About approval of the Regulations on guarantees of origin of the electric power made from renewable energy resources
Being effective according to Art. 7 of the Law on renewable energy No. 160-XVI of 12.07.2007. (The official monitor of the Republic of Moldova, 2007, No. 127-130, of the Art. 550), for the purpose of regulation of the sector of renewable energy the Administrative board of the National agency on regulation in power DECIDES:
1. Approve Regulations on guarantees of origin of the electric power made from renewable energy resources, component to this resolution.
2. To management of regulation and licensing to perform monitoring of observance by participants of the market of electrical energy of the approved Provision.

The regulations on guarantees of origin of the electrical energy made from renewable energy resources, further the Provision are developed according to provisions of the Law on renewable energy No. 160-XVI of 12.07.2007 (The official monitor of the Republic of Moldova, 2007, No. 127-130, the Art. 550).
1. The provision determines:
a) criteria and conditions of issue, procedure of issue and cancellation of guarantees of origin;
b) necessary documents and data for issue of guarantees of origin;
c) the application form about issue of guarantees of origin;
d) form of guarantees of origin;
e) necessary measures for ensuring correctness and reliability of guarantees of origin;
f) the procedures connected with use of guarantees of origin and responsibility of these procedures of the parties involved in execution;
g) the transactions performed when accounting guarantees of origin.
2. The concepts used in this Provision have the following values:
Hybrid power plant - the installation for development of electrical energy applying both fossil fuel, and renewable energy resources.
Installation for burning of waste - installation for production of electrical energy with or without recuperation of the developed heat, used only or generally for burning of waste by oxidation or for thermal conversion of waste.
3. The guarantee of origin specifies renewable energy resource from which the electrical energy was developed, date of issue, locations of installation for production of electrical energy, installed capacity of the making installation, quantity of the made electrical energy, and gives the chance to the producer to prove that the electrical energy realized by it is made from renewable energy resources.
4. The guarantee of origin is issued monthly by operators of the transferring or distribution network on amount of the electrical energy made last month from renewable energy resources.
5. The guarantee of origin is provided to producers which generating capacity of installation makes 10 kW and more.
6. The guarantee of origin is constituted and issued by the operator of the transferring or distribution network on quantity of the electrical energy made by each installation making electrical energy from renewable energy resources, in triplicate: one for the producer, network, the second for the operator, third for National regulation agency in power (further the Agency).
7. The sample of guarantee of origin is specified in Appendix No. 1 of the Provision.
8. For hybrid power plants and installations for burning of waste the guarantee of origin is issued only on quantity of the electrical energy made from renewable energy resources.
9. Guarantees of origin are issued on all amount of the electrical energy made from renewable energy resources which is subject to payment by suppliers of electrical energy.
10. The operator of the transferring or distribution network establishes separate number of each guarantee of origin.
11. The operator of the transferring or distribution network without fail provides to the Agency origin guarantee copy within 5 calendar days from the date of its issue.
12. For receipt of guarantee of origin the electric power producer submits the application, according to Appendix No. 2 of Provisions, the operator of the transferring or distribution network depending on power network to which the corresponding installation of production is attached.
13. The operator of the transferring or distribution network shall register all statements for issue of guarantees of origin with indication of date of filing of application.
14. After receipt of the statement for issue of guarantees of origin and filling of all necessary forms, the operator of the transferring or distribution network shall make inspection of the location of installation of production of electrical energy from renewable energy resources and check the data specified in the statement for their compliance with reality.
15. The producer shall provide access for personnel of the operator of network to the location of installation of production of electrical energy during working hours and provide the requested information necessary in its order to be convinced that I will eat around electrical energy on which the origin guarantee is requested, is made from renewable energy resources.
16. If the producer does not resolve access for personnel of the operator of network to the location of installation of production of electrical energy or does not permit to make inspection, the operator of network refuses issue of guarantee of origin. In this case the producer takes the responsibility for the actions. The refusal in issue of guarantee of origin goes to the producer the registered mail with the notification in which causes of failure are specified.
