For the purpose of implementation of the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Technical regulation "Requirements to Safety of the Drinking Water Which Is Packed Up in Reservoir".

2. This resolution becomes effective after six months from the date of the first official publication.

Technical regulation "Requirements to Safety of the Drinking Water Which Is Packed Up in Reservoir"

1. Scope

1. This technical regulation "Requirements to Safety of the Drinking Water Which Is Packed Up in Reservoir" (further - the Technical regulation) is developed according to the Code of the Republic of Kazakhstan of September 18, 2009 «About health of the people and health care system» and the Law of the Republic of Kazakhstan of November 9, 2004 "About technical regulation" and establishes requirements to safety of the drinking water which is packed up in reservoir and to processes of its lifecycle.

2. Requirements of the Technical regulation extend to the drinking waters which are packed up in the reservoirs made and realized in the territory of the Republic of Kazakhstan:

1) natural mineral waters;

2) spring waters;

3) waters of the established place of origin;

4) table waters;

5) the purified waters.

3. Requirements of this Technical regulation extend to the drinking waters imported on the territory of the Republic of Kazakhstan:

1) natural mineral waters;

2) spring waters;

3) got on fields of underground waters and packed up in the reservoirs in the territory of the third countries and recognized as the state system of technical regulation of the Republic of Kazakhstan according to the legislation of the Republic of Kazakhstan on technical regulation.

4. Products types falling under action of this Technical regulation and their codes correspond to line item of 2201 classifications of goods of the single Commodity nomenclature of foreign economic activity of the Customs union.

5. The technical regulation does not extend to the following waters:

1) drinking natural mineral medical and medical and table;

2) natural mineral, used as medical in thermal or hydromineral balnearies;

3) processed by power information and/or other physical methods and technologies, and having therapeutic properties;

4) distilled;

5) belonging to soft drinks, prepared using nutritional supplements, including juice, infusions, essences, fragrances, dyes, sugar, substitutes of sugar, sweeteners, preservatives.

6. The analysis of the potential risks connected with safety of drinking water on objects is carried out at all stages of lifecycle, beginning from water source and to the final consumer.

The producer periodically considers the analysis results of risks connected with safety of drinking water, critical control points, procedures of check and regulation, monitoring is carried out them.

The producer identifies points in which there can be risks connected with safety of the drinking water which is packed up in reservoir and procedures of check and regulation in critical points are carried out.

The risks connected with microbiological and chemical pollution of water shall be based on the technique allowing to estimate risk degree. The methods used for the analysis of the drinking water which is packed up in reservoir shall provide reliable and comparable results.

7. In case of risk assessment of safety of the drinking water which is packed up in reservoir the available scientific data, the corresponding methods of processing and production (production), methods of inspection, selective control, laboratory researches this about degree of prevalence of specific diseases and availability of free zones from diseases shall be used.
