About approval of the Regulations on the State committee of the Azerbaijan Republic on work with religious structures

For the purpose of ensuring activities of the State committee of the Azerbaijan Republic on work with religious structures I decide:

1. Approve Regulations on the State committee of the Azerbaijan Republic on work with religious structures it (is applied).

2. To the Cabinet of Ministers of the Azerbaijan Republic:

in a month to approve expense budget and numerical limit of employees of the State committee on work with religious structures, to resolve the logistics issues connected with ensuring its activities;

resolve other issues following from this Decree.

3. This Decree becomes effective from the date of signing.

Regulations on the State committee of the Azerbaijan Republic on work with religious structures

I. General provisions

1. The state committee of the Azerbaijan Republic on work with religious structures (further - Committee) is created by the Presidential decree of the Azerbaijan Republic of June 21, 2001 No. 512.

The committee is the central executive body providing implementation of state policy in the field of religious activities, observance of provisions of the legislation on religious structures, the coordination of activities of the central authorities connected with religious structures.

The acts adopted by Committee within the competence are obligatory for others central and the local executive bodies, structures connected with religious activities, physical persons and legal entities, and the Committee exercises control of execution of these acts.

The committee does not give any financial support to religious structures.

The main activities of Committee according to article 48 of the Constitution of the Azerbaijan Republic are connected with creating favorable conditions for implementation of religious liberty.

2. In the activities the Committee is guided by the Constitution of the Azerbaijan Republic, decrees and orders of the President of the Azerbaijan Republic, resolutions and orders, international treaties which participant is the Azerbaijan Republic of the Cabinet of Ministers of the Azerbaijan Republic and this Provision.

3. In case of accomplishment of the tasks and implementation of the rights the Committee interacts with other executive bodies, local government bodies and non-governmental organizations, coordinates their activities connected with religious cases.

4. The committee has separate balance, the state-owned property which is according to the legislation at its disposal, state and bank accounts, seal with the image of the State Emblem of the Azerbaijan Republic and own name, the corresponding stamps and forms.

5. Maintenance costs and activities of Committee are financed by means of the government budget of the Azerbaijan Republic and other stipulated by the legislation sources.

6. The committee is placed in the city of Baku.

The committee carries out the tasks on places by means of regional departments.

II. Activities of Committee

6-1. Activities of Committee are:

6-1.1. implementation of activities in the sphere of providing religious liberty;

6-1.2. participation in forming of single state policy in the sphere of providing religious liberty and ensuring implementation of this policy;

6-1.3. ensuring regulation and development of the relations state religion;

6-1.3-1. Carries out educational work in the sphere of religion;

6-1.4. implementation of state registration of religious structures;

6-1.5. participation within the powers in regulation of the questions connected with religious education;

6-1.6. implementation of activities in other directions established by the legislation.

III. Tasks of Committee

7. Tasks of Committee are:

7.1. Creation of the corresponding conditions for religion implementation;

7.2. Ensuring control of observance of the legal acts connected with religious liberty;

7.3. in stipulated by the legislation procedure implementation of state registration of religious structures, maintaining the state register of religious structures, the publication in media of data on state registration of religious structures, rendering assistance in the organization of organizational work of religious structures according to the law;

7.4. Rendering necessary assistance to religious structures in achievement of arrangements with state bodies at the request of religious structures and in the questions requiring the solution state bodies;

7.5. Rendering assistance to strengthening of mutual respect, understanding and tolerance between religious structures of various religions, prevention of cases of opposition and discrimination, other negative manifestations on religious basis, religious radicalism and extremism;

7.6. Creation of general databank with receipt of data at the religious centers, religious bodies and other religious structures;

7.7. Rendering assistance to participation of the religious organizations in business contacts with the international religious movements, forums, international religious centers and foreign religious structures;

7.8. Ensuring conducting theological examination of literature (on paper and electronic media), audio-and video records, goods and products of religious appointment and other information materials of religious content;

7.9. Coordination of the activities of executive bodies connected with religious work and control of these activities. Rendering assistance in the organization of work of the commissions on questions of religion created in case of the district and city executive authorities;

7.9-1. twice a year representation to the President of the Azerbaijan Republic of reports on toleration in the country;

7.9-2. in the presence of the bases specified by the law, appeal to the court for liquidation of religious structure;

7.9-3. in the procedure established by the law and cases performs concerning religious structures of function of monitoring body over legalization of the property received in the criminal way, and financing of terrorism including to svz using target financial sanctions;

7.9-4. hearing of cases about the corresponding administrative offenses, stipulated by the legislation;

7.9-5. According to the second part of article 24 of the Law of the Azerbaijan Republic "About religious liberty" the religious center shall send citizens to foreign educational institutions for training, exchange of students and teachers, and also religious figures and specialists;
