About the Single state register of legal entities and individual entrepreneurs

1. Approve Regulations on the Single state register of legal entities and individual entrepreneurs it (is applied).

2. Determine that:

2.1. registering bodies – the Ministry of Finance, the National Bank, the Ministry of Justice Authorized for religions and nationalities, regional executive committees, the Brest, Vitebsk, Gomel, Grodno, Minsk, Mogilev Gorispolkoms, head departments of justice of regional executive committees, the Minsk Gorispolkom, administration of free economic zones, administration of the Chinese-Belarusian industrial park "Great Stone":

create the Single state register of legal entities and individual entrepreneurs (further - the Single register) (territorial part of the Single register) regarding data on state registration of legal entities and individual entrepreneurs, liquidation of legal entities (the termination of activities of individual entrepreneurs), changes and (or) additions made to charters of legal entities (foundation agreements - for the commercial organizations acting only under foundation agreements), the changes made to certificates on state registration of individual entrepreneurs, and also other data which are subject to inclusion in the Single register according to the legislation;

represent to the Ministry of Justice of the data according to the procedure, determined by this Ministry.

Regional executive committees have the right to delegate part of the powers on forming of the Single register to other local executive and administrative organs, and the called Gorispolkoms - to the relevant administrations of areas in the cities;

2.2. No. 15 is excluded according to the Resolution of Council of Ministers of the Republic of Belarus of 08.01.2013

2.3. the state bodies and the state organizations performing maintaining all-republican qualifiers within five days from the date of modification and (or) amendments of the specified qualifiers report about it in the Ministry of Justice.

3. To the Ministry of Finance annually when forming the draft of the republican budget for the next financial year to provide allocation to the Ministry of Justice of the means necessary for ensuring maintaining, maintenance and development of system of the Single register.

4. Recommend to regional executive committees and the Minsk Gorispolkom annually when forming local budgets for the next financial year to provide assignment, necessary for ensuring systematization and data storage about state registration of legal entities and individual entrepreneurs, and also transfers to the Ministry of Justice of data in electronic form for inclusion in the Single register.

5. To the registering bodies specified in subitem 2.1 of Item 2 of this resolution:

in two-month time to provide reduction of the regulatory legal acts in compliance with this resolution;

take other measures necessary for the organization of maintaining the Single register, including for the organization and upgrade of communication channels with the Ministry of Justice.

6. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of March 17, 2003 No. 359 "About some questions of maintaining the Single state register of legal entities and individual entrepreneurs" (The national register of legal acts of the Republic of Belarus, 2003, No. 38, 5/12186);

Regulations on the Single state register of legal entities and individual entrepreneurs

Chapter 1. General provisions

1. In this Provision the purposes, tasks, the principles of forming, content, procedure for forming and maintaining the Single state register of legal entities and individual entrepreneurs (further - the Single register), and also provisions of information from this register are determined.

2. The single register represents the nation-wide system of accounting and identification of legal entities and individual entrepreneurs intended for providing complete and reliable information about the legal entities and individual entrepreneurs registered in the Republic of Belarus about state bodies and the state legal entities, provisions on whom are approved by acts of the legislation, for maintaining other state registers (registers) containing the information about legal entities and individual entrepreneurs.

The register of representative offices of the foreign organizations and branches of foreign legal entities is subsystem of the automated information system of the Single register.

3. The single register is created on the basis of the principles:

completeness, reliability of the data containing in it, openness and their availability to general acquaintance, except for the data constituting the state secrets, the bank or protected by the law other secret;

efficiency, the accuracy of the information provided from the Single register to users of information resources;

information exchange with other information resources of the Republic of Belarus;

compliance to organizational, program and technical and methodological requirements.

4. The single register is kept for the purpose of:

ensuring single state accounting of legal entities and individual entrepreneurs in the Republic of Belarus;

ensuring the single principle of identification of legal entities and individual entrepreneurs in the Republic of Belarus;

informing according to the legislation of legal entities and physical persons on the data containing in the Single register;

coordination of names of legal entities;

implementation of other functions assigned to registering bodies.
