About melioration and irrigation
This Law establishes the legal basis of activities in the field of melioration and irrigation.
In this Law the following basic concepts are used:
melioration - radical improvement of lands by holding hydrotechnical, kulturtekhnichesky, chemical, agricultural forest melioration, agrotechnical and other actions;
irrigation (irrigation) - water supply on crops on lands with shortage of natural water by holding technical and other actions;
the reclaimed (reclaimed) lands - lands which fertility improves (improved) as a result of implementation of meliorative actions;
the irrigated lands - the lands provided with irrigational systems and constructions for the purpose of irrigation;
meliorative systems - complexes of the interconnected hydraulic engineering and other constructions and devices (channels, collectors, pipelines, water storage basins, dikes, pumping points, water intakes, other constructions and devices on the reclaimed lands) providing creation of the optimum water, salt, air, thermal and nutritious modes of soils on the reclaimed lands and also protective forest plantings;
irrigational (irrigating) systems - complexes of the hydraulic engineering and other constructions providing rise, giving, distribution of water from water objects, irrigation of plantings, and also protective forest plantings;
separately located hydraulic engineering constructions - the engineering constructions and devices which are not logging in meliorative and irrigational, providing water delivery to consumers, removal of excessive waters by means of meliorative systems, protection of soils against water erosion and landslides, protective forest plantings;
meliorative and irrigational actions - designing, construction, reconstruction and operation of meliorative systems, irrigational systems and separately located hydraulic engineering constructions (further - meliorative and irrigational systems), flood of pastures, laying of protective forest plantings, carrying out kulturtekhnichesky works, works on improvement of physical and agrochemical properties of soils, scientific and technological ensuring the specified works;
consolidation of water users (Consolidation) - the special form of non-commercial structure created by agricultural producers for the purpose of management with the meliorative and irrigational systems transferred to them to use and providing grounds in the territory of servicing with irrigating water.
The legislation of the Azerbaijan Republic in the field of melioration and irrigation consists of this Law and other regulatory legal acts accepted according to it.
If international treaties of the Azerbaijan Republic establish other rules, than those which are stipulated by the legislation the Azerbaijan Republic in the field of melioration and irrigation then are applied rules of international treaties.
Melioration and irrigation is performed for the purpose of creating favorable conditions for agriculture, ensuring stability and increase in production of agricultural products on the basis of preserving and increase in fertility of lands, involvement in agricultural turnover of the unproductive not used lands.
Depending on nature of meliorative actions differentiate the following types of melioration: hydromelioration, agricultural forest melioration, kulturtekhnichesky melioration, chemical melioration and other types of melioration.
Each type of melioration is divided into the following types:
hydromelioration - irrigation, drainage, washing of saline soils, antierosion, against landslide, antiflood, antimudstone works and of river;
agricultural forest melioration - the soil-protective, field-protecting, water-retaining and other types of melioration performed by creation of forest plantings;
kulturtekhnichesky melioration - clearing of lands from wood and grassy vegetation, stones, hummocks, stubs and other objects, recultivation of lands etc.;
chemical melioration - plastering of soils etc.
