About approval of Rules of calculation of length of service in the specialty for civil servants, employees of the organizations containing at the expense of means of the government budget, employees of the state companies of social security

For the purpose of implementation of the order of the Government of the Republic of Kazakhstan of December 29, 2007 No. 1400 "About wages system of civil servants, employees of the organizations containing at the expense of means of the government budget, employees of the state companies", PRIKAZYVAYU:

1. Approve the enclosed Rules of calculation of length of service in the specialty for civil servants, employees of the organizations containing at the expense of means of the government budget, employees of the state companies of social security.

2. Declare invalid the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan "About approval of Rules of calculation of length of service in the specialty for the employees of public institutions of social security who are not government employees" of February 22, 2002 No. 39-p (it is registered in the Register of state registration of regulatory legal acts for No. 1764, No. 15, by the Art. 572) is published in the Bulletin of regulatory legal acts of the central executive and other state bodies of the Republic of Kazakhstan, 2002.

3. This order becomes effective after ten calendar days after its first official publication.

Rules of calculation of length of service in the specialty for civil servants, employees of the organizations containing at the expense of means of the government budget, employees of the state companies of social security

1. These rules regulate procedure and conditions of calculation of length of service as civil servants, employees of the organizations containing at the expense of means of the government budget, employees of the state companies of social security (further the organizations).

2. In length of service all the time of work on the same specialty in the organizations irrespective of form of business in the specialty is set off, and also time joins:

1) stay in public service on the same specialty;

2) passings of active duty, and also accomplishment of international debt, including finding of the military personnel in captivity, faces of officers, ensigns, warrant officers, the military personnel of extra urgent service in Armed Forces, internal, border troops, governing bodies and parts of civil defense of the Republic of Kazakhstan and the former USSR, in system of bodies of Committee of homeland security of the Republic of Kazakhstan and Committee for State Security of the USSR, in Security service of the President of the Republic of Kazakhstan and Republican guard of the Republic of Kazakhstan, except persons, dismissed from service for negative motives;

3) maternity leaves, and also time of the additional vacation non-paid on child care granted according to the legislation;

4) implementation of powers of deputies of Parliament of the Republic of Kazakhstan, local representative bodies of the Republic of Kazakhstan;

5) works abroad if before the direction abroad the worker worked in the specialty in public institution and within two months from the date of return from abroad, apart from moving time, went to work in public institution;

6) induced truancy in case of wrongful dismissal and the subsequent recovery at work;

7) training in the direction of public institutions at rates in preparation, retraining and advanced training of personnel with separation from work if the worker before revenues to rates worked in public institution and after their termination returned to public institution;

8) scientific work in the organizations for specialty profile;

9) passings of internship till September 1, 1999 and clinical internship in the specialty;

10) works on positions on identical specialties irrespective of field of activity in which its labor activity proceeded;

11) operating time in the sphere of social security, education and health care on positions on social, pedagogical and medical specialties.

3. The length of service in the specialty which is set off according to these rules is considered in calendar calculation.

4. To workers who during calendar month had right to increase in official pay rate calculation of official pay rate taking into account years of service is performed from the date of emergence of such right.

5. Length of service in the specialty and identity of specialties is determined in case of employment by the commission of the organization for establishment of working life which structure affirms the head of the organization.

6. The decision of the commission on establishment of length of service in the specialty is drawn up by the protocol. Statements are made of the decision in duplicate and are transferred: one copy - in personnel service, the second - in accounts department.

7. The main document for determination of length of service in the specialty is the service record (in case of its availability) or the employment contract or statements from orders on acceptance and dismissal, the record of service. Cases, when there is no necessary record or contain the wrong or inexact records about the work periods, in confirmation of length of service references, personal accounts and distribution slips of the salary and other documents containing data on the work periods stipulated by the legislation are accepted. Confirmation of length of service in the specialty is performed by the testimony in the procedure established by the legislation.
