Procedure for selection and realization of inspection lots of natural diamonds

I. General provisions

1. This Procedure for selection and realization of inspection lots of the rough natural diamonds (further - inspection lots) is developed according to the Presidential decree of the Russian Federation of September 20, 2010 N 1137 "About approval of the Regulations on import to the Russian Federation from the countries which are not entering into the Customs union within EurAsEC and export from the Russian Federation to these countries of the precious metals, gemstones and primary goods containing precious metals" (The Russian newspaper, 2010, on September 23) for the purpose of check of the prices of the main batches exported by subjects of production of natural diamonds.

2. Inspection lots are created of the array of diamonds intended for export by subjects of production of natural diamonds (further - export array). The main batch is the remaining balance of export array, after allocation from it inspection lot.

Selection of inspection lots is not made when exporting natural diamonds:

- the mass of 10,80 of carat and more, the natural diamonds having the "board" and "drilling" form irrespective of their sizes and extent of processing, and also diamonds of sitovy classes "-3+2" and below, including diamond concentrate, diamond crumb and diamond powders;

- recuperated from the multichip diamond tool and waste from any kind of processing of diamonds;

- the subjects of production and the natural diamonds realized by subjects of production which are property under contracts with the federal state unitary enterprise "Almazyuvelireksport foreign trade organization (further - Federal State Unitary Enterprise In/about Almazyuvelireksport).

Realization of the main batches of the natural diamonds realized by subjects of production under contracts with Federal State Unitary Enterprise In/about Almazyuvelireksport is performed on competitive basis, at the same time the number of competitive offers on purchase of batch shall be at least three.

3. The realization of inspection lots is enabled by Federal State Unitary Enterprise In/about Almazyuvelireksport with participation of the state controllers of the Ministry of Finance of the Russian Federation in the cases established by this Procedure.

II. Selection, assessment and transfer to the seller of inspection lots

4. Selection of inspection lots is performed by the subject of production with the assistance of the state controllers of the Ministry of Finance of the Russian Federation from each array of the rough natural diamonds (except for the diamond raw materials specified in paragraphs three - the fifth Item 2 presents of the Procedure) intended to them for export.

The amount, assortment structure and frequency of preparation of export arrays are determined by the subject of production.

5. The export array shall consist of the natural diamonds which underwent sorting, primary classification and primary assessment. The diamonds sorted, certified for test and also the diamonds completed to indivisible boxes can be part of export array.

For the purposes of this Procedure as indivisible boxes are understood last sorting, assessment and picking of batch of diamond raw materials having the assortment of the same name established in the nomenclature and technical requirements of subjects of production of natural diamonds, and considered by subjects of production of natural diamonds as finished goods.

6. Inspection lots shall be representative in relation to assortment structure of the corresponding main export arrays.

7. The size of inspection lot shall constitute at least 5 percent on weight from each export array.

For subjects of production of natural diamonds which amounts of production make less than 2 million carat a year the weight of inspection lot is determined proceeding from the following regulations of selection from export array of natural diamonds:

8. If the export array includes indivisible boxes, then from among the boxes of the same name for forming of inspection lot separate boxes in the following proportions shall be allocated:

in case of the number of boxes from 2 to 20 one boxing is allocated;

in case of the number of boxes from 21 to 40 two boxing are allocated;

in case of the number of boxes from 41 to 60 three boxing and so on in the same proportion are allocated.
