About measures for enhancement of realtor activities in the Republic of Belarus

Based on the paragraph of the sixth of part one of Item 4, parts two of Item 6 and Item 10 of the Rules of implementation of realtor activities in the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of January 9, 2006 No. 15, of subitems 7. 23, 7.29 and 7.30 Items 7, DECIDES: parts one of Item 12 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 26, 2024 No. 545, the Ministry of Justice of the Republic of Belarus

1. Determine that when implementing realtor activities the realtor organizations take the measures aimed at providing:

1.1. legal protection of consumer interests of realtor services by explanation of their rights and obligations in case of the conclusion of contracts for rendering realtor services, and also payment procedure of realtor services;

1.2. availability in the realtor organization in the place of the main documents, available to consumers of the realtor services (or their copies) confirming legitimacy of implementation of activities of the realtor organization and created in separate case (job specification) including:

certificates on state registration of the realtor organization;

information on the license for implementation of realtor activities (further – the license) (license number, decision date about its provision);

agreements of compulsory insurance;

copies of certificates on certification of realtors;

copies of identification plastic cards of specialists in realtor activities;

information on types of the rendered realtor services;

regulations of rendering realtor services;

working hours of the realtor organization;

books of notes and offers (location, number of office phone, surname, initials of person responsible for ledger maintenance of notes and offers);

the document containing payment procedure of realtor services;

structures of the realtor organization;

the information about the head of the realtor organization (surname, own name, middle name (if that is available), number of office and the head's phones) and its reception of citizens on private matters;

data on the state bodies exercising control of compliance with law by the realtor organizations (full name and the address);

1.3. the conclusions with the builder of the contract for rendering the realtor services specified in paragraphs by fifth or pole of part one of subitem 1.3 of Item 1 of the Presidential decree of the Republic of Belarus of January 9, 2006 to No. 15 "About realtor activities in the Republic of Belarus" and directed to rendering assistance in case of the conclusion, execution, the termination of agreements of creation of object of shared-equity construction of the residential and (or) non-residential premise in the apartment apartment house and other real estate objects connected with the apartment apartment house only in case of absence at the builder of the tax debt, to charges (duties), other obligatory payments in republican and (or) local budgets (including in the state trust budget funds), in state non-budgetary funds and in the presence at it:

the documents certifying its right to the parcel of land necessary for ensuring shared-equity construction;

the project documentation, including estimate, passed state, state ecological the examinations in the state bodies determined by legal acts, and approved according to the procedure, established by Council of Ministers of the Republic of Belarus;

construction contracts for construction of the apartment apartment house and other real estate objects connected with the apartment apartment house (if the construction is not conducted by the builder by own forces);

permissions to production of installation and construction works for the construction of the apartment apartment house and other real estate objects connected with the apartment apartment house;

the documents confirming publication of the project declaration.

The documents specified in part one of this subitem are provided to the realtor organization by the builder for acquaintance that is reflected in the contract for rendering realtor services in rendering assistance signed by the realtor organization with the builder in case of the conclusion, execution, the termination of contracts for creation of objects of shared-equity construction, and also in the agreement signed by the realtor organization with the consumer having intention to sign with the builder the agreement of creation of object of shared-equity construction of the residential and (or) non-residential premise in the apartment apartment house and other real estate object connected with the apartment apartment house;

1.4. the conclusions of written agreements on rendering realtor services in questions of the conclusion of lease agreements as with person wishing to lease real estate object and with person wishing to receive such object in lease;

1.6. it is excluded

1.7. aklyucheniye of the contracts with specialists in realtor activities providing payment terms of their work taking into account the remuneration payment right in percentage terms from revenue of the realtor organization, and also control of accomplishment of conditions of contracts;

1.8. transfers of the book of registration of contracts for rendering realtor services in archive according to the legislation on archiving and clerical work in case of the termination of the license;

1.9. prevention of the offenses encroaching on public order (strengthening of internal control, ensuring high-quality matching of personnel structure, creation of safe working conditions, the equipment of rooms with systems of protection and safety);

1.10. provisions in the Ministry of Justice:
