The agreement between the Government of the Russian Federation and the Cabinet of Ministers of Ukraine on cooperation in the field of the prevention of spread of the disease caused by human immunodeficiency virus (HIV infection)

The government of the Russian Federation and the Cabinet of Ministers of Ukraine which further are referred to as with the Parties

recognizing that the disease caused by human immunodeficiency virus (further - HIV infection), acquired mass distribution around the world and creates safety hazard of two countries, leads to serious social and economic and demographic consequences,

in view of the special social importance of problem in the conditions of visa-free regime between Russia and Ukraine and active migratory processes,

considering that programs of prevention of HIV infection are performed by Russia and Ukraine taking into account national interests,

confirming need of application of timely effective measures of complex prevention of HIV infection and acceptance of agreed measures for ensuring protection of the rights and interests of the population,

agreed as follows:

Article 1

For the purposes of this agreement the specified terms mean:

"HIV infection" - the disease caused by human immunodeficiency virus;

"HIV-positive people" - persons infected with human immunodeficiency virus;

"The state of temporary stay" - the state of the Party providing medical services to the patient who is not the citizen of this state.

Article 2

The parties will organize delivery of health care by HIV-positive and sick AIDS to citizens of the states of the Parties according to the Agreement on delivery of health care to citizens of the State Parties of the Commonwealth of Independent States of March 27, 1997.

Article 3

The parties, having complete independence in taking measures for ensuring prevention of HIV infection in the territories of the states, coordinate the actions directed to the prevention of this disease.

Article 4

The parties take measures for enhancement of epidemiological surveillance behind spread of HIV infection in the territories of the states with use of results of researches in vulnerable national groups.

Article 5

The parties provide control of safety of medical manipulations, donor blood, medical immunobiological supplies, biological liquids, bodies and fabrics.

Article 6

The parties guarantee to citizens of the states of the Parties available and free medical examination in the state and municipal organizations of health care of the states.

Medical examination for detection of HIV infection is performed by the medical organizations on the basis of the principles of confidentiality and voluntariness, except as specified, of the stipulated by the legislation states of the Parties.

Article 7

Authorized bodies of the Parties take measures for safety of medical examination both for osvidetelstvuyemy, and for person who is carrying out survey.

Article 8

The parties take measures for ensuring compliance with all rights and freedoms of HIV-positive citizens according to the legislation of the states.

The rights and freedoms of citizens of the state and persons living in the state of temporary stay in connection with availability of HIV infection at them can be limited only to the legislation of the state in the territory of which HIV-positive people are.

Article 9

The parties do not require from citizens of the states of the Parties of presentation of the certificate on absence HIV infection at them in case of entrance on the territory of the state.

Article 10

The party quickly informs other Party on identification in the territory of the state of one Party of HIV-positive citizens of the state of other Party.

Article 11

The parties take necessary measures to rapprochement of the national legal system for the HIV infection problem, and also timely inform each other on adoption of new regulatory legal acts in this area.

Article 12

The parties promote implementation of regular contacts, consultations and development of direct connections between the organizations dealing with problems of HIV infection, and also implementation of joint programs, projects and developments.

Article 13

The parties give opportunities for carrying out joint scientific research in the field of HIV/AIDS.

Article 14

The parties will organize preparation, advanced training of personnel and exchange of the specialists dealing with problems of HIV infection.

Article 15

The parties provide regular informing the population through mass media about necessary measures of prevention of HIV infection.

Article 16

The disagreements and disputes between the Parties connected with interpretation or application of this agreement are solved by negotiations and consultations.

Article 17

This agreement becomes effective from the date of the last notification on accomplishment of the interstate procedures by the Parties necessary for its entry into force and is effective within five years.

Its action will be prolonged automatically for the next five-year periods if any of the Parties does not notify in writing other Party at least, than in six months prior to the expiration of the next five-year period about the intention to terminate this agreement.

It is made in Kiev on January 28, 2003 in duplicate, everyone in the Russian and Ukrainian languages, and both texts are equally authoritative.
