About state regulation of the prices of separate types of socially important goods

According to articles 5 and 6 of the Law of the Kyrgyz Republic "About food security of the Kyrgyz Republic" and part 5 of article 11 of the Law of the Kyrgyz Republic "About domestic trade in the Kyrgyz Republic", for the purpose of control of growth rates of the prices of socially important goods, ensuring economic product availability of food for socially vulnerable segments of the population, the Government of the Kyrgyz Republic decides:

1. Approve enclosed:

- The list of socially important goods on which temporary state regulation of the prices in the domestic market of the Kyrgyz Republic can be entered (further - the List);

- Procedure for state regulation of the prices of socially important goods.

2. Ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 20.11.2015 No. 789

3. Ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 14.08.2012 No. 561

4. To the Ministry of Agriculture, food industry and melioration of the Kyrgyz Republic:

- perform permanent monitoring of selling prices on main types of socially important goods;

- to weekly provide the relevant information in the Ministry of Economics of the Kyrgyz Republic.

4-1. To plenipotentiaries of the Government of the Kyrgyz Republic in areas, local public administrations and city halls of the cities of Bishkek and Osh:

- paragraph two of Item 4-1 ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 20.11.2015 No. 789

- monitor situation in the markets on realization of the main socially important goods, including on the basis of data of the city halls of the cities of regional value and ayyl to okmot;

- in case of increase in prices for socially important goods for 20 and more percent within a month to make offers on control of the prices of these goods in the Ministry of Economics of the Kyrgyz Republic.

4-2. Recommend to the city halls of the cities of Bishkek and Osh, executive bodies of other cities and ayylny aimags:

- organize fairs selling the main socially important goods producers and suppliers, with creation of conditions for their carrying out;

- carry out explanatory work among the population and entrepreneurs concerning control of the prices of the main socially important goods.

5. To impose control of observance of the Procedure for state regulation of the prices of socially important goods on Public service on fight against economic crimes under the Government of the Kyrgyz Republic (financial police), the State Tax Administration under the Government of the Kyrgyz Republic, the State agency of anti-monopoly regulation under the Government of the Kyrgyz Republic.

6. To the Ministry of Economics of the Kyrgyz Republic by results of monitoring, analyses, the offers made by plenipotentiaries of the Government of the Kyrgyz Republic in areas, local public administrations and local government bodies of the inspections which are carried out by the relevant authorized state bodies to make offers:

in the Government of the Kyrgyz Republic - about introduction or the termination of state regulation of the prices of separate types of the goods included in the List if increase in prices constitutes 20 and more percent within a month;

in Council for food security of the Kyrgyz Republic - about introduction or the termination of state regulation of the prices of the food products included in the List in case of crisis threat.

7. The procedure for state regulation of the prices of socially important goods is applied from the date of acceptance by the Government of the Kyrgyz Republic of the decision on introduction of state regulation of the prices.

8. Publish this resolution in mass media.

9. To impose control over the implementation of this resolution on department of economy and investments and department of the industry, fuel and energy complex and subsurface use of Government office of the Kyrgyz Republic.

Procedure for state regulation of the prices of socially important goods

1. General provisions

1. This Procedure determines procedure for state regulation of the prices of socially important goods (further - goods) which list affirms the Government of the Kyrgyz Republic.

2. Depending on specifics of goods one of the following methods of regulation by establishment is applied:

paragraph two of ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 03.04.2020 No. 193

- maximum prices;

- the maximum or minimum allowances to the prices.

3. In this Procedure the following terms and determinations are used:

- the importer - the business entity or the individual entrepreneur acquiring socially important goods abroad and importing them on the territory of the Kyrgyz Republic for the subsequent realization;

- calculation - the commodity unit cost reflecting expenditure items, necessary for its production and realization and expected profit for determination of economically reasonable prices;

- the maximum level of wholesale selling price on goods - the largest size of wholesale selling price on goods;
