About chemicalixation and protection of plants

This Law determines general legal, economic, ecological, social and organizational basis of chemicalixation and protection of plants for the benefit of public health care, animals, the environment, the prevention or mitigation of consequences of pollution of the soil, vegetable and animal products.

Chapter 1. General provisions

Article 1. Terms and determinations

In this Law the following basic concepts are used:

agrochemicals - fertilizers, the feed additives, chemical ameliorants of soils, preservatives of forages used in practice for increase in fertility of soils and productivity of crops, product quality, and also chemical reactants for carrying out agrochemical analyses, production and chemical control of processes of conversion and conservation of agricultural products and natural raw materials, pesticides, growth substances and fertilizers;

agrochemical service - network of the production enterprises and research, technological organizations performing agrochemical servicing of agricultural industry;

agrochemical servicing of agricultural industry - system on development and deployment in agricultural production of scientifically based recommendations about rational use of means of chemicalixation in crop production and livestock production;

biological medicine for protection of plants - medicine in which the operating beginning is the microorganism or product of its life activity;

disease of plants - violation of normal metabolism of cages, bodies and the whole plant under the influence of phytopathogene or adverse conditions of the circle;

substances pollutants - the substances getting to the biosphere in the course of activities of the person, the defiant changes of the environment exceeding the established standard rates of harmful effects and creating health hazard of the person, to condition vegetable, fauna, to soils, atmospheric air and waters;

the wrecker of plants - the animal type capable to cause damages to plants from which it is economically reasonable to prevent damage;

harmful organism for plants - the organism reducing harvest of plants or its quality. Microorganisms, the insects striking plants and also rodents, weeds and others belong to harmful organisms;

state registration of pesticides and agrokhimikatovregistration of pesticides and agrochemicals based on which the executive body performing the organization of registration testing and state registration of pesticides and agrochemicals grants permission for production, application, realization, transportation, storage, destruction, advertizing, import to the Kyrgyz Republic and export from the Kyrgyz Republic of pesticides and agrochemicals;

active ingredient of pesticide - biologically active part of pesticide which use in the form of different preparative forms leads to impact on this or that type of harmful organism or on growth and development of plants;

diagnosis of disease of plants - recognition of disease of plants on set of signs;

protection of plants - the Section of applied biology developing theoretical bases and methods of prevention and decrease in losses from harmful organisms and also the Section of agricultural production performing application of these methods;

manufacturer - the physical person or legal entity performing production of pesticides and agrochemicals;

quarantine of plants - the particular treatment providing system of the governmental activities directed to protection of plants against delivery and penetration from other regions of the republic and the states of quarantine wreckers and causative agents of diseases of plants and weeds;

the mass wrecker of plants - the wrecker who is characterized by the permanent number or capability to its increase and leading to decrease in harvest or quality of agricultural products;

particular treatment - the specific mode of activities of state bodies of local self-government, the companies, organizations, organizations and farms irrespective of patterns of ownership directed to localization and liquidation of the centers of quarantine objects, allowing temporary establishment of the restrictions provided by this Law in implementation of the rights of physical persons and legal entities and assigning to them subsidiary duties;

pesticides - the chemical or biological medicines used for pest control or diseases of plants, weed plants, wreckers of the stored agricultural products, household wreckers and external parasites of animals and also for regulation of growth of plants, preharvesting removal of leaves (defoliants), preharvesting dehumidification of plants (desiccants);

Maximum allowable concentration - maximum permissible quantity chemical veshchestvmaksimalny amount of chemicals in food and in harvest, not making harmful effects per capita and animals; threshold limit values of chemicals in the soil, for water of fishery reservoirs, maximum permissible residual amounts of pesticides in sterns for farm animals;

the forecast - forecasting of number, prevalence and time of appearance of wreckers (diseases) of plants;

growth substances (growth regulators) - the organic compounds of different chemical composition causing strengthening in the minimum doses, and in the raised doses - oppression of growth of plants;

developer - the physical person or legal entity performing receipt of pesticides or agrochemicals, research of their activity, toxicological properties and influence on the surrounding environment;

regulations of use of pesticides and agrochemicals - mandatory requirements to conditions and procedure for use of pesticides and agrochemicals;

health regulations - the rules regulating the conditions of use of chemicals and pesticides in agricultural industry for the purpose of the prevention of poisonings among the persons adjoining to them in the course of work (transportation, storage, processing of plants, animals, birds, rooms, care of the processed crops, etc.) preventing pollution of food by them, atmospheric air, the inhabited places, reservoirs and the soil. All requirements stated in health regulations extend also to biological means of pest control and diseases of plants;

weeds - the plants littering agricultural holdings and doing harm to crops;

fertilizer - substance for food of plants and increase in fertility of the soil;

phytosanitation - actions for reduction of quantity or destruction of harmful organisms;

phytosanitary monitoring - the forecast and establishment of the most probable level of distribution, number, intensity of development and injuriousness of organisms;

phytosanitary situation - the condition of lands, the woods and vegetation determined by the number of wreckers of plants, spread of diseases of plants and availability of weed plants;

chemicalixation and protection of plants - complex of the governmental, public, economic and special events for application of means of chemicalixation and protection of the plants directed to increase in fertility of soils, productivity of crops, prevention and decrease in losses from wreckers, diseases and weeds;

chemicalixation of agriculture and crop production - application of chemical means for increase in productivity of crop production and improvement of quality of agricultural products;

epiphytoty - mass disease of plants.
