PRESIDENTIAL DECREE OF THE REPUBLIC OF BELARUS

About funds of precautionary (preventive) actions for separate types of insurance

(as amended on 11-05-2019)

1. Approve:

1.1. the amount of contributions to fund of precautionary (preventive) actions on:

to compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Republic of Belarus - 15 percent from the arrived insurance premiums;

to obligatory civil liability insurance of legal entities and individual entrepreneurs for the harm done by the activities connected with operation of separate objects, to obligatory civil liability insurance of carrier in transit of dangerous goods - 10 percent from the arrived insurance premiums on each of the specified types of insurance;

to obligatory civil liability insurance of owners of vehicles - 8 percent from the arrived insurance premiums on agreements of internal insurance or agreements of all-inclusive internal insurance and agreements of boundary insurance;

to obligatory civil liability insurance of carrier before passengers, to compulsory insurance of the structures belonging to citizens, compulsory insurance from labor accidents and occupational diseases, to voluntary insurance of medical expenses - 5 percent from the arrived insurance premiums on each of the specified types of insurance;

to voluntary insurance of life - 1 percent from the arrived insurance premiums;

1.2. the enclosed Regulations on procedure and the directions of use of means of funds of precautionary (preventive) actions for separate types of compulsory and voluntary insurance.

2. To impose control over the implementation of this Decree on the State Control Committee.

3. This Decree becomes effective from the date of its official publication and extends the action to the relations which arose since January 1, 2009.

Regulations on procedure and directions of use of means of funds of precautionary (preventive) actions for separate types of compulsory and voluntary insurance

1. In this Provision the procedure and the directions of use of means of funds of precautionary (preventive) actions for compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Republic of Belarus, to obligatory civil liability insurance of owners of vehicles (are determined by agreements of internal insurance or agreements of all-inclusive internal insurance and agreements of boundary insurance) (further - obligatory civil liability insurance of owners of vehicles), to obligatory civil liability insurance of carrier before passengers, to compulsory insurance of the structures belonging to citizens, compulsory insurance from labor accidents and occupational diseases, to obligatory civil liability insurance of legal entities and individual entrepreneurs for the harm done by activities connected with operation of separate objects, to obligatory civil liability insurance of carrier in transit of dangerous goods, and also on voluntary insurance of medical expenses, voluntary insurance of life (further - funds).

2. Means of funds are transferred by insurance companies into the republican budget no later than the 22nd following reporting.

3. Managers of means of funds are:

3.1. on compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Republic of Belarus - the Ministry of Health, the State boundary committee, the Ministry of Internal Affairs;

3.2. on obligatory civil liability insurance of owners of vehicles - the Ministry of Internal Affairs, the Ministry of Transport and Communications, the State boundary committee, the Ministry of Emergency Situations, the Ministry of Health;

3.3. on obligatory civil liability insurance of carrier before passengers - the Ministry of Transport and Communications, the Ministry of Health;

3.4. on compulsory insurance of the structures belonging to citizens - the Ministry of Emergency Situations, the Ministry of Natural Resources and Environmental Protection;

3.5. on compulsory insurance from labor accidents and occupational diseases - the Ministry of Labour and Social Protection, the Ministry of Health;

3.5-1. on obligatory civil liability insurance of legal entities and individual entrepreneurs for the harm done by the activities connected with operation of separate objects - the Ministry of Emergency Situations;

3.5-2. on obligatory civil liability insurance of carrier in transit dangerous goods - the Ministry of Emergency Situations, the Ministry of Internal Affairs, the Ministry of Transport and Communications, the Ministry of Health;

3.6. on voluntary insurance of medical expenses, voluntary insurance of life - the Ministry of Labour and Social Protection, the Ministry of Health.

4. Funds of funds are distributed if other is not provided by legal acts, between managers equal shares from the amount of the means arriving in the republican budget for each type of insurance, except for means of the following funds:

on obligatory civil liability insurance of carrier before passengers, distributed between the Ministry of Transport and Communications and the Ministry of Health in the amount of respectively 80 and 20 percent;

on compulsory insurance of the structures belonging to citizens, distributed between the Ministry of Emergency Situations and the Ministry of Natural Resources and Environmental Protection in the amount of respectively 80 and 20 percent.

5. The basis for receipt in accordance with the established procedure of means of funds are the estimates of use of fund approved with the Ministry of Finance:

5.1. on compulsory medical insurance of the foreign citizens and stateless persons who are temporarily staying or temporarily living in the Republic of Belarus, approved by the Ministry of Health, the State boundary committee, the Ministry of Internal Affairs;

5.2. on obligatory civil liability insurance of owners of vehicles, approved by the Ministry of Internal Affairs, the Ministry of Transport and Communications, the State boundary committee, the Ministry of Emergency Situations, the Ministry of Health;

5.3. on obligatory civil liability insurance of carrier before passengers, constituted based on the requests submitted by regional executive committees and the Minsk Gorispolkom under which authority urban road and electric transportation is, approved by the Ministry of Transport and Communications, and also the estimates of use of fund on this type of insurance approved by the Ministry of Health;

5.4. on compulsory insurance of the structures belonging to citizens, approved by the Ministry of Emergency Situations, the Ministry of Natural Resources and Environmental Protection;

5.5. on compulsory insurance from labor accidents and occupational diseases, approved by the Ministry of Labour and Social Protection, the Ministry of Health;

5.5-1. on obligatory civil liability insurance of legal entities and individual entrepreneurs for the harm done by the activities connected with operation of separate objects, approved by the Ministry of Emergency Situations;
