About consumer protection

This Law determines general legal, economic and social basis and the mechanism of single regulation of the relations between the consumer and the manufacturer, the seller and the contractor in the course of purchase and sale, performance of works and rendering services, and also consumer protection for the purpose of creation of equal conditions for them in the territory of the Azerbaijan Republic.

The law is drafted on the basis of "The guidelines for protection of the consumer interests" accepted by the United Nations General Assembly and directed to reduction of the similar relations in the Azerbaijan Republic in compliance with world practice.

Chapter I. General provisions

Article 1. Basic concepts

The basic concepts applied in this Law:

the consumer - the person who is using, acquiring, ordering, or having intention to acquire or order goods, works and services for satisfaction of personal needs;

the manufacturer - irrespective of pattern of ownership and legal form, the company, organization, the organization or the entrepreneur making goods for realization;

the contractor - the company, organization, the organization or the entrepreneur performing the works or rendering services;

the seller - the company, organization, the organization or the entrepreneur making the transactions on purchase and sale realizing goods;

the regulating document - state standards, pharmacological, sanitary and construction standards, rules and other documents which according to the legislation of the Azerbaijan Republic establish mandatory requirements to quality and safety of goods (works, services);

shortcoming - discrepancy of goods (work, service) to requirements of regulating documents, conditions of agreements or other imposed requirements, and also information on goods (work, service) provided by the contractor or the seller;

the essential shortcoming - shortcoming which makes impossible or inadmissible use of goods (work, service) according to its purpose or cannot be eliminated to the relation of this consumer, or for its elimination big costs of work and time are required, or does goods (work, service) to others, than it is provided by the agreement, or is shown after its elimination again;

the certificate of conformity (certificate) - the document issued for confirmation of conformity of the goods certified by rules of certified system (service, work), process, management system and personnel to the requirements established by the corresponding standard, the technical regulation and other regulatory legal act;

mark of conformity - the sign showing goods compliance (services, works), process, management system and personnel to the requirements established by the corresponding standard, the technical regulation and other regulatory legal act appropriated and applied according to rules of certified system, registered in accordance with the established procedure;

safety of goods (works, services) - the usual conditions of use, storage, transportation, operation of goods (works, services) or process of performance of works (rendering services) excluding damnification of life, to health, property of the consumer, and also the environment;

warranty period - the term during which the warranty obligations provided in the relevant regulating documents are valid;

the control brand - special sign of single sample with the alphanumeric code and holographic remedy pasted to copies which is provided for one-time application and confirms production (production) of copies of the audiovisual work, soundtrack, the computer program, collection of information, books and other objects of the author's and related right with observance of copyright and the related rights, and also availability of permission to sales of goods, products and information materials for which sale permission of the relevant state body is required, and grants the right to distribution of these copies.

Article 2. Legislation of the Azerbaijan Republic on consumer protection

The legislation of the Azerbaijan Republic on consumer protection consists of the Civil code of the Azerbaijan Republic, this Law and other regulatory legal acts published according to it.

If the international treaty of the Azerbaijan Republic establishes other rules, than those which contain in this Law then are applied rules of the international treaty.
