About measures for enhancement of activities of the Ministry of Finance of the Azerbaijan Republic

For the purpose of ensuring the state control and regulation in spheres of management of means of the government budget and public debt, the State Treasury, state financial, assay, the organization and conducting financial accounting in the Azerbaijan Republic according to modern requirements and enhancements of work of the Ministry of Finance of the Azerbaijan Republic I decide:

1. Create national debt management Agency, Service of the state financial control of the Ministry of Finance of the Azerbaijan Republic.

2. Based on the Main State Treasury under the Ministry of Finance of the Azerbaijan Republic to create the Agency of the State Treasury of the Ministry of Finance of the Azerbaijan Republic.

3. Based on the State assay chamber under the Ministry of Finance of the Azerbaijan Republic to create Public service of control over precious metals and gemstones of the Ministry of Finance of the Azerbaijan Republic.

4. Approve "Structure of the Ministry of Finance of the Azerbaijan Republic".

5. Approve "Provision on the Ministry of Finance of the Azerbaijan Republic".

6. Approve "Provision on the Agency of the State Treasury of the Ministry of Finance of the Azerbaijan Republic".

7. No. 842 is cancelled according to the Presidential decree of the Azerbaijan Republic of 16.10.2019

8. Approve "Provision on Service of the state financial control of the Ministry of Finance of the Azerbaijan Republic".

9. It is cancelled.

10. Approve "Regulations on Public service on control over precious metals and gemstones of the Ministry of Finance of the Azerbaijan Republic".

11. Charge to the Cabinet of Ministers of the Azerbaijan Republic in a month:

11.1. establish the general numerical list of employees of the Ministry of Finance of the Azerbaijan Republic and resolve the issues connected with financial provision of the divisions entering into structure of the ministry;

11.2. prepare and provide to the President of the Azerbaijan Republic offers on reduction of the existing legal acts to compliance with this Decree;

11.3. provide reduction of regulatory legal acts of the Cabinet of Ministers of the Azerbaijan Republic and relevant organs of the executive authority in compliance with this Decree and inform on it the President of the Azerbaijan Republic;

11.4. resolve other issues following from this Decree.

12. The presidential decree of the Azerbaijan Republic of February 4, 2000 No. 271 "About approval of the Regulations on the Ministry of Finance of the Azerbaijan Republic" (except for Item 3) and Item 3 of the Presidential decree of the Azerbaijan Republic of October 4, 1995 "About creation of the State Treasury in the Azerbaijan Republic" to consider No. 398 invalid.

13. This Decree becomes effective from the date of its publication.

Regulations on the Ministry of Finance of the Azerbaijan Republic

I. General provisions

1. The Ministry of Finance of the Azerbaijan Republic (further - the Ministry) - the central executive body developing and performing financial policy of the Azerbaijan Republic, organizing management of public finances, preparing drafts of the state and summary budgets and providing cash execution of the State Budget, providing state regulation in spheres of national debt management and financial liabilities, the organization and conducting financial accounting, implementation of the state control in spheres of use of means of the government budget, production, processing and turnover of precious metals and gemstones.

2. In the activities the Ministry is guided by the Constitution of the Azerbaijan Republic, the laws of the Azerbaijan Republic, decrees and orders of the President of the Azerbaijan Republic, resolutions and orders of the Cabinet of Ministers of the Azerbaijan Republic, international treaties in as which party the Azerbaijan Republic, and this Provision acts.

3. In case of accomplishment of the obligations and implementation of the rights the Ministry performs activities, interacting with other executive bodies, municipalities of domicile and non-governmental organizations.

4. The ministry has the separate balance, state-owned property which is at its disposal according to the legislation, treasurer and bank accounts, seal with the image of the State Emblem of the Azerbaijan Republic and the name, the corresponding stamp and forms.

5. Maintenance costs of the Ministry and its activities are financed by the government budget of the Azerbaijan Republic and other stipulated by the legislation sources.

6. The ministry is in the city of Baku.

II. Activities of the Ministry

7. Activities of the Ministry:

7.1. develops state policy in the financial, budget, tax sphere of the Azerbaijan Republic and provides its implementation with the assistance of involved state bodies and other organizations;

7.2. provides preparation of drafts of the state and summary budgets according to the current legislation;

7.3. provides execution of the State Budget in the procedure established by the legislation, will organize implementation of the state financial control over expenditure to destination of the funds allocated from the government budget, and the credits obtained under the state guarantee;

7.4. it is cancelled;

7.5. in stipulated by the legislation procedure and cases will organize in the country the state assay supervision and the state supervision in the sphere of production, processing and turnover of precious metals and gemstones and provides their implementation;

7.6. will organize national debt management and financial liabilities and provision of the state guarantee, develops policy of state loan and provides its implementation;

7.7. develops state policy in the sphere of the organization and conducting financial accounting, including preparation and submission of financial statements by the legal entities, and also physical persons who are engaged in business activity without formation of legal entity acting in the territory of the Azerbaijan Republic and within the powers takes measures for its implementation;

7.8. develops state policy in the sphere of auditor activities in the Azerbaijan Republic and represents offers in connection with its implementation;

7.9. in the procedure established by the legislation participates in creation of the state investing programs, in preparation and implementation of concepts and strategies of development of the state investment policy, state programs;

7.10. provides implementation of necessary measures in the sphere of attraction of external and domestic credits in national economy;

7.11. performs normative legal regulation on other questions carried by the legislation and this Provision to activities of the Ministry in the sphere of the budget system, taxes, the state treasury, the state financial supervision, national debt management and financial liabilities, supervision of precious metals and gemstones, audit, the organization and conducting financial accounting

7.12. prepares offers concerning forecasting of macroeconomic indicators in the Azerbaijan Republic, state regulation of economy, the directions of its development;

7.13. will approve activities industry central and local executive bodies on activities of the Ministry

7.14. performs activities in other directions established by the legislation.

III. Obligations of the Ministry

8. According to the activities established by this Provision the Ministry carries out the following obligations:
