RESOLUTION OF BOARD OF NATIONAL BANK OF THE REPUBLIC OF KAZAKHSTAN

of November 15, 1999 No. 388

About approval of Rules of application of codes of sectors of economy and purpose of payment and submission of data on payments according to them

(as amended on 31-12-2015)

For the purpose of implementation of the Strategic plan of development of bank system of the Republic of Kazakhstan for 1998-2000 the Board of National Bank of the Republic of Kazakhstan decides:

1. Approve the enclosed Rules of application of codes of sectors of economy and purpose of payment and submission of data on payments according to them.

2. To management of payment systems (Musayev R. N.):

1) together with Legal department (Sharipov S. B.) to take measures to state registration in the Ministry of Justice of the Republic of Kazakhstan of this resolution;

2) in ten-day time from the date of state registration in the Ministry of Justice of the Republic of Kazakhstan to bring this resolution to the attention of branches of National Bank of the Republic of Kazakhstan, having obliged them to bring this resolution to the attention of banks of the second level.

3. To department of information technologies (Polikarpov O. Yu.):

1) together with the Republican state company on the right of economic maintaining "The Kazakhstan center of interbank calculations of National Bank of the Republic of Kazakhstan" (Abdulkarimov S. H.) provide development of the corresponding software and put it into commercial operation since July 1, 2000;

2) together with Management of planning and control of the budget (Galiyeva D. T.) provide in expense budget of National Bank of the Republic of Kazakhstan for 2000 funds for development of the corresponding software.

4. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Abdulina N. K.

Rules of application of codes of sectors of economy and purpose of payment and submission of data on payments according to them

Chapter 1. General provisions

1. Rules of application of codes of sectors of economy and purpose of payment and submission of data on payments according to them (further - Rules) are developed according to the laws of the Republic of Kazakhstan of March 30, 1995 "About National Bank of the Republic of Kazakhstan", of June 29, 1998 "About payments and money transfers" and install system of coding of payments and procedure for putting down of codes of sectors of economy and purpose of payment in the payment documents and other documents used in the territory of the Republic of Kazakhstan in which obligation of putting down of codes of the sender of money and the beneficiary, codes of purpose of payment is provided by regulatory legal acts of National Bank of the Republic of Kazakhstan (further - payment documents), and procedure, form and terms of submission to National Bank of the Republic of Kazakhstan (further - National Bank) the data on payments according to codes of sectors of economy and purpose of payment (further - Data).

2. Coding of payments is used for ensuring transparency of payments, forming of system of indicators based on the provided data on payments and for flow analysis of money in the Republic of Kazakhstan.

3. The concepts used in Rules mean the following:

1) currency code and precious metals - the conditional, reduced designation of national currency of the Republic of Kazakhstan and currencies of foreign states, and also precious metals (further - currency code);

2) payment system - set of procedures, technologies, infrastructures, rules and standards providing carrying out payments and money transfers between members of payment service provider;

3) code of purpose of payment - the conditional, reduced digital designation of purpose of payment;

4) electronic payment system - settlement system, the conclusions of transactions, money transfer and information transfer in the established electronic format by means of electronic means of communication;

5) the international payments - mutual payments and calculations between the countries, financial institutions, the organizations and citizens who are in the territory of the different countries.

4. The procedure for putting down of codes of sectors of economy and purpose of payment is applied both in electronic payment system, and to transactions of bank on direct correspondent accounts, including intra bank and international payments.

Chapter 2. Coding of payments

5. Coding of payments is performed by means of system of digital and alphabetic symbols. This system is created of additional details of the payment document and code of purpose of payment. The system of the coding of payments looks as follows:

where: I - sign of residence of the sender of money,

II - the sector of economy of the sender of money,

III - sign of residence of the beneficiary,

IV - the sector of economy of the beneficiary,

V VI VII - currency code and precious metals,

VIII - transaction type,

IX - nature of payment,

X - payment disaggregation

Exception is the Section 0 "Pension Payments and Benefits" containing also the codes of purpose of payment which do not have the name of nature of payment.

6. Symbols I and II are created in payment documents in the field of KOD code of the sender of money.

7. Symbols III and IV are created in payment documents in the field of KBE code of the beneficiary.

8. The currency code and precious metals (symbols V VI VII) is designated according to the state qualifier of the Republic of Kazakhstan - RK Group 07 ISO 4217 - 2001 "Codes for designation of currencies and funds".

9. Symbols VIII, IX, X create code of purpose of payment.

10. The sign of residence is determined according to the foreign exchange legislation of the Republic of Kazakhstan and put down in the following procedure:

"1" - resident

"2" - the nonresident

11. The sector of economy is specified according to code of the sector of economy, according to appendix 1 to Rules.

12. The code of purpose of payment is specified according to the Disaggregated table of the codes of purpose of payment specified in appendix 2 to Rules.

Chapter 3. Procedure for filling of payment documents

13. In the payment documents created in electronic format and on paper the residence sign, codes of sectors of economy of the sender of the money/beneficiary, code of purpose of payment, currency code in specially allotted fields are put down.

14. In the column "Purpose of payment" of the payment document the sender of money specifies content of specific transaction with indication of the obligation which execution is made, and also details of documents based on which money transfer and/or payment is made (including, number, date, surname and initials).

When making transaction with securities the currency in which securities are issued is also specified if it differs from payment currency.

15. It is excluded

16. The bank of the sender of money refuses the acceptance of the payment document in case of wrong putting down in the payment document of code of the sender of money.

The bank and/or the organization performing separate types of banking activities in case of acceptance of specifying from the initiator of payment refuses the acceptance of the payment document in case of discrepancy of digital designation of purpose of payment of its text part.

17. No. 267 is excluded according to the Resolution of Board of National Bank of the Republic of Kazakhstan of 24.08.2012

18. Putting down more than one code of purpose of payment in payment documents is not allowed.

When implementing the transaction having several purposes of payment in the payment document the code of purpose of basic payment is put down.

18-1. Putting down of code of the purpose of payment which is heading of transaction type or nature of payment is not allowed if there is its further disaggregation.

18-2. Data are represented to National Bank by the Republican state company on the right of economic maintaining "The Kazakhstan center of interbank calculations of National Bank of the Republic of Kazakhstan" (further - the Center), banks of the second level and Development Bank of Kazakhstan joint-stock company (further - banks), the Kazpochta joint-stock company, the legal entity which was earlier subsidiary bank, performing without license of National Bank the translated transactions connected with implementation by parent bank of payments and money transfers, including with use of correspondent account of subsidiary bank according to the bank accounts of depositors transferred to parent bank according to the Law of the Republic of Kazakhstan of August 31, 1995 "About banks and banking activity in the Republic of Kazakhstan" (further - the legal entity, earlier being subsidiary bank) and are created by National Bank according to form, intended for collection of administrative data, established by appendix 3 to Rules.

The bank of the beneficiary checks correctness of putting down in Data of code of the beneficiary and code of purpose of payment on the payments entering from abroad.

For confirmation of reliability of Data banks, the Kazpochta joint-stock company and the legal entity which was earlier subsidiary bank provide in National Bank on its request information on the registered payments, including copies of payment documents.

19. Data are represented to National Bank in electronic form according to the message format established by the Center.

20. Data are represented monthly:

1) the Center - no later than the date seventh (inclusive) following month under report;

2) banks, the Kazpochta joint-stock company, the legal entity which was earlier subsidiary bank are also created by National Bank - no later than the date tenth (inclusive) following month under report, except for case, provided by the subitem 3) of this Item;

3) parent bank and subsidiary bank concerning which restructuring according to the Law of the Republic of Kazakhstan of August 31, 1995 "About banks and banking activity in the Republic of Kazakhstan" is carried out (further - the Law on banks), the attached bank, and also bank to which accession according to the Law on banks - no later than the date twenty first (inclusive) following month under report is performed.

If the term of submission of Data falls on non-working day, the working day following it is considered date of submission of Data.

21. The organizations specified in Item 20 of Rules:

1) in case of absence for month under report of the payments and money transfers which are subject to reflection in Data in writing notify on it National Bank no later than the date tenth (inclusive) following month under report;

2) in case of detection of mistakes in earlier provided Data correct errors and represent to National Bank authentic Data within five working days after the expiration of terms, stipulated in Item 20 Rules for submission of Data.

Distribution of economic activity by sectors is made by allocation of institutional units which represent elementary units of the production sphere or sphere of consumption and differ in the fact that independently make economic decisions (concerning production and consumption) and operate necessary set of financial accounts. Each separate institutional unit belongs entirely to one sector of economy according to the core activity. The principles of classification recognize that the economy consists of the allocated institutional units which are grouped in sectors according to main type of the activities performed by them.

The sector is the basic division of economy where the institutional units which are engaged in the same core activity unite. Each sector is considered analytically significant part of economy and has the economic characteristics different from other sectors.

Institutional unit represents economic unit which owns assets, assumes liabilities and is engaged in economic activity and transactions with other economic sectors.

In Rules the following sectors of economy are used: state bodies; financial organizations; non-financial organizations; the non-profit organizations serving households; households.

State bodies

"1" Central Government;

"2" Regional and local authorities of management;

Financial organizations

"3" Central (national) banks;

"4" Other deposit organizations;

"5" Other financial organizations;

Non-financial organizations

"6" State non-financial organizations;

"7" Non-state non-financial organizations;

The non-profit organizations serving households

"8" The non-profit organizations serving households;

Households

"9" Households.

The sector "State bodies" - the institutional units having the legislative, judicial or executive authority which extends to other institutional units located in the territory of the country. The main functions of state bodies are: responsibility for providing with goods and services of society in general and separate households: mobilization of financial resources necessary for this purpose by the taxation or at the expense of other income; income redistribution and riches by means of transfers and implementation of non-market production. This sector includes the central government (code "1"), regional and local authorities of management (code "2").

The code "1" means the ministries, departments and the agencies financed from means of the republican budget, research institutions, institutional units - agents of the Government of the Republic of Kazakhstan, the funds controlled by state bodies and financed from means of the republican budget and also other organizations which are under control of the state, performing the functions peculiar to state bodies and not engaged in market production;

The code "2" means the institutional units performing management functions at the level of the area, the city and the area and the organizations financed from means of regional (local) budgets.

The sector "Financial organizations" - institutional units which main function is the financial intermediation or the auxiliary financial activities which are closely connected with financial intermediation. This sector includes the Central (national) Banks (code "3"), other deposit organizations (code "4") and other financial organizations (code "5").

The code "3" means institutional unit which exercises control over key aspects of financial system and carries out such activities as issue of national currency, management of the international reserves. The international organizations which are engaged in financial activities are considered in the sector of economy "The Central (national) banks". All other international organizations are considered in the sector of economy "the Central Government".

The code "4" means institutional units which core activity is the financial intermediation and which obligations have the form of deposits or their analogs (close substitutes of deposits which join in national determination of wide money). Banks treat this group.

The code "5" means all other institutional units of this sector which perform various intermediary or support financial services, or activities of which are closely connected with financial intermediation, but they do not perform function of intermediaries. The credit partnerships, the insurance (reinsurance) organizations, the accumulation pension funds, pawnshops, exchange points, the mortgage companies, the broker and dealer companies, the affiliated organizations of special purpose, investment funds, other organizations performing separate types of banking activities treat this group.

"The non-financial sector" - institutional units which core activity is mainly production of market goods and non-financial services. This sector includes the state non-financial organizations (code "6") and the non-state non-financial organizations (code "7").

The code "6" means the institutional units which are engaged mainly in market production and controlled by state bodies.

The code "7" means the institutional units which are engaged mainly in market production and uncontrollable state bodies.

This sector includes representations and branches of the non-state non-financial organizations which are minor (the auxiliary organizations), which activities do not pursue commercialization from their main activities and is only auxiliary and is strictly limited to provision of services of the parent organization.

The sector "The non-profit organizations serving households" (code "8") - the institutional units which are making goods or services, but not bringing in the income or other financial benefits to the institutional units controlling such organizations - also includes the following institutional units:

1) which are created by associations of persons to provide with goods or services of members of these associations. Such services are usually provided free of charge or financed by the regular membership fees. Carry to them political parties, labor unions, mosques, churches (temples) and religious societies, public, cultural, entertaining and sports clubs and others.
