About measures for implementation of the Presidential decree of the Republic of Belarus of June 30, 2008 No. 359

For the purpose of implementation of the Presidential decree of the Republic of Belarus of June 30, 2008 No. 359 "About some questions of provision of guarantees for the Government of the Republic of Belarus on the credits issued by banks of the Republic of Belarus" Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Regulations on procedure for filling of the form of guarantee of the Government of the Republic of Belarus.

2. Determine formu:zayavleniye about provision of a guarantee for the Government of the Republic of Belarus according to appendix 1;

guarantees of the Government of the Republic of Belarus according to appendix 2.

3. Determine that:

3.1. banks represent to the Ministry of Finance to the 10th day of the next month of the data on the amounts of the means in month collected according to Item 12 of the Regulations on procedure for provision of guarantees for the Government of the Republic of Belarus on the credits issued by banks of the Republic of Belarus, No. 359 approved by the Presidential decree of the Republic of Belarus of June 30, 2008 (The national register of legal acts of the Republic of Belarus, 2008, No. 160, 1/9845), in the form established by the Ministry of Finance;

3.2. guarantees of the Government of the Republic of Belarus on the credits issued by banks of the Republic of Belarus:

drawn up before entry into force of this resolution, are not subject to renewal in the form determined by this resolution;

are subject to return to the Ministry of Finance to 10-day term from the date of decision making about their response.

4. Bring in the Regulations on the Unified State Register of Legal Entities and the individual entrepreneurs who got the state support approved by the resolution of Council of Ministers of the Republic of Belarus of July 30, 2004 No. 930 (The national register of legal acts of the Republic of Belarus, 2004, No. 122, 5/14626; 2006, No. 129, 5/22698), following changes:

4.1. in subitem 4.1 of item 4:

to exclude the paragraph of the seventh;

the eighth or thirteenth to consider paragraphs respectively paragraphs the seventh or twelfth;

4.2. in Item 6:

the fifth to exclude the paragraph;

to consider the paragraph of the sixth the paragraph the fifth.

6. This resolution becomes effective since October 6, 2008, except for subitem 3.1 of Item 3, becoming effective since January 1, 2009.

Regulations on procedure for filling of the form of guarantee of the Government of the Republic of Belarus

1. The form of guarantee of the Government of the Republic of Belarus (further the form of guarantee) is the form of the document with certain degree of protection and is made on sample, single for the Republic of Belarus.

Account of forms of guarantees is kept in the Ministry of Finance according to the legislation.

2. The form of guarantee is provided with necessary means and elements of protection and contains number and series put in case of its production in the lower part of the face of leaf of the form of guarantee.

3. When filling the text of guarantee of the Government of the Republic of Belarus on the credits issued by banks of the Republic of Belarus (daleegarantiya) it can be used one or two leaves of the form of guarantee.

The text of guarantee is filled in on the face of the first and second leaf of the form of guarantee with computer method.

4. In detail "No." the warranty number consisting of the number corresponding to number of the resolution of Council of Ministers of the Republic of Belarus on provision of this guarantee, and registration warranty number, assigned by the Ministry of Finance is specified.

When filling the text of guarantee on one leaf of the form of guarantee after the text of guarantee on this leaf the signature of the Minister of Finance is appended (in its absence - person, the acting minister of finance, or other Deputy Minister of Finance authorized in accordance with the established procedure) and sealed official the Ministries of Finance. The back of leaf of the form of guarantee has no background grid and remains blank.

6. When filling the text of guarantee on two sheets of the form of guarantee the text of guarantee is filled in on the face of the first and second leaf. Under the text of guarantee on the second leaf the signature of the Minister of Finance is appended (in its absence - person, the acting minister of finance, or other Deputy Minister of Finance authorized in accordance with the established procedure), sealed official the Ministries of Finance and the sheet is numbered by figure "2" in the right bottom corner in the allocated square field. On the back is the second leaf having background grid, the number of sheets, their numbers, and also number and series of the first and second leaf is specified. The text of the back of the second leaf is certified by the authorized signature of the Ministry of Finance sealed corresponding this Ministry.

7. Date of issue of guarantee corresponds to date of its signing.

The guarantee is drawn up in duplicate in the Russian (Belarusian) language at one number.

8. Write-off and destruction of the withdrawn forms of guarantee is made according to the legislation.
