About the state guarantees and compensations for the persons living and working in the conditions of highlands and the remote remote zones

This Law establishes the state guarantees and compensations on compensation of additional material and physiological costs to citizens in connection with accommodation and work in extreme climatic conditions of highlands and the remote remote zones.

SECTION I. GENERAL PROVISIONS

Article 1. Operation of this Law

Operation of this Law extends to persons living in conditions of highlands and the remote remote zones and persons working at the companies in organizations, the organizations located in the specified conditions.

In the cases provided by this Law, the state guarantees and compensations are provided to the unemployed pensioners, military personnel dismissed on age or in connection with reducing Armed Forces of the Kyrgyz Republic, to pupils of initial professional and average professional educational institutions and comprehensive schools, and also the members of families who arrived to the settlements located in the conditions of highlands and the remote remote zones together with the supporter.

Article 2. Procedure for determination of the list of the settlements located in the conditions of highlands and the remote remote zones

The list of the settlements located in the conditions of highlands and the remote remote zones affirms General Court the Government of the Kyrgyz Republic in coordination with Jogorku Kenesh.

Article 2-1. Criteria of reference of settlements to mountain and remote zones

For the persons living and working in the conditions of highlands and remote zones of the Kyrgyz Republic to establish the following criteria and the sizes of coefficients of surcharges to the salary and other social payments:

Article 3. The legislation of the Kyrgyz Republic on the state guarantees and compensations for the persons living and working in the conditions of highlands and the remote remote zones

The state guarantees and compensations for the persons living and working in the conditions of highlands and the remote remote zones are established by this Law and other corresponding legal acts of the Kyrgyz Republic.

Additional guarantees and compensations can be provided at the expense of means of budgets of the administrative-territorial educations located in the conditions of highlands, means of the companies, organizations, the organizations (employers).

Article 4. Sources and procedure for financing of costs for the state guarantees and compensations

Source of financing of costs for the state guarantees and compensations provided by this Law is the republican budget of the Kyrgyz Republic.

The procedure for cost recovery on the state guarantees and compensations from the republican budget of the Kyrgyz Republic affirms the Government of the Kyrgyz Republic, and from budgets of areas and areas - relevant organs of these educations.

SECTION II. REGULATION OF EMPLOYMENT RELATIONSHIPS. COMPENSATION

Article 6. The state guarantees in the field of employment of the population

To the persons released from the companies from organizations, the organizations located in the conditions of highlands and the remote remote zones in connection with their reorganization or liquidation, not over four months the average salary taking into account dismissal wage remain for their employment, but.

Dismissal wage payment and the kept average salary is made still to place of employment.

Article 7. Compensation

Compensation of employees of the companies, organizations, the organizations located in the conditions of highlands and the remote remote zones is performed according to the procedure, established by the legislation of the Kyrgyz Republic. Payment of district coefficient to the salary and the percentage allowance to official pay rate is guaranteed to workers.

Article 8. Indexation of cash incomes

Article 9. Compensations to jobless citizens

To the persons who are constantly living in conditions of highlands and the remote remote zones and recognized in accordance with the established procedure as the unemployed, unemployment benefits are paid taking into account district coefficient.

To persons who lost work and earnings (labor earnings) and are registered in public service of employment of the population as persons who are looking for work, during professional training, advanced training or retraining in the direction of public service of employment of the population the grant is paid taking into account district coefficient.

Article 10. District coefficient to the salary

District coefficient to the salary and procedure for its payment to persons working in the conditions of highlands and the remote remote zones are established by the Government of the Kyrgyz Republic.

To persons working in the conditions of highlands and the remote remote zones the district coefficient, single for all production and non-productive industries, to the salary is established.

The district coefficient is charged on all payment types of work on which insurance premiums, without restriction of its maximum size are assessed.

Payment of district coefficient to the salary is considered in all cases of calculation of the average salary.
