ORDER OF THE GOVERNMENT OF THE RUSSIAN FEDERATION

of July 17, 2003 No. 442

About cross-border movement of waste

(as amended on 26-04-2022)

For the purpose of the implementation of the Federal Law "About Production Wastes and Consumption" and obligations of the Russian Federation following from the Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal, the Government of the Russian Federation decides:

1. Approve the enclosed Rules of cross-border movement of waste (further hereinafter are referred to as - Rules).

2. Determine that:

import to the territory of the Russian Federation of the waste specified in the appendix N 1 to Rules for the purpose of their use and export from the territory of the Russian Federation of the waste specified in appendices 1 and 2 to Rules are performed according to the license granted in accordance with the established procedure by the Ministry of Industry and Trade of the Russian Federation based on permission of Federal Nature Management Supervision Service and its territorial authorities to cross-border movement of waste;

transit of waste across the territory of the Russian Federation is performed in accordance with the legislation of the Russian Federation based on permission of Federal Nature Management Supervision Service.

3. Federal Service for Environmental, Technological and Nuclear Supervision:

develop and in coordination with the Ministry of Finance of the Russian Federation and the Ministry of Economic Development and Trade of the Russian Federation in 3-month time to approve in accordance with the established procedure rules of providing guarantees in case of cross-border movement of dangerous and (or) other wastes, stipulated in Item the 11th Article 6 of the Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal;

develop and in 3-month time to approve forms of the notification on cross-border movement of waste and the document on transportation of waste;

develop together with the Ministry of the Russian Federation for civil defense, to emergency situations and natural disaster response, by the Ministry of Transport of the Russian Federation, the Ministry of Railways of the Russian Federation, the Ministry of Health of the Russian Federation, the State Customs Committee of the Russian Federation and the Federal inspectorate for mining and industry of Russia and in 3-month time to approve regulatory legal act concerning control and supervision of cross-border movement of waste.

4. To the Federal Customs Service to submit annually within agreed time frame in Federal Nature Management Supervision Service and the Ministry of Industry and Trade of the Russian Federation aggregated data about import (export, transit) of waste to the territory (from the territory, on the territory) the Russian Federation for forming of the reporting sent to the secretariat of the Basel Convention on the Control of Trans-boundary Movement of Hazardous Wastes and their removal.

5. Declare invalid the order of the Government of the Russian Federation of July 1, 1996 N 766 "About state regulation and control of cross-border transportations of dangerous wastes" (The Russian Federation Code, 1996, N 28, Art. 3379; 2000, N 9, Art. 1036; 2001, N 50, Art. 4735).

6. This resolution becomes effective after 3 months from the date of its official publication.

These rules establish procedure for import of waste to the territory of the Russian Federation for the purpose of their ecologically safe use, export of waste from the territory of the Russian Federation, and also transit of waste across its territory (further hereinafter are referred to as - cross-border movement of waste).
