About the Nation-wide target economic program of carrying out monitoring of remaining balance of veterinary medicines and pollutants in live animals, animal products and sterns, and also in the foodstuff under control to veterinary service, for 2010-2015

The Verkhovna Rada of Ukraine decides:

1. Approve the Nation-wide target economic program of carrying out monitoring of remaining balance of veterinary medicines and pollutants in live animals, animal products and sterns, and also in the foodstuff under control to veterinary service, for 2010-2015 (further - the Program) which is applied.

2. To the Cabinet of Ministers of Ukraine:

The paragraph two is excluded according to the Law of Ukraine of 17.05.2012 No. 4731-VI

during preparation of the bill on the Government budget of Ukraine for the corresponding year to provide expenses for financing of the actions determined in the Program.

3. This Law becomes effective from the date of its publication.

The nation-wide target economic program of carrying out monitoring of remaining balance of veterinary medicines and pollutants in live animals, animal products and sterns, and also in the foodstuff under control to veterinary service, for 2010-2015

Program purpose

The purpose of the Program is improvement of quality and safety of the animal products, foodstuff under control to veterinary service, and forages, informing consumers on the risks connected with the use of low-quality foodstuff of animal origin, use of the forages containing remaining balance of veterinary medicines and pollutants, and also expansion of the markets of domestic agricultural production.

Ways and methods of the problem resolution

The problem resolution is possible by three options.

The first option - establishment of liability of the producer before the consumer for safety of own products and implementation on production of analysis system of risks and control (regulation) in critical points (HACCP) or similar systems of safety and product quality. In all developed countries of the world application of NASSR is one of compulsory provisions of implementation of activities in the field of production of foodstuff that allows to provide with them consumers.

For January 1, 2009 in Ukraine there were 14 292 companies concerning which public service of veterinary medicine exercised veterinary health control, including meat-processing - 3681, milk-processing - 1574, rybopererabatyvayushchikh1269 the companies.

For today in Ukraine the NASSR system is implemented only at 37 milk-processing and three meat-processing companies. One of requirements to implementation of NASSR is availability of conditions for carrying out monitoring, in particular production rooms, the corresponding equipment, methods of researches, personnel and etc.

In realization of the first option the fact that NASSR as the system of management of safety of food, most widespread in the world, can include or be followed by proper work and agricultural practice and proper practice on hygiene is positive.

At the same time NASSR takes root producers of food for the purpose of self-checking and cannot act as the guarantor of the state on control when exporting products of the Ukrainian production. As implementation of NASSR requires considerable time and means, it is performed very slowly. Therefore, application of the specified option is impossible.

The second option - control of safety of animal products and forages in the state laboratories of veterinary medicine according to the established requirements.

In case of export of foodstuff of animal origin and forages they shall be checked for compliance to requirements of the importing country.

Application of such option will allow to conduct researches in the state laboratories of veterinary medicine, to exercise the state control of safety of foodstuff of animal origin and forages and to fulfill demands which are made by importing countries. However it will not allow to carry out at the nation-wide level monitoring of remaining balance of veterinary medicines and pollutants in live animals, the raw foodstuff of animal origin and sterns as it is provided by the Directive of Council 96/23/EEC of April 29, 1996 about control measures of separate substances and their residual content in the live cattle and animal products (further - the Directive 96/23/EEC) that will lead to failure to carry out of one of conditions of exit of products of the Ukrainian production to the international market. Therefore it is inexpedient to apply such method as Ukraine will not be able to fulfill the international requirements.

The third option - accomplishment at the national level of annual plans of the state monitoring of remaining balance of veterinary medicines and pollutants in live animals, the raw foodstuff of animal origin and sterns (further - plans of the state monitoring) the state laboratories of veterinary medicine with proper material and technical resources.

According to the Directive 96/23/EEC of the state shall adopt the laws, regulations and provisions necessary for accomplishment of programs of monitoring of remaining balance of veterinary medicines and pollutants in live animals, animal products and sterns, and also in the foodstuff under control to veterinary service. The question of inclusion in the list of the third countries from which import of animals and foodstuff of animal origin is resolved is solved the European commission based on the provided plans of the state monitoring. Besides, according to the decision of the European commission 657/2002/EU of August 12, 2002 (daleeresheniye 657/2002/EU) in pursuance of the Directive 96/23/EEC concerning application of methods of the analysis and interpretation of results of the state shall guarantee reliability of results of the conducted researches.

When carrying out researches of remaining balance of veterinary medicines and pollutants in live animals, animal products and sterns, and also in the foodstuff under control to veterinary service, rapid methods (immunoenzymatic, radio immune (radio immunological), thin layer chromatography) which results often require confirmation by foreign referens-laboratories are mainly applied.

Benefit of this option is that in Ukraine the material and technical resources of the state laboratories of veterinary medicine will be enhanced, the sphere of their accreditation in ISO/IEC 17025, which determines general requirements to competence of test and calibrating laboratories is expanded, confirmable methods of control similar are developed and implemented.

So, the third option - the most optimum. He will allow the state laboratories of veterinary medicine to implement in full plans of the state monitoring and to conduct researches (screening and confirmatory methods) upon the demand of the importing country. In case of application of the specified option the material and technical resources of domestic laboratories will also be strengthened, there will be no need for expenditure of public funds for researches for laboratories of other states.
