About free economic zones in the territory of the Republic of Belarus

For the purpose of providing favorable conditions for economic development of regions of the Republic of Belarus, attraction of foreign investments, creation of new workplaces, accelerations of scientific and technical progress, development of trade and economic cooperation with other states I decide:

2. Create the free economic zone Brest (further - SEZ "Brest") for the term of 31 December of 2049.

SEZ "Brest" is complex zone.

Development financing of SEZ "Brest", including production, engineering, transport and other infrastructure, including content of administration of SEZ "Brest" and other stipulated by the legislation expenses for ensuring functioning of zone, is performed at the expense of means of the republican budget and fund of development of SEZ "Brest", other sources which are not prohibited by the legislation.

The specified fund is created at the expense of the rent for the parcels of land located in borders of SEZ "Brest" and provided in lease to its residents, receipts according to agreements on activities conditions in zone and also other receipts according to the legislation.

Specific sources of forming of this fund and the direction of expenditure of its means are determined by Council of Ministers of the Republic of Belarus.

3. To the government of the Republic of Belarus in two-month time:

3.1. approve:

regulations on SEZ "Brest" in which to specify: exact name of zone; features of its special legal regime; terms of functioning of zone; the purposes and tasks performed in it; list, structure and competence of governing bodies and control of zone; methods of their interaction with other state bodies and subjects of managing acting in SEZ;

regulations on Administration of SEZ "Brest";

3.2. together with the relevant local authorities of management and self-government operating in the territory of SEZ "Brest" to resolve issue of transfer to maintaining Administration of this zone of the objects which are in republican and utility property, according to the procedure, established by the legislation.

4. Suggest National Bank to found in case of need in SEZ "Brest" the departments and to resolve issue of licensing of the transactions with foreign currency performed by banks (departments of banks) located in its territory.

5. To the Ministry for State Property Management and privatization together with Administration of SEZ "Brest" in two-month time to approve the list of the objects which are in state-owned property, subjects of first-priority privatization in the territory of SEZ.

6. To the local executive and administrative organs operating in the territory of SEZ "Brest" to delegate the Administrations of SEZ of power provided by this Decree including the right to implementation of state registration of subjects of managing, to presentation of the action for declaration to court about suspension or the termination of activities of subjects of managing - residents of zone, and also activities of their representations in SEZ in case of violation of requirements of the legislation by them.

7. This Decree becomes effective from the date of its publication.
