About perpetuating of name of the martyr and about privileges to families of martyrs

This Law serves the purpose of regulation of the status and social protection of persons, dead, missing persons and in the procedure established by the law who are considered as the dead in connection with military operation for freedom, sovereignty and territorial integrity of the Azerbaijan Republic, their families.

Article 1. Concept of the martyr and martyr's family

The martyr is the person who died, missing and in the procedure established by the law considered as the dead in connection with military operation for freedom, sovereignty and territorial integrity of the Azerbaijan Republic.

According to the current legislation the following persons are considered as members of the family of the martyr:

spouses, parents;

the children, brothers and sisters who did not reach 18 years the children, children having disability are more senior than 18 years which disability are established before achievement of 18 years, become disabled people before achievement of this age, pupils of orphanages, and getting education in educational institutions of professional education, secondary vocational and higher education, the specified educational institutions, average special and higher educational institutions - to the termination of these institutions, but no more, than before achievement of age of 23 years;

grandfathers and grandmas, if there are no persons who under the law shall contain them.

Article 2. Procedure for provision of the status of the martyr and martyr's family

Person interested in provision of the status of the martyr or the martyr's family to persons specified in article 1 of this Law addresses to the relevant state bodies.

The matter can be considered also according to the petition of state body or relevant military unit.

The relevant state body, having immediately accepted addresses and petitions, no later than one month shall issue the document on the status of the martyr or the martyr's family according to this Law.

The body (organization) determined by relevant organ of the executive authority keeps the register of persons which received the status of shekhid and members of the family of shekhid electronically in electronic information system of body (organization) determined by relevant organ of the executive authority for the purpose of to create the single database of shekhid and families of shekhid. The procedure for maintaining the register of persons which received the status of shekhid and families of shekhid is determined by body (organization) determined by relevant organ of the executive authority.

Article 3. Perpetuating of memory of the martyr and right of family of the martyr

For the purpose of perpetuating of memory of persons who died on the signs specified in article 1 of this Law the following measures are performed:

construction of gravestone monuments, memorial complexes;

assignment of names of martyrs to streets, squares, companies, organizations, organizations, schools, cultural and educational institutions.

The following guarantees are provided to members of the families which received the status of family of the martyr in legislatively established procedure:

providing with work pension on the occasion of loss of the supporter is regulated by the Law of the Azerbaijan Republic "About work pensions";

paragraph third ceased to be valid;

the benefit in deduction at work when reducing number or staff is provided to them;

paragraph fourth ceased to be valid;

During their training in educational institutions at paid basis payment of their training at the expense of means of the government budget is regulated by article 14.8-1 of the Law of the Azerbaijan Republic "About education";

in the procedure established by relevant organ of the executive authority are provided with sanatorium treatment within the country in the direction of medical institutions;

they are given preference under the organization of social workplaces and self-employment of the unemployed, and also under the organization of professional training.

Article 4. Providing families of martyrs with the dwelling

Providing family of the martyr with living space are performed according to the current legislation local executive bodies according to the procedure, established by the government of the republic.

The families of martyrs needing improvement of housing conditions are provided with living space first of all.

It are at will provided to family of the martyr the preferential target loan for individual housing construction, the parcel of land in legislatively established size depending on the residence, and also benefit in case of the introduction in gardening partnership (cooperative).

In case of acquisition as private property notarial operations are performed by family of the martyr of the apartment or own house without collection of the state fee.

Article 5. The state bodies dealing with issues of martyrs and families of martyrs and their interrelation

The Ministry of Defence, the Ministry of Labour and Social Protection of the population and local executive bodies of the Azerbaijan Republic are engaged in questions of martyrs and families of martyrs. They it is interconnected resolve issues of rendering to families of martyrs of medical and social services, withdrawal of the parcels of land for housing construction and occupation by economy, employment of family members, and also rendering other help to them.

Article 6. Sources of the means spent for martyrs and families of martyrs

The means spent on shekhid and family of shekhid are paid from the government budget of the Azerbaijan Republic, funds of the help created at the expense of means of individuals and various organizations, departments and the companies, including donations of the foreign organizations and other sources and also on at the expense of means of the national compulsory personal insurance.

Article 7. Responsibility for violation of the Law

Citizens and officials bear responsibility for violation of this Law according to the procedure, stipulated by the legislation the Azerbaijan Republic.

Article 8. Procedure for permission of the questions connected using this Law

Necessary acts for permission of the questions connected using this Law are accepted by the Cabinet of Ministers of the Azerbaijan Republic.
