About fight against terrorism

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following concepts are used:

terrorism - making of the explosions, the fires or other actions (act of terrorism) posing threat of life of people, causing damage to their health, causings significant property damage or emergence of other socially dangerous effects for the purpose of violation of public safety, sowing of panic among the population or rendering impact on decision making by public authorities or international organizations, and also threat of making of similar actions with the same purpose;

the terrorist - physical person which in this or that form, directly or indirectly, intentionally participates in implementation of terrorist activities as the organizer, the instigator, the assistant or the contractor either prepares similar acts or tries to make them, and also obviously assists group of persons by previous concert, to organized group or criminal society in implementation of terrorist activities;

terrorist group - consolidation of two and more persons for the purpose of implementation of terrorist activities;

the terrorist organization - the group of terrorists or the organization which is finding possible use in the activities of terrorism who in this or that form, directly or indirectly, intentionally participate in implementation of terrorist activities as the organizer, the instigator, the assistant or the contractor prepare acts of terrorism or try to commit them, and also obviously assist group of persons by previous concert, to organized group or criminal society in implementation of terrorist activities. If one of structural divisions with the consent of any governing body of the organization is occupied with terrorist activities, then this organization is considered the terrorist organization;

fight against terrorism - the activities connected with identification, prevention of terrorist activities or with data to minimum of damage which can be put as a result of terror;

the operations performed against terror - the special events performed for the purpose of prevention of acts of terrorism, safety of physical persons, disarmament, neutralization of terrorists, and also the data to minimum of damage which can be put as a result of act of terrorism;

zone of the operation performed against terror - limits of the territory or certain sites of the water area, vehicles, buildings, structures, constructions, apartment houses and the territories or water areas adjoining them where operations are performed;

terrorist activities - the activities connected with the organization, planning, preparation and implementation of acts of terrorism, violence over physical persons and legal entities for the purpose of terror by destruction or spoil of material objects, creation of the illegal armed connections, criminal groups for the purpose of implementation of acts of terrorism, and also with participation in these acts, involvement of persons to terrorism, the arms, training and their use intended by financing of the terrorist organizations or terrorist groups, or rendering other help to them;

the international terrorist activities - the activities performed by terrorists or the terrorist organizations in the territory of several states, or connected with the crime able to do harm to the interests of several states which are commited by person against the citizen of any state in the territory of the state to which it belongs, or other state in case the terrorist and person who underwent to terrorism are citizens of one or different states, outside the territory of this state;

terrorism financing - intentional collection or transfer by direct and indirect way of all or parts of money or other property irrespective of source of its obtaining, knowing that they will be used for financing of preparation, the organization or committing by person or group (gang, the organization) of the acts provided by Articles 219-1, 219-2, 226, of 227, 227-1, 270-1, 277, of 278, of 279, 280,of 282 and 283-1 Criminal code of the Azerbaijan Republic or for providing the terrorist or terrorist group (gangs, the organizations);

money or other property - the any kinds of material and non-material property, personal or real estate, and also the legal documents or statements which are drawn up in electronic or any other form and confirming the rights to these assets including bank loans, travel checks, bank checks, mailings, letters of credit, and also shares, bonds, bills of exchange and other securities, irrespective of methods of their obtaining.

Article 2. Legislation on fight against terrorism

The legislation on fight against terrorism consists of the Constitution of the Azerbaijan Republic, interstate agreements supported by the Azerbaijan Republic, this Law and other legal acts of the Azerbaijan Republic.

Article 3. Purpose of fight against terrorism

Terrorism in the Azerbaijan Republic is fought in the following purposes:

1) providing human rights and freedoms, safety of society and state;

2) the identification expected prevention of terrorism and bringing to minimum as a result of terrorism of damage;

3) identifications and liquidations of the reasons and conditions of creation and implementation of terrorism, and also financing of terrorism and rendering other help.

Article 4. Basic principles of fight against terrorism

Fight against terrorism in the Azerbaijan Republic is based on the following principles:

1) law enforcement;

2) inevitability of punishment, stipulated by the legislation the Azerbaijan Republic for implementation of terrorist activities;

3) coordination of the open and hidden methods in fight against terrorism;

4) complex use of legal, political, social and economic and organizational and preventive measures;

5) benefit of protection of the rights of persons endangered as a result of terrorist activities;

6) independence in management of forces involved in the operations performed against terrorism;
