About the guaranteed state minimum social standards

This Law determines bases of legal regulation in the field of establishment and application of the guaranteed state minimum social standards for ensuring the major vital needs of the population.
For the purposes of this Law the following basic concepts are used:
the guaranteed state minimum social standard (further - the social standard) - the minimum level of guarantees of provision of the public, free and granted tax allowance social services and payments;
subsistence minimum - cost assessment of the minimum set of the material benefits and services equal in size of cost of the minimum consumer goods basket, necessary for ensuring activity of the person and preserving his health, and also the amount of obligatory payments and charges (fees);
poverty line - border of minimum income on one person necessary for satisfaction of the minimum needs of the person;
level of living - set of the material and spiritual benefits and services providing satisfaction of vital requirements of the population.
The basic principles of forming and application of social standards are:
- ensuring constitutional rights of citizens;
- compliance of social standards to the main directions of the state social policy;
- social and economic justification of social standards;
- priority and obligation of social expenses during the forming and execution of the consolidated government budget;
- frequency of official establishment of social standards;
- publicity of establishment and change of social standards;
- responsibility of state bodies for observance of the established social standards.
Establishment of social standards is directed to the solution of the following tasks:
- determination of the regulations of consumption by citizens of the main material and spiritual benefits and services guaranteed by the state;
- carrying out single state social policy and non-admission of distinctions of levels of social development on regions on the basis of equalization of conditions of ensuring availability of consumption of the material and spiritual benefits and services;
- assessment of level of living of the population and conditions of its increase on regions;
- increase in efficiency of use of the budgetary and other funds allocated for provision of social services;
- reasons for need of target and targeted state support to the needy and being in difficult life situation citizens.
Social standards are a part of the system the social standards established in the following areas of the social sphere:
- health care;
- social protection;
- education;
- housing-and-municipal servicing;
- compensation, employment relationships and labor protection;
- provision of pensions;
- assistance of employment of the population;
- providing ecological safety;
- providing legal order, safety of citizens and free legal aid;
- culture;
- physical culture.
Social standards in the field of health care provide:
- provision of the emergency (urgent) medical care to all population by the organizations of health care, irrespective of patterns of ownership, is free before removal of the patient from medical emergency;
- rendering basic medical services to citizens at primary level according to the amounts and types determined by the Government of the Kyrgyz Republic;
- provision of medical care free of charge and on favorable terms to citizens according to the social status and clinical indications included in the list approved by the Government of the Kyrgyz Republic;
- performing free immunoprevention of vaktsinoupravlyaemy infections according to the National calendar of preventive inoculations approved in accordance with the established procedure by the Government of the Kyrgyz Republic.
Social standards in the field of social protection provide determination:
- public welfare payments to citizens (families) taking into account their needs;
- requirements to the provided services for socially vulnerable categories of citizens in the sphere of social servicing;
- ritual benefits (on burial) in case of the death of able-bodied and disabled citizens.
Social standards in the field of social protection affirm the Government of the Kyrgyz Republic.
Social standards in the field of education consist of the regulations and standard rates providing the minimum level of social protection of the studying all education levels.
In the field of education the following social standards are established:
- preschool;
- school;
- initial, the main and average;
- initial, average professional;
- the highest professional.
In the field of education obligatory free receipt of initial, main and general secondary education by each citizen in the state and municipal educational organizations is established.
The procedure for education in the organizations preschool, initial professional, average professional and higher education, financed from the government budget, is determined by the Government of the Kyrgyz Republic.
Social standards in the field of housing-and-municipal servicing are established on public services - water, the electric power, ensuring withdrawal of drains.
Providing the population with additional types of housing and communal services (hot water, heat power, gas, cleaning of household garbage) is made by local government bodies.
The procedure for provision of housing subsidies and compensations to needy citizens affirms the Government of the Kyrgyz Republic and local government bodies.
Social standards provide establishment in areas:
- compensations - the minimum wage which determines the salary level of the worker of unskilled labor;
- employment relationships - durations of working hours, the main paid leave, guarantees, privileges and compensations under the terms of work;
- labor protections - the mandatory requirement to safety and labor protections.
