The protocol on exchange of the preliminary information on the goods and vehicles moved through customs borders of the State Parties of the Commonwealth of Independent States

The Customs Services of the State Parties of the Commonwealth of Independent States which further are referred to as with the Parties

based on the Agreement on cooperation and mutual assistance in customs affairs of April 15, 1994,

aiming to establish effective cooperation and coordination of activities of customs authorities of the State Parties of the Commonwealth of Independent States in ensuring customs control over the goods and vehicles moved through their customs borders

recognizing need of timely exchange of the preliminary information about the goods and vehicles moved through customs borders of the State Parties of the Commonwealth of Independent States for the purpose of prevention of violations of the customs legislation of the states of the Parties, and also enhancement and acceleration of customs clearance and customs control,

believing that efforts on prevention of violations of the customs legislation of the states of the Parties, and also on ensuring exact charge of customs duties, taxes and other payments levied during the importing or commodity exportation can become more effective thanks to cooperation of Customs Services of the State Parties of the Commonwealth of Independent States,

agreed as follows:

Article 1

The parties according to the legislation of the states of the Parties will organize exchange of the preliminary information about the goods and vehicles moved through customs borders of gosudarstvuchastnik of the Commonwealth of Independent States.

Action of the this Protocol extends to exchange of the preliminary information about the goods and vehicles which are drawn up in the customs relation by one of customs authorities of the states of the Parties and moved through customs borders of gosudarstvuchastnik of the Commonwealth of Independent States. At the same time the data received in case of customs clearance of the goods and vehicles which are exported from the territory of the state of one Party are subject to exchange if the destination (way of transit) is in the territory of the state of other Party, about goods and vehicles electronically before crossing of border by them.

Article 2

Exchange of the preliminary information about the goods and vehicles moved through customs borders of gosudarstvuchastnik of the Commonwealth of Independent States can be performed both between the Parties, and between the customs authorities which are directly exercising control at check points through customs borders of the State Parties of the Commonwealth of Independent States.

Article 3

The parties in process of readiness of the information systems for implementation of preliminary information exchange in real time, on bilateral basis approve Specifications on the organization of exchange of information between the states about the goods and vehicles moved through their customs areas with road, railway, water and air transport including:

- structure, structure and format of information;

- information transfer methods;

- procedure for the organization of exchange of information about movement of goods and vehicles.

Exchange of the preliminary information is performed upon termination of transactions of customs clearance and customs control of the state of one Party by customs authority and prior to carrying out such transactions by customs authority of the state of other Party.

Article 4

Information transferred according to the this Protocol has confidential character and shall be used only for the purposes of goods control and vehicles moved through customs borders of the State Parties of the Commonwealth of Independent States.

Transfer of information obtained according to the this Protocol to the third parties without written consent of the Party which transferred her is not allowed.

Article 5

Provisions of the this Protocol do not limit the Party in application of other, additional forms and methods of information exchange between the states of the Parties about the goods and vehicles moved through borders of the states of the Parties.

Article 6

By mutual consent of the Parties in the this Protocol changes and additions which are its integral part can be made and are drawn up by the separate protocols which are becoming effective according to the procedure, stipulated in Clause the 7th this Protocol.

Article 7

The this Protocol becomes effective from the date of its signing, and for the Parties which legislation of the states requires accomplishment of the interstate procedures necessary for its entry into force, from the date of receipt by depositary of the written notice of their accomplishment.

The this Protocol consists for action of the Agreement on cooperation and mutual assistance in customs affairs of April 15, 1994.

Each of the Parties can leave the this Protocol, having sent to depositary the written notice of such intention. In this case the Protocol stops the action in 6 (six) months from the date of receipt of the notification.

It is made to St. Petersburg on November 21, 2008 in one authentic copy in Russian. The authentic copy is stored in the Federal Customs Service (FCS of Russia) which will send to each state which signed the this Protocol, its verified copy.
