1. Approve the enclosed Provisions, Structure of central office, the Scheme of management and the List of organizations and organizations of system of the Ministry of Culture of the Republic of Tajikistan (the appendices 1,2, 3, 4).

6. Declare invalid the following orders of the Government of the Republic of Tajikistan:

- of December 27, 1997 No. 570 "Questions of the Ministry of Culture of the Republic of Tajikistan";

- of June 3, 2006 No. 261 "About modification of the order of the Government of the Republic of Tajikistan of August 7, 1997 No. 349 "About the Ministry of Culture of the Republic of Tajikistan";

- of December 2, 2005 No. 469 "Questions of Committee on cases of religion under the Government of the Republic of Tajikistan";

- of June 3, 2006 No. 270 "About modification and amendments in the order of the Government of the Republic of Tajikistan of December 2, 2005 No. 469 "Questions of Committee on cases of religion under the Government of the Republic of Tajikistan".

Provision of the Ministry of Culture of the Republic of Tajikistan

I. General provisions

1. The Ministry of Culture of the Republic of Tajikistan (further Ministry of culture) is the central public authority performing functions on development of single state policy in the field of culture, art, cultural leisure, seal, publishing activities, protection and restoration of historical and cultural monuments, copyright protection, control of observance of the rights established by the legislation of the Republic of Tajikistan and obligations of legal entities and physical persons on the questions carried to its maintaining.

2. The Ministry of Culture exercises coordination and control of activities of the structural divisions which are under its supervision.

3. In the activities the Ministry of culture is guided by the Constitution of the Republic of Tajikistan, the Laws of the Republic of Tajikistan, decisions of Majlisi Oli of the Republic of Tajikistan, Decrees and orders of the President of the Republic of Tajikistan, resolutions and orders of the Government of the Republic of Tajikistan and international legal acts recognized by the Republic of Tajikistan, and also this Provision.

4. The Ministry of culture performs the tasks assigned to it directly and through the territorial authorities in interaction with other executive bodies, and also with public and other organizations.

5. Main powers of Ministry of culture:

- the organization of reception of citizens, ensuring timely and complete examination of oral and written addresses of citizens, adoption on them of decisions and the direction of answers to applicants in the time established by the legislation of the Republic of Tajikistan;

- providing within the competences of protection of the data which are the state secret;

- ensuring mobilization preparation of the Ministry of culture, and also control and coordination of activities which are under its authority, the organizations and organizations for their mobilization preparation;

- interaction in accordance with the established procedure with state bodies of foreign states and the international organizations;

- implementation according to the legislation of the Republic of Tajikistan works on completing, storage, accounting and use of archive documents of Ministry of culture;

- representation of the Republic of Tajikistan, in accordance with the established procedure, in the intergovernmental, international organizations and ensuring international legal protection of interests of the republic;

- carrying out in accordance with the established procedure tenders and the conclusion of public contracts on order placement on delivery of goods, performance of works, rendering services for needs of the Ministry, and also on carrying out research works for other state needs in the established field of activity;

- the organization of control of observance by state bodies, legal entities and physical persons of the legislation of the Republic of Tajikistan on preservation scheme, restoration and use of objects of historical and cultural heritage, about seal and other mass media;
