of water biological resources in internal waters of the Russian Federation, except for internal sea waters of the Russian Federation, in borders of the subject of the Russian Federation (further - general admissible catch for the subject of the Russian Federation);

b) general admissible catch around production (catch) of water biological resources in internal sea waters of the Russian Federation, in the territorial sea of the Russian Federation, on the continental shelf of the Russian Federation, in exclusive economic zone of the Russian Federation and the Caspian Sea (further - general admissible catch for trade zone).

4. Preparation of the materials proving general admissible catch (further - materials of general admissible catch), the materials proving modification of earlier approved general admissible catch (further - materials of adjustment of general admissible catch), and also data collection about inventories of the water biological resources necessary for preparation of the specified materials, is performed by the Federal Agency for Fishery and the research organizations which are under its authority (further - the scientific organizations).

By preparation of materials of general admissible catch and materials of adjustment of general admissible catch data of the state monitoring of water biological resources performed according to the order of the Government of the Russian Federation of December 24, 2008 N 994 "About approval of the Regulations on implementation of the state monitoring of water biological resources and application of its data" can be used.

5. The scientific organizations annually, till May 15, direct:

a) materials of general admissible catch for the subject of the Russian Federation the forthcoming year on the state environmental assessment in the relevant territorial authority of Federal Nature Management Supervision Service;

b) materials of general admissible catch for trade zone the forthcoming year in Federal Agency for Fishery.

6. The scientific organizations in case of receipt of new scientific data on inventory condition of water biological resources annually, till September 1, direct:

a) materials of adjustment of general admissible catch for the subject of the Russian Federation the current year on the state environmental assessment in the relevant territorial authority of Federal Nature Management Supervision Service;

b) materials of adjustment of general admissible catch for trade zone the current year in Federal Agency for Fishery.

7. The Federal Agency for Fishery annually, no later than May 20, directs materials of general admissible catch for trade zone the forthcoming year to the state environmental assessment in Federal Nature Management Supervision Service.

8. The Federal Agency for Fishery when obtaining from the scientific organizations of materials of adjustment of general admissible catch for trade zone the current year no later than September 5 directs them to the state environmental assessment in Federal Nature Management Supervision Service.

9. The Federal Nature Management Supervision Service and its territorial authorities carry out the state environmental assessment and send to Federal Agency for Fishery and the scientific organizations of the conclusion of the state environmental assessment:

a) on the materials of general admissible catch provided by them annually, no later than October 1;

b) on the materials of adjustment of general admissible catch provided by them no later than 2 months after their obtaining.

10. The Federal Agency for Fishery in time, not exceeding 10 days after receipt of the conclusion of the state environmental assessment, taking into account this conclusion develops general admissible catch the forthcoming year or offers on modification of earlier approved general admissible catch and sends to the Ministry of Agriculture of the Russian Federation for approval.

11. The Ministry of Agriculture of the Russian Federation in time, not exceeding 7 days after obtaining from Federal Agency for Fishery of the materials specified in Item 10 of this provision approves general admissible catch or changes in earlier approved general admissible catch.
