About the automated information system "Interaction"

The Council of Ministers of the Republic of Belarus DECIDES:

1. It is excluded

2. Approve the enclosed Regulations on the automated information system "Interaction".

3. To the Ministry of Justice till January 1, 2008:

3.1. put the automated information system "Interaction" into operation;

3.2. equip workplaces of participants of the automated information system "Interaction" with the necessary software, devices of reading smart cards for work in the called system and to perform other necessary procedures for its commissioning.

4. To the Ministry of Taxes and Tax Collection, the Ministry of Finance, National Statistical Committee, the Ministry of Labour and Social Protection, Social Security Fund of the population of the Ministry of Labour and Social Protection, National Bank, the Belarusian republican unitary insurance enterprise Belgosstrakh, regional (To the Minsk city) to provide to executive committees, administrations of free economic zones:

till December 31, 2007 workplaces the equipment with access to the automated information system "Interaction" through IP-VPN channels;

since January 1, 2008 exchange of documents (information) with registering bodies in electronic form within the automated information system "Interaction".

5. To the Ministry of Justice, the Ministry of Economics, the Ministry of Finance, the Ministry of Communications and Informatization, the State committee on science and technologies and National Bank in accordance with the established procedure to introduce to the Government of the Republic of Belarus the draft "Development and deployment of second priority of the unified automated information system allowing registering bodies to interact according to regulations with use of the automated systems of other republican state bodies for the purpose of realization of the principle "one window" for its inclusion in structure of the list of the projects which are carried out according to the State program of informatization of the Republic of Belarus for 2003-2005 and on prospect till 2010 "Electronic Belarus", the Republic of Belarus approved by the resolution of Council of Ministers of December 27, 2002 No. 1819 (The national register of legal acts of the Republic of Belarus, 2003, No. 3, 5/11734).

6. To the Ministry of Justice, the Ministry of Taxes and Tax Collection, the Ministry of Finance, National Statistical Committee, the Ministry of Labour and Social Protection, Social Security Fund of the population of the Ministry of Labour and Social Protection, National Bank, the Belarusian republican unitary insurance enterprise Belgosstrakh, administrations of free economic zones since 2008 to perform financing of maintenance and fee on data transmission, connected with ensuring functioning of the automated Interaction system, at the expense of the means provided in accordance with the established procedure on content of relevant organs and organizations.

7. To local executive and administrative organs when forming budget statements of the corresponding administrative and territorial units for the next financial (budget) year to provide assignment for maintenance and fee on data transmission, connected with ensuring functioning of the automated information system "Interaction".

8. To the Ministry of Justice, the Ministry of Taxes and Tax Collection, the Ministry of Finance, the Ministry of statistics and analysis, the Ministry of Labour and Social Protection to bring the regulatory legal acts into accord with this resolution.

9. This resolution becomes effective since January 1, 2008, except for items 4 and 5, becoming effective from the date of official publication of this resolution.

Regulations on the automated information system "Interaction"

1. This Provision determines procedure for ensuring operational information data exchange in case of registration of legal entities and individual entrepreneurs, liquidation of legal entities (the termination of activities of individual entrepreneurs), and also when opening to legal entities and individual entrepreneurs of accounts in banks, the non-bank credit and financial organizations with use of the automated information system "Interaction" (further AIS "Interaction") and its maintenance.

2. For the purposes of this provision terms and their determinations in the values established in the Law of the Republic of Belarus of December 28, 2009 "About the electronic document and the digital signature" are used (The national register of legal acts of the Republic of Belarus, 2010, No. 15, 2/1665), and also the following terms and determinations:

the information card - the electronic document containing the information about the legal entity or the individual entrepreneur;

the electronic statement - the electronic document containing the information about the legal entity (individual entrepreneur), sent by registering body to bank, the non-bank credit and financial organization for opening of the current (settlement) bank account. The form of the electronic statement affirms the Ministry of Justice;

electronic bank inquiry - the electronic document of bank, non-bank credit and financial organization containing information on accounting number of the payer, the name of the legal entity, surname, own name, middle name (if that is available) the individual entrepreneur concerning which the request is constituted.

3. Information exchange log in:

3.1. authorized body - the state body (Ministry of Justice) responsible for the regulated implementation of information exchange between the organizations - participants of information exchange;

3.2. operator - the organization or structural division of state body performing functions of maintenance and system administration within information exchange between the organizations - participants of information exchange;

3.3. the organization - the participant of information exchange (registering bodies, tax authorities, bodies of the state statistics, bodies of Social Security Fund of the population of the Ministry of Labour and Social Protection, the Belarusian republican unitary insurance enterprise Belgosstrakh, customs authorities, territorial (city, district) archives of local executive and administrative organs, banks, the non-bank credit and financial organizations).

4. The organizations - participants of information exchange shall apply AIS "Interaction" one of the following methods:

by the regulated access to AIS "Interaction" of authorized employees of the organizations - participants of information exchange and manual handling of information cards (electronic requests of banks);

by the regulated access to AIS "Interaction" of authorized employees of the organizations - participants of information exchange and batch mode of processing of information cards (electronic requests of banks) using package files of the set format;
