Declare invalid the order of the Government of the Republic of Kazakhstan of January 23, 2004 No. 76 "About approval of Rules of subsidizing of cost of services in supply of drinking water from especially important group water supply systems which are the uncontested sources of drinking water supply which are in republican property" (SAPP of the Republic of Kazakhstan, 2004, No. 2, the Art. 40).

Rules of subsidizing of cost of services in supply of drinking water from especially important group and local water supply systems which are uncontested sources of drinking water supply

1. These rules determine procedure for subsidizing of cost of services in supply of drinking water from especially important group and local water supply systems which are uncontested sources of drinking water supply for the account and within the means provided by the law on the republican budget for the corresponding financial year.

2. In these rules the following concepts are used:

the water giver - the individual entrepreneur or the legal entity serving especially important group and local water supply systems on supply of drinking water and being the subject of natural monopoly on rendering services of water management systems;

the water user - physical person or legal entity which according to the procedure, established by the legislation of the Republic of Kazakhstan, is granted right to use of water resources for satisfaction of own needs and (or) commercial interests.

3. Subsidies intend for complete or partial cost recovery (reduction in cost of cost of services) to the water givers serving especially important group and local water supply systems on supply of drinking water, water users for satisfaction of own needs, except for uses of water resources in commercial interests.

4. The amounts of subsidies for each area (the city of republican value, the capital) affirm as the procedure established by the legislation of the Republic of Kazakhstan based on provided by the Ministry of regional development of the Republic of Kazakhstan (further - the administrator of the budget program) the amounts created according to offers of local executive bodies of areas (the city of republican value, the capital).

The size of the allocated subsidies for 1 (one) cubic meter of the pumped drinking water for water givers by the group water supply systems and local water supply systems which are uncontested sources of drinking water supply, approved by the Republican budget commission for the corresponding financial years is determined as difference between the rate for services in supply of drinking water approved by the authorized state body performing management in spheres of natural monopolies and in the controlled markets for the rendered services in supply of drinking water of guaranteed quality within the set limit behind minus:

1) 30 (thirty) tenges for 1 (one) cubic meter of the pumped drinking water to the water users having in the houses or apartments internal water supply equipped with individual metering devices of water;

2) 40 (forty) tenges for 1 (one) cubic meter of the pumped drinking water to the water users using the networks of water supply which are on borders of balance sheet accessory and equipped with single metering devices of water;

3) 0 (zero) tenge for 1 (one) cubic meter of the pumped water from especially important group and local water supply systems which are uncontested sources of drinking water supply, the requiring further cleaning and finishing it to condition of drinking water consumption.

6-1. The administrator of the budget program lists target current transfers to regional budgets and budgets of the cities of Astana, Almaty according to the subsidizing amounts approved in the procedure established by the legislation of the Republic of Kazakhstan on areas and the cities of Astana, Almaty based on the agreement on results on target transfers between akims of areas and cities of Astana, Almaty and the Minister of Regional Development of the Republic of Kazakhstan, the individual funding plan of the appropriate budget program on payments for the corresponding year approved in accordance with the established procedure.

7. The water giver for receipt of subsidies for services in supply of drinking water:

1) is represented to regional Energy division and housing and communal services (the city of republican value, the capital) by the list of water users approved with territorial authority of authorized body in the field of use and protection of water fund, water supply, water disposal and district departments of construction and housing and communal services (the cities of regional value) with which contracts on supply of drinking water on rate taking into account subsidizing are signed, with indication of amounts of the pumped drinking water, payment for the provided services and rate taking into account the subsidizing for services in supply of drinking water approved by the authorized body performing management in spheres of natural monopolies and in the controlled markets (further - the list of water users);
