ABOUT THE PROCEDURE FOR OPENING AND ACTIVITIES IN THE REPUBLIC OF BELARUS OF REPRESENTATIVE OFFICES OF THE FOREIGN ORGANIZATIONS

1. Approve the enclosed Regulations on procedure for opening and activities in the Republic of Belarus of representative offices of the foreign organizations.

2. Determine that:

2.3. legal entities of the State Parties of the Agreement on cooperation in the field of investing activities signed in by Ashgabade on December 24, 1993 for implementation of activities in the Republic of Belarus shall register in the territory of the Republic of Belarus the company with the rights of the legal entity in executive committee on the location of such company or representation by accreditation in the Ministry of Foreign Affairs;

to branches of legal entities of the State Parties of the specified Agreement, to the publication of this resolution which got in executive committee permission to placement in the territory of the Republic of Belarus without registration for its territories of the company with the rights of the legal entity or without accreditation in the Ministry of Foreign Affairs of representation of the foreign legal entity till August 1, 1998 to be registered by executive committee on the location as the company with the rights of the legal entity of the Republic of Belarus or by the Ministry of Foreign Affairs as representation;

activities of legal entities of the State Parties of this Agreement in other forms of business in the territory of the Republic of Belarus are forbidden.

3. Consider by BSSR which voided the resolution of Council of Ministers of June 21, 1991 N242 "About Approval of the Regulations on Procedure for Opening and Activities in the Belarusian SSR of Representative Offices of Foreign Firms and Organizations, Their Departments (Branches)" (JV BSSR, 1991, N 18, the Art. 217).

Regulations on procedure for opening and activities in the Republic of Belarus of representative offices of the foreign organizations

1. Representations of the legal entities and other organizations registered in accordance with the established procedure in foreign state of administrative and territorial units of foreign states (daleeorganization) open and perform activities in the territory of the Republic of Belarus based on the permissions issued by the Ministry of Foreign Affairs if other is not established by legal acts of the Republic of Belarus.

2. Representative office of the organization is its separate division located in the territory of the Republic of Belarus, performing protection and representation of interests of the organization and other functions which are not contradicting the legislation.

The representative office of the organization is not legal entity.

Representative offices of the organizations which activities are regulated by this Provision have the right to be engaged in business activity in the territory of the Republic of Belarus only for and on behalf of the organization represented to them.

Types of activity on which implementation receipt of special permission (license) is required can be performed by representation only based on such special permission (license) got by the organization in the procedure established by the legislation.

3. Representative offices of the organizations can be open for the purpose of implementation of activities for and on behalf of the organization represented to them which name is specified in permission to opening of representation, including:

3.1. for representative office of the commercial organization:

effective assistance of implementation of international treaties of the Republic of Belarus on cooperation in the sphere of trade, economy, finance, science and technology, transport, search of opportunities for their further development, enhancement of forms of this cooperation, establishment and expansion of amount of economic, commercial and scientific and technical information;

studying of the goods markets of the Republic of Belarus;

studying of opportunities for investing activities in the Republic of Belarus;

creations of overseas and joint businesses;

assistance to development of trade and economic relations between the countries;

representations and protection of interests of the commercial organization;

sales of tickets and seat booking of the companies of air, rail, road and sea transport;

implementation of activities in others, including the socially useful purposes which are not forbidden by the legislation of the Republic of Belarus for these representations;

3.2. for representative office of non-profit organization:

social support and protection of citizens, including improvement of financial position needy, social resettlement of the unemployed, disabled people and other persons who owing to the physical or intellectual features, other circumstances are not capable to exercise independently the rights and legitimate interests;

preparation of the population for overcoming consequences of natural disasters, environmental, industrial or other disasters, for prevention of accidents;

assistance injured with natural disasters, environmental, industrial or other disasters, social, ethnic, religious conflicts, to the victims of repressions, refugees and displaced persons;

assistance to strengthening of the world, friendship and consent between the people, to prevention of the social, ethnic and religious conflicts;

assistance to strengthening of prestige of family in society;

assistance to protection of motherhood, childhood and paternity;

assistance of activities in education, sciences, cultures, arts, educations, to spiritual development of the personality;

assistance of activities in the sphere of prevention and protection of public health, and also promotion of healthy lifestyle, improvement of moral and psychological condition of citizens;

assistance of activities in the sphere of physical culture and mass sport;

environmental protections and protection of animals;

protection and due content of the buildings, other objects and the territories having historical, cultural, cult or nature protection value and places of burial;

in other socially useful purposes.

For the purpose of carrying out promotional and informational work, studying of experience of organization activity of formation of the Republic of Belarus, assistance to the conclusion of agreements on cooperation between the organizations of education, assistance to experience exchange and information in education and sciences can be open representative offices of the organizations of education.
