About approval of the Regulations on procedure for registration by the Centers of the state services of permissions to implementation of individual housing construction (reconstruction), approval of projects in authorized bodies by the principle "one window"

In pursuance of the resolution of the Cabinet of Ministers of April 30, 2009 "About measures for introduction of the simplified procedure for registration of permissions to implementation of individual housing construction (reconstruction), approval of projects in authorized bodies by the principle "one window" the Cabinet of Ministers decides No. 127:

1. Approve Regulations on procedure for registration by the single Centers of the state services of permissions to implementation of individual housing construction (reconstruction), approval of projects in authorized bodies by the principle "one window", according to appendix.

2. To the ministries and departments to bring the regulatory legal acts into accord with this resolution in a month.

3. To impose control of execution of this resolution on the Deputy prime minister of the Republic of Uzbekistan Hanov N. M.

Appendix

to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of July 2, 2009 No. 184

Regulations on procedure for registration by the Centers of the state services of permissions to implementation of individual housing construction (reconstruction), approval of projects in authorized bodies by the principle "one window"

I. General provisions

1. This Provision determines procedure for registration by the Centers of the state services (further - the centers) permissions to implementation of individual housing construction (reconstruction), approval of projects in authorized bodies by the principle "one window".

2. Action of this provision extends to all builders performing individual housing construction (further - private housing construction), and also the homeowners performing reconstruction of housing.

3. The center renders services on paid basis in accordance with the established procedure.

4. The builder or the homeowner has the right to draw up permissions to implementation according to private housing construction and reconstruction of housing, and also to approve projects independently, without appeal to the center.

5. If necessary, on behalf of the builder or the homeowner of action within this provision can be made by their representatives.

6. For the purpose of this provision the following basic concepts are applied:

housing - the premises suitable for accommodation of the person, including the individual apartment houses, apartments in multi-storey houses and also relating the subsidiary economic structures and domestic constructions intended for rest or maintaining personal economy to individual apartment houses;

reconstruction - change of architectural planning solutions, construction of superstructures, integrations, extensions with partial dismantling, replacement of worn-out and obsolete designs and the engineering equipment), including outside networks (except main).

II. Procedure for receipt of permission and approval of projects in authorized bodies in case of construction of the apartment house

7. For execution of permissions for construction of the apartment house the builder or his representative submits to the center the application for construction of the apartment house with indication of number and decision date of hokim about allocation of the parcel of land to which the project on construction of the apartment house developed by the project organization having the corresponding license is attached.

8. The statement is registered in the special magazine and the statement with indication of date of its obtaining is issued to the builder or his representative.

The requirement from the builder or his representative of submission of the documents and approvals which are not provided by this Provision is not allowed.

9. The project on construction of the apartment house consists from:

the plan of the parcel of land, with display of elevated and underground engineering communications;

plans of the bases, cellars, floors, cuts and facades;

estimate financial calculation (on condition of the need for receipt of the credit).

10. On one parcel of land the construction of several apartment houses is allowed.

11. The center after receipt of the statement submits the corresponding applications to one-day time:

on approval of the project on construction of the apartment house - in management (department) of architecture and city building and areas;

on implementation branch of the state company of land management and the inventory of the real estate of the Republic of Karakalpakstan, areas and Tashkent in the respective area (city).

12. Management (department) of architecture and city building and areas in three-day time approves the project on construction of the apartment house then sends documents to the center.

13. The branch of the state company of land management and inventory of the real estate of the Republic of Karakalpakstan, areas and Tashkent in the respective area (city) in two-day time makes state registration of the right to the parcel of land with execution of the appropriate certificate then sends documents to the center.

14. The center in one-day time issues to the builder or his representative the agreed project and other documents.

15. The basis for construction works on construction of the apartment house is the approved individual or standard project.

III. Procedure for receipt of permission and approval of projects in authorized bodies in case of reconstruction of housing

16. For registration of permissions to reconstruction of housing the homeowner or his representative submits to the center the application for reconstruction with statement of the planned works.

Are enclosed to the application:

the copy of the documents certifying the property right to housing;

the draft copy on reconstruction of housing developed by the project organization having the corresponding license;

the technical conclusion prepared in accordance with the established procedure by the project organization.

The paragraph of the sixth is excluded according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 22.07.2011 No. 222 

17. The statement is registered in the special magazine and the statement with indication of date of its obtaining is issued to the owner or his representative of housing.
