For the purpose of ensuring execution of Item 1.8 of the Presidential decree of the Azerbaijan Republic of July 4, 2008 "About approval of the Law of the Azerbaijan Republic "About road transport" the Cabinet of Ministers of the Azerbaijan Republic decides No. 792:

1. Approve "The procedure for pretrip check of technical condition of the vehicles which are at the disposal of the carriers performing public conveyance and loads road transport of performing pretrip medical examination of drivers" (is applied).

2. The resolution of the Cabinet of Ministers of the Azerbaijan Republic of August 21, 2006 No. 194 "About approval "Procedure for carrying out in the current procedure for pretrip and posttrip medical examination of the transport drivers who are in general use" and "Procedure for pretrip technical inspection of the vehicles which are in general use" (Collection of the legislation of the Azerbaijan Republic, 2006, No. 8, Article 732; 2008, No. 2, Article 116) to declare invalid.

3. This resolution becomes effective from the date of signing.

Procedure for pretrip check of technical condition of the vehicles which are at the disposal of the carriers performing public conveyance and loads road transport, performing pretrip medical examination of drivers

1. General provisions

1.1. This Procedure is prepared according to the Law of the Azerbaijan Republic "About road transport", establishes procedure for pretrip check of technical condition of the vehicles which are at the disposal of the carriers performing in the Azerbaijan Republic public conveyance and loads road transport irrespective of form of their property, form of business, performing pretrip medical examination of drivers.

1.2. Provisions of this Procedure are applied to the legal entities and business owners performing regular and irregular public conveyances by road transport, public conveyance by taxi cars for commercial purposes including the international and internal cargo transportation.

2. Organization, general principles and methods of pretrip check of technical condition of vehicles

2.1. The main objective of pretrip check of technical condition of vehicles consists in ensuring their compliance to requirements of the existing rules, standard rates, standards of safety and operation, protection of life and human health.

2.2. The carriers performing public conveyance and loads road transport shall provide pretrip check of technical condition of the vehicles which are at their disposal.

2.3. Pretrip check of technical condition of vehicles is performed according to the legislation in the Items organized by the physical persons or legal entities appointed by the Ministry of transport of the Azerbaijan Republic.

2.4. Pretrip check of technical condition of vehicles is performed by physical persons and legal entities based on employment or civil contracts.

2.5. During pretrip check of technical condition of vehicles their brake system, the steering gear of management, external light devices, window washers and wind screen wipers, wheels and tires, other elements of the motor and design are checked.

2.6. During pretrip check of technical condition of vehicles the following principles shall be observed:

2.6.1. conducting generally visual check by the professional specialist without department or removal of any part motor transportation means, with use of technical measuring means;

2.6.2. the validity to use of the used technical measuring means and compliance to their established standards.

2.7. The registration form of results of pretrip check of technical condition of vehicles is kept in the "Magazine of pretrip check of vehicles" established by the Ministry of transport, communication, and high technologies of the Azerbaijan Republic.

2.8. Based on results of pretrip check of technical condition of vehicles the reference approved by verification station seal is issued to carrier or the driver of the vehicle. The form of the reference is established by the Ministry of transport, communication, and high technologies of the Azerbaijan Republic

2.9. The reference is issued only to those vehicles which meet from technical aspect the requirements established by the legislation.

2.10. Vehicles are not allowed to transportations without availability of the certificate of pretrip check of technical condition.

3. General principles and methods of pretrip medical examination of drivers

3.1. The main objective of pretrip medical examination consists in ensuring compliance of the state of health of drivers to exit in run to medical regulations and requirements, protection of life and human health.

3.2. The carriers performing public conveyance and loads road transport shall provide passing by drivers of the vehicles which are at their disposal (daleevoditel), medical examination.

3.3. Pretrip medical examination of drivers is performed by the relevant medical institutions according to the legislation.

3.4. Pretrip medical examination of drivers by the relevant medical institutions is performed in the Items organized by the physical persons or legal entities appointed by the Ministry of transport of the Azerbaijan Republic.

3.5. Pretrip medical examination is performed by physical persons and legal entities based on employment or civil contracts.

3.6. During pretrip medical examination the anamnesis of drivers gathers, body temperature is taken, pulse is considered and alcohol availability in expiratory air is determined.

3.7. When performing pretrip medical examination the following principles shall be observed:

3.7.1. carrying out survey by professional health workers with use of the corresponding medical equipment;

3.7.2. the validity to use of the used medical equipment and compliance to its established standards.

3.8. The registration form of results of pretrip medical check of drivers is kept in the "Magazine of pretrip medical check of drivers" established by the Ministry of Health of the Azerbaijan Republic.

3.9. By results of pretrip medical examination in the book of pretrip medical examination of the driver which form is approved by the Ministry of Health of the Azerbaijan Republic the entries approved by survey Item seal are made.

3.10. Drivers are not allowed to vehicle control in case of discrepancy of condition of their health to medical requirements.
