Based on Item 3 of article 42 of the Law of the Republic of Belarus of June 18, 2019 "About radiation safety" the Council of Ministers of the Republic of Belarus DECIDES: No. 198-Z

1. Approve the enclosed Regulations on order of interaction of republican state bodies, other state bodies (organizations) in case of detection of sources of ionizing radiation which owners are not established, and also in case of detention of sources of ionizing radiation when importing to the Republic of Belarus and (or) export from the Republic of Belarus.

2. To republican state bodies to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

3. This resolution becomes effective since May 15, 2009.

Regulations on order of interaction of republican state bodies, other state bodies (organizations) in case of detection of sources of ionizing radiation which owners are not established, and also in case of detention of sources of ionizing radiation when importing to the Republic of Belarus and (or) export from the Republic of Belarus

Chapter 1. General provisions

1. This Provision determines the purposes, tasks and order of interaction of republican state bodies, other state bodies (organizations) in case of detection of sources of ionizing radiation which owners are not established, and also in case of detention of sources of ionizing radiation when importing to the Republic of Belarus and (or) export from the Republic of Belarus (further – Frontier).

2. Republican state bodies, other state bodies (organizations) in case of detection of sources of ionizing radiation which owners are not established and also in case of detention of sources of ionizing radiation when importing to the Republic of Belarus and (or) export from the Republic of Belarus are guided by this Provision and the regulatory legal acts adopted according to this Provision and approved with the Ministry of Emergency Situations (further – the Ministry of Emergency Situations) and the Ministry of Health.

3. For the purposes of this provision the following terms and determinations are applied:

the safety area – space around source of ionizing radiation with power level of dose less than 1 μSv/h;

the source of ionizing radiation which owner is not established – the source of ionizing radiation or goods containing such source which does not have the owner (the owner, the user) or the owner (the owner, the user) of which is not established or to which the owner (the owner, the user) refused the rights;

primary radiation control – actions for identification of goods, vehicles and persons with the raised radiation background by means of stationary (mobile) means of radiation control, and also figurative dosimeters and dosimeters radiometers;

additional radiation control – the actions confirming the facts of availability of source of ionizing radiation elicited in case of primary radiation control, specifying location of source in goods (vehicles), determining the safety area and isotope structure (if technically possible);

complete radiation inspection – the actions allowing to determine type, isotope structure, activity, category (for nuclear material), degree of danger and other parameters of source of ionizing radiation;

the raised radiation background – the radiation dose exceeding the natural radiation background characteristic of this area;

radiological emergency situation – emergency situation with source of ionizing radiation which can bring or led to radiation of people and (or) radioactive environmental pollution over the established regulations;

vehicles – water vessel, the aircraft, the automotive vehicle, trail car, semitrailer truck, the rail vehicle or container.

Chapter 2. Purposes and tasks of interaction of republican state bodies, other state bodies (organizations)

The purposes of interaction of republican state bodies, other state bodies (organizations) in case of detection of sources of ionizing radiation which owners are not established and also in case of detention of sources of ionizing radiation when importing to the Republic of Belarus and (or) export from the Republic of Belarus are decrease in probability of causing damage these sources to human health and the environment, prevention of emergence of radiological emergency situations, increase in efficiency of response of law enforcement and other state bodies to crimes and incidents in the field of ensuring radiation safety of the population.

5. Tasks of interaction of republican state bodies, other state bodies (organizations) in case of detection of sources of ionizing radiation which owners are not established and also in case of detention of sources of ionizing radiation when importing to the Republic of Belarus and (or) export from the Republic of Belarus are:

5.1. ensuring efficiency and coordination of actions for achievement of necessary level of organization of events for decrease in danger of the found (detained) sources, including goods with the increased content of natural radionuclides in case of excess of capacity of dose of gamma radiation on 1 μSv/h and more over background at m 0,1 distance, and to establishment of control over them;

5.2. implementation of operational exchange of information, including with the international organizations, for acceptance of adequate measures of counteraction to illicit trafficking in nuclear and radioactive materials;

5.3. increase in efficiency of use of forces, means and material resources, and also knowledge and experience of specialists;

5.4. rendering assistance in carrying out legal proceedings on the materials and criminal cases connected with detection (detention) of sources of ionizing radiation, illicit trafficking in nuclear and radioactive materials and also ensuring radiation safety of participants of criminal procedure.

Chapter 3. Actions, carried out by republican state bodies, other state bodies and the organizations

6. In case of detection of sources of ionizing radiation, and also in cases of their detention when importing to the Republic of Belarus and (or) export from the Republic of Belarus accomplishment of the following events by republican state bodies, other state bodies and organizations (the subordinate organizations, bodies and divisions) is provided:

6.1. MINISTRY OF EMERGENCY SITUATIONS:

6.1.1. participation in management and work on liquidation of radiological emergency situation;
