This Instruction establishes procedure for development and acceptance by employers of the local legal acts containing requirements for labor protection in the form of instructions for labor protection for professions of working and (or) separate work types (services) (further – instructions for labor protection).
2. No. 128 is excluded according to the Resolution of the Ministry of Labour and Social Protection of the Republic of Belarus of 24.12.2013
3. For the purposes of this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus "About labor protection" are applied.
4. The employer develops and accepts instructions for labor protection for professions of working and (or) separate work types (services) which accomplishment is performed in the organization by workers of various professions of workers and positions of employees (handling works, works with the electromechanical tool, works at height, earthwork and others).
The employers including who are not given the right of adoption of local legal acts in the absence of specifics of professions of workers and (or) work types (services) can be guided by the corresponding standard instructions for labor protection.
5. Instructions for labor protection are developed on the basis of regulatory legal acts, including technical regulatory legal acts, technical regulations of the Customs union and Eurasian Economic Union, provisions on labor protection stated in technological documentation, operational documents of the organizations manufacturers to the equipment used in the organization, the tool, mechanisms and devices (further - operational documents), taking into account local conditions and specifics of organization activity.
In case of absence in regulatory legal acts, including technical regulatory legal acts, technical regulations of the Customs union and Eurasian Economic Union, technological documentation, operational documents of requirements (provisions) for labor protection employers develop for professions of workers and (or) work types (services) and include in the instructions for labor protection of the requirement for labor protection providing preserving life, health and efficiency of workers in the course of labor activity.
6. Instructions for labor protection join only those requirements which belong to labor protection and are carried out by working.
7. Provisions of instructions for labor protection shall not contradict regulatory legal acts, including the technical regulatory legal acts containing requirements for labor protection.
