About approval of the Procedure for use of means of the State fund of the treatment of radioactive waste

The Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for use of means of the State fund of the treatment of radioactive waste which is applied.

2. This resolution becomes effective since January 1, 2010.

Procedure for use of means of the State fund of the treatment of radioactive waste

1. This Procedure determines the mechanism of use of means of the State fund of the treatment of radioactive waste (daleefond) which is created for acquisition account in special fund of the government budget from collection for pollution of the surrounding environment which is collected for formation of radioactive waste (including already cumulative) and temporary storage of radioactive waste by their producers, and also other sources which are not prohibited by the legislation.

2. By fund financing of actions of the Nation-wide target ecological program of the treatment of radioactive waste (further - the Nation-wide program) in the amounts provided the current year according to the appropriate budget programs is performed.

3. The central executive body which exercises public administration in the field of the treatment of radioactive waste is the main manager of fund (the daleeglavny manager).

Managers of fund (further - managers) are budgetary institutions which activities are connected with accomplishment of actions of the Nation-wide program.

Receivers of fund are the companies, organizations and the organizations which receive through managers of funds for accomplishment of actions of the Nation-wide program (daleepredpriyatiya).

4. Fund is allocated for accomplishment of such annual tasks determined in appendix 2 to the Nation-wide program:

1) construction, putting into operation and operation of the Vector complex;

2) designing, construction and operation of storage for interim storage of highly active radioactive waste which returns from the Russian Federation after conversion of the fulfilled nuclear fuel of the Ukrainian nuclear power plants;

3) pereosnashchaniye and reshaping of special plants of the state corporation "The Ukrainian national association "Radon" for the purpose of creation of conditions for collection and storage of radioactive waste;

4) providing:

further development of the state system of accounting of radioactive waste;

radiation safety and implementation of antiradiation actions during the treatment of radioactive waste, reduction of doses of radiation of personnel of specialized enterprises and the population;

5) training and holding information and educational actions;

6) development of regulatory framework in the field of the treatment of radioactive waste, carrying out research and development works, preparation of the National report on accomplishment of the Integrated convention on safety of the treatment of spent fuel and about safety of the treatment of radioactive waste;

7) accomplishment of complex of search, estimative, scientific and methodical, research and project works at the choice of platforms for the purpose of placement of geological storage for burial of dolgosushchestvuyushchy and highly active radioactive waste.

5. Managers:

1) is constituted by estimates and plans of special fund of the government budget (except for own receipts of budgetary institutions and the corresponding expenses) and give them for approval to the main manager;

2) are approved:

annual plans of works of the companies with the monthly estimate;

plans of use of fund;

3) is determined by priority tasks of the companies for the current year;

4) is established in coordination with the main manager by productive indicators, proceeding from the list given in appendix 2 to the Nation-wide program;

5) exercise control over the implementation of annual plans of works.

6. Companies:

1) is used by fund in borders of estimate appointments only for accomplishment of annual plans of works;

2) is constituted monthly by reports on accomplishment of work plans for previous period which after consideration and approval by the manager are the basis for assignment of Fund and implementation of payments.

7. Purchase of goods, works and services by fund is performed according to the legislation.

8. Money transfer of Fund is performed according to Procedure for servicing of the government budget on expenses and transactions on provision and return of the loans granted at the expense of means of the government budget which is approved by the State Treasury.

9. Opening of accounts in bodies of the State Treasury by the manager and the companies and display of the performed operations connected with use of fund in financial accounting and the financial reporting about accomplishment of the government budget is performed according to the procedure, established by the State Treasury.

10. The companies submit quarterly to the 10th day of the next month to managers reports on accomplishment of work plans in natural, cost and productive indicators and reports on use of means.

Managers submit quarterly to the 15th day of the next month to the main manager reports on accomplishment of work plans.

The main manager submits to the Ministry of Finance quarterly to the 20th day of the next month the report on accomplishment of the actions specified in Item 2 of this Procedure with analysis results and offers concerning settlement of problematic issues.

11. Control of target and effective expenditure of fund is performed in the procedure established by the legislation.
