1. Approve the enclosed Regulations on registration (re-registration) on the Belarusian republican unitary insurance enterprise Belgosstrakh of insurers on compulsory insurance from labor accidents and occupational diseases.

2. To legal entities and physical persons till January 1, 2004 to be registered on the Belarusian republican unitary insurance enterprise Belgosstrakh as insurers on compulsory insurance from labor accidents and occupational diseases according to the procedure established by this resolution.

3. This resolution becomes effective from the date of its official publication.

Regulations on registration (re-registration) on the Belarusian republican unitary insurance enterprise Belgosstrakh of insurers on compulsory insurance from labor accidents and occupational diseases

1. This Provision determines order of registration as insurers by compulsory insurance from labor accidents and occupational diseases on the Belarusian republican unitary insurance enterprise Belgosstrakh which is the insurer (further – the insurer), the organizations (including foreign), their separate divisions, physical persons and their removal from registration accounting.

2. Registration on compulsory insurance from labor accidents and occupational diseases (further – registration) at the insurer are subject:

legal entities (including foreign), except for the legal entities specified in parts two and third this Item and the individual entrepreneurs performing activities in the territory of the Republic of Belarus;

the separate divisions of legal entities performing activities in the territory of the Republic of Belarus and given the right to payment of insurance premiums on compulsory insurance from labor accidents and occupational diseases;

the physical persons who are not individual entrepreneurs, signed employment and (or) civil contracts with the physical persons which are subject to compulsory insurance from labor accidents and occupational diseases.

Legal entities, newly created as a result of reorganization in the form of transformation, are not subject to registration, and behind them registration number of the reorganized legal entity remains.

Legal entities are not subject to registration if activities of the physical persons working for them are provided by other legal entities who are subject to registration as the insurer.

3. Registration is performed by separate divisions of the insurer.

4. As insurers are registered:

legal entities - in the place of their state registration;

separate divisions of legal entities - in the place of their stay;

individual entrepreneurs, and also the physical persons who are not individual entrepreneurs - in the place of their residence.

5. Registration of the legal entities and individual entrepreneurs undergoing state registration according to the Decree of the President of the Republic of Belarus of January 16, 2009 No. 1 "About state registration and liquidation (the activities termination) of subjects of managing" (The national register of legal acts of the Republic of Belarus, 2009, No. 17, 1/10418), is performed based on the information card of the legal entity or the individual entrepreneur received in accordance with the established procedure by the insurer from registering body.

The legal entities specified in Item 3 of the Regulations on state registration of subjects of the managing approved by the Decree of the President of the Republic of Belarus of January 16, 2009 No. 1, not registered at the insurer in case of their state registration, shall be registered at the insurer from the date of receipt of the document on state registration in a month.

At the insurer shall be registered:

state bodies, local executive and administrative organs – in a month from the date of entry into force of the regulatory legal act determining their legal status;

separate divisions of legal entities, except for representative offices of the foreign organizations in the Republic of Belarus, – in a month from the date of investment of separate division of the legal entity with the right to payment of insurance premiums;

representative offices of the foreign organizations in the Republic of Belarus – in a month from the date of obtaining in regional executive committee (The Minsk Gorispolkom) of permission to the opening;

the individual entrepreneurs who were not registered at the insurer in case of state registration and also the physical persons who are not individual entrepreneurs – within a month from the date of the conclusion of the first employment and (or) civil contract with the physical person which is subject to compulsory insurance from labor accidents and occupational diseases.

6. Registration as insurers of the physical persons who are not individual entrepreneurs is performed on effective period of the employment and (or) civil contracts signed by them with the physical persons which are subject to compulsory insurance from labor accidents and occupational diseases.

In cases of prolongation of effective period of employment and (or) civil contracts before the termination of term of their action or the conclusion of new agreements and submission of copies of the relevant agreements by the insurer in time, provided in paragraph five of Item 16 of this provision, repeated registration of physical person is not made, and the term of registration is prolonged before the termination of effective period of the specified agreements.

7. The legal entities specified in part two and the paragraph the second to part three of Item 5 of this provision for registration submit in separate division of the insurer the application in the form established by the Ministry of Finance.

Copies of the document confirming state registration of the charter (foundation agreement) are requested by the insurer in state bodies, local executive and administrative organs, and also can be provided by the legal entities specified in part two and the paragraph the second to part three of Item 5 of this provision, at will independently.
