ORDER OF THE FEDERAL CUSTOMS SERVICE OF THE RUSSIAN FEDERATION

About approval of the Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation

(as amended on 20-08-2024)

In pursuance of article 47 of the Federal Law of July 21, 1997 N 114-FZ "About service in customs authorities of the Russian Federation" (The Russian Federation Code, 1997, N 30, Art. 3586; 2000, N 33, Art. 3348; N 46, of Art. 4537; 2001, N 53 (p. I), Art. 5030; 2002, N 27, Art. 2620; N 30, of the Art. 3029, Art. 3033; 2003, N 1, Art. 15; N 27 (p. I), Art. 2700; N 52 (p. I), Art. 5038; 2004, N 27, Art. 2711, N 35, Art. 3607; N 49, of Art. 4846; 2005, N 14, Art. 1212; 2007, N 10, Art. 1151; 2008, N 26, to the Art. 3022), for the purpose of the completing of customs authorities of the Russian Federation and organizations which are under authority of FCS of Russia (daleetamozhenny bodies), highly professional personnel structure, providing objective assessment of office activities of customs officers and also for further enhancement of work on matching and placement of personnel I order:

1. Approve the enclosed Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation (further - the Provision).

2. To chiefs of structural divisions of FCS of Russia, customs authorities and certifying commissions of customs authorities to be guided by the Provision when carrying out employee assessment.

3. To chiefs of structural divisions of FCS of Russia, customs authorities to bring this order to the attention of subordinate employees.

4. Declare invalid the order of the State Customs Committee of Russia of October 29, 2003 N 1215 "About approval of the Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation" (per is registered by the Ministry of Justice of the Russian Federation on December 5, 2003. N 5299).

Regulations on procedure for carrying out employee assessment of customs authorities of the Russian Federation

I. General provisions

1. Employee assessment of customs authorities of the Russian Federation is carried out in the customs authorities of the Russian Federation and organizations which are under authority of FCS of Russia (further - customs authorities), for the solution of questions:

1) about compliance of the employee of customs authority of post;

2) about representation of the employee of customs authority to the state award of the Russian Federation.

2. Certification for the solution of question of compliance of the employee of customs authority (further - the employee) post can be next and early.

3. The next employee assessment is carried out not more often than once in two years, but at least once in four years.

4. Early employee assessment can be carried out based on the order of customs authority in coordination with the chief of higher customs authority, except the cases specified in Item 6 of this provision on procedure for carrying out employee assessment of customs authorities of the Russian Federation (further - the Provision) not earlier than in 30 calendar days after finishing the relevant order to the employee under the signature.

5. Certification for the solution of questions of representation of employees to the state award of the Russian Federation is carried out taking into account the features provided by Chapter IV of this provision.

6. Certifications are not subject employees:

1) the holding positions less than a year;

2) being at the disposal of the chief of customs authority in connection with holding organizational and regular actions;

3) attached to public authorities of the Russian Federation and the organizations (the specified employee categories are not subject to certification for sending);

4) the employees who are on maternity leave on child care, and expectant mothers (certification of the specified employees is carried out not earlier than in year after exit from leave).

7. In system of customs authorities the following certifying commissions are created:

1) the Highest certifying commission of FCS of Russia;

2) certifying commission of FCS of Russia on employee assessment of law-enforcement divisions;

3) certifying commission of central office of FCS of Russia;

4) certifying commissions of regional customs authorities;

5) certifying commissions of regional customs authorities on employee assessment of law-enforcement divisions;

6) certifying commissions of customs;

7) certifying commission of the Russian customs academy.

According to the decision of the head of FCS of Russia other certifying commissions can be created.

8. Certifying commissions are created by orders of the relevant customs authorities in the following structure: chairman of certifying commission, his deputy (deputies), members of certifying commission and secretary (secretaries).

Can be included in structure of certifying commissions: the deputy chief of customs authority, the chief of personnel division, the chief of division on anti-corruption, the chief of legal division, the psychologist and other officials according to the decision of the chief of customs authority.

9. The certifying commission performs the activities according to the regulations of work of certifying commission (further Regulations) developed taking into account this provision and approved by the order of the relevant customs authority.

10. Positions of the employees who are subject to certification by the corresponding certifying commissions and also the officials responsible for preparation of responses on the certified employees and approval of results of certification, are determined by the standard scheme of employee assessment of customs authorities which affirms the order of FCS of Russia (further - the Standard scheme of certification).

II. Preparation for carrying out certification

11. Semi-annual work plans of certifying commission of customs authority, semi-annual schedules of certification and lists of the employees who are subject to certification are constituted by personnel division and affirm the chief of the relevant customs authority.

In graphics of certification it is specified: the name of customs authority, initials, surname, special rank of the employee, the name of structural division, post, date of certification, date of representation in certifying commission of necessary documents with indication of responsible heads of the relevant divisions of customs authority.

When forming the schedule of certification date of position assignment of the employee, date of the last certification is considered.
